Eligibility: The Oklahoma City Thunder “Thunder Free Play” Promotion (“Promotion”) is only offered and open to individuals who at the time of participation are (i) legal residents of and are physically located in the fifty United States or District of Columbia and (ii) are age 18 years or older. Employees, officers and directors of Riverwind Casino and its operators, the Professional Basketball Club, LLC (the “Club”), the National Basketball Association and its member teams, NBA Properties, Inc., and each of their respective parents, subsidiaries, affiliates, partners, dealers, advertising and promotion agencies, manufacturers or distributors of promotion materials (collectively, “Promotion Entities”) as well as such person’s immediately families (parents, children, siblings, spouse) and/or persons living in the same household (whether related or not) are NOT ELIGIBLE to enter this Promotion or win a prize. Void where prohibited by law. All federal, state and local laws and regulations apply. The Promotion may only be entered in, or from, the state of Oklahoma. Entries originating from any other state or jurisdiction will be deemed ineligible. The Club reserves the right to verify the eligibility of winners before awarding any prize.

Promotion Period: The Promotion will run from the date and time that the Game (as defined below) is launched and available in the App (as defined below) through the conclusion of the 2023-24 Oklahoma City Thunder regular season (as defined below) (the “Promotion Period”). The Promotion Period is divided into weekly entry periods (each a “Weekly Entry Period”) as outlined in the section entitled “Winner Selection/Notification” and will incorporate the Oklahoma City Thunder regular season games scheduled to take place throughout the Weekly Entry Periods. The Club’s computer is the official time keeping device for the Promotion.

To Participate: During the Promotion Period, open the Official Oklahoma City Thunder Mobile App (“App”) and click on the “Thunder Free Play” button (“Promotion Button”). If you do not have the App, you can download it for free on the iOS and Android operating systems. After clicking the Promotion Button, you will need to confirm that you are eighteen (18) years of age or older by entering your birthdate, and if a first-time user, complete the required information (username, email, zip code) to participate in the Promotion. Participants are responsible for ensuring that all required information is accurate. Limit one (1) registration form submission per person and per email address for the duration of the Promotion Period. Additional registration forms received from any such person or email address after the first registration form received from that person or email address will be void. The use of a script, macro or any other device to automate or subvert the registration process is prohibited and all such registrations will be void. Registration form submissions will be accepted throughout the Promotion Period, in accordance with the terms of these Official Rules.

After completion of the registration process, you will be given access to the “Thunder Free Play” home page (“Game Home Page”) within the App. Visit the Game Home Page and follow the instructions to play the “Thunder Free Play” predictive game (the “Game”).

(a) Object of the Game: The object of the Game is to earn as many points as possible during a Weekly Entry Period. A Weekly Entry Period will begin on Sunday at 12:01 AM during each week of the Promotion Period and end at 11:59 on Saturday during each week of the Promotion Period. Prizes will be awarded to the participants with the most points (i) in each Weekly Entry Period and (ii) at the end of the Promotion Period, as further described in the “Prizes” section below.

(b) How to earn Points: Participants may earn points in the Game in the following ways:

(1) A user will receive 500 coins after registration to use throughout the Promotional Period. The user will be eligible to earn points through wagering their coins, as well as correctly predicting the outcome of the provided scenarios.

(2) The user will earn eligible points in two different ways during each game:

(i) Some predictions will ask the user to wager their coins. The amount of points a user wins is based on the total number of coins wagered for that prediction.

(ii) Some predictions will be free pick. If the user guesses the prediction correctly they earn more points. Once a user has locked in their prediction, the user will not be able to change their selection. Additionally, once the game begins, any remaining unanswered predictions will be closed and the user will not be able to answer said prediction.

(3) A user may roll their winning points over from game-to-game during each of the weekly or grand promotional periods. Once a user has logged winnings into the leaderboard, those winnings will not be lost, even if the user risks those winnings on subsequent games.

Winner Selection/Notification: Potential winners of each Weekly Entry Period will be determined on or about two (2) days following the end of each Weekly Entry Period. One (1) prize will be awarded for each Weekly Entry Period to the participant who logs the highest number of valid points to the leaderboard for the applicable Weekly Entry Period. One (1) grand prize will be awarded for the participant who accumulates the highest number of valid points during the Promotion Period.

In the event of a tie for any weekly or grand prize, the winner(s) will be determined in chronological order, based on when each participant reached the point total. The tabulation of points, administration of tiebreakers, and identification of potential winners will be conducted by the Club, whose decision is final and binding with respect to these Official Rules and in all other matters relating to this Promotion. Each prize will be awarded to the authorized account holder of the email address identified in the registration form, regardless of whether that is the person named on the applicable registration form (subject to verification of eligibility and compliance with the terms of these Official Rules). Potential winners will be notified by Club via email throughout the Promotion Period. If a potential winner cannot be contacted; is ineligible according to these Official Rules; declines his/her prize for any reason whatsoever; otherwise fails to fully comply with these Official Rules; or if prize notification is returned as undeliverable, the potential winner will forfeit his/her prize and the prize may be awarded to an alternate winner or the Club may retain the prize.

Prize Details: All costs and expenses associated with the acceptance and use of any prizes awarded in connection with the Promotion, including, but not limited to, all federal, state and local taxes, and other miscellaneous expenses (including, but not limited to, meals, personal expenses, activities, tips, incidental room charges, travel (except as otherwise specifically provided for herein), ground transportation (if applicable)) are each winner’s sole responsibility. Prizes are awarded “as is” without any warranty or guarantee, either express or implied by the Club. The Club has no obligations or commitments to any winner or his/her guests in connection with this Promotion. Prizes will be rewarded on a weekly duration.

Weekly prizes will consist of one (and only one) of the following:

One (1) Grand Prize Winner will receive a trip for two (2) to see the Oklahoma City Thunder play in an away market for the 2024-25 NBA Season. Trip includes round-trip airfare for two (2) and accommodations in one (1) hotel room for winner and guest for two (2) nights for the away game, two (2) Thunder Swag Bags, and two (2) tickets to an Oklahoma City Thunder Summer League Game. All details, including dates, airline, hotel and tickets location to be determined by Club and subject to availability. Approximate Total Grand Prize Value: $2,500.

Approximate Total ARV of all prizes awarded: $23,000.

If tickets to Thunder basketball games are awarded as a prize additional terms, restrictions, and exclusions may apply (see front and back of game tickets for additional terms and exclusions). All game tickets are subject to verification and are void and will be rejected if not obtained through authorized, legitimate channels, or if any part of any game ticket is determined by Club or Club’s agent or representative (including but not limited to Club employees or contractors) to be illegible, forged, reproduced, manipulated, mutilated, counterfeited, or tampered with in any way, or if game ticket contains printing, typographical, mechanical, or other errors.

In the event that an Oklahoma City Thunder basketball game or any part of it is cancelled, postponed or preempted for any reason, including weather, no rain checks, exchanges, substitution or cash replacement value of any game ticket prize will be provided except at the Club’s discretion. In the event a winner and/or a winner’s guest at an Oklahoma City Thunder basketball game (“Guest”) engages in behavior during the basketball game that (as determined by Club in its sole discretion) is obnoxious or threatening, illegal, or that is intended to threaten or harass any other person, or that in any way disparages or adversely affects the reputation, image, and/or customer goodwill of the Club and any of Club’s services, products, trademarks, service marks, or logos, Club reserves the right to terminate prize redemption and eject winner and/or Guest from the basketball game with no further obligations or compensation whatsoever to winner and/or Guest (which may, in the Club’s sole discretion, result in such winner’s disqualification from the Promotion and forfeiture of a prize). In the event winner or Guest engages in behavior during a basketball game that (as determined by the Club in its sole discretion) is illegal, tortious, or subjects winner or Guest to arrest or detention, the Club shall have no obligation to pay any damages, fees, fines, judgments or other costs or expenses of any kind whatsoever incurred by winner or Guest as a result of such conduct. Each winner and such winner’s guest agree to abide by all rules and policies of the applicable NBA arena and are subject to removal for noncompliance or unruly behavior.  THE CLUB (INCLUDING ITS EMPLOYEES OFFICERS AND DIRECTORS) SHALL HAVE NO LIABILITY FOR ANY PERSONAL INJURIES, DEATH, PROPERTY DAMAGE, OR OTHER DAMAGES OR EXPENSES RESULTING FROM OR ARISING OUT OF THE WINNER’S OR ANY GUEST’S ATTENDANCE AT ANY BASKETBALL GAME OR ANY OTHER ASPECT OF WINNER’S OR ANY GUEST’S ACCEPTANCE OR USE OF A PRIZE.

Miscellaneous: No transfer, assignment, cash redemption, or substitution of a prize (or portion thereof) is permitted except by the Club, who reserves the right to substitute a prize (or applicable portion thereof), at its sole discretion. The Club reserves the right to void and remove any and all predictions and resulting points of a participant who the Club believes has attempted to tamper with, influence, or impair the administration, security, fairness, judging or proper play of this Promotion and such participant will be disqualified and all associated predictions and resulting points will be void. Potential winners may be required to execute and return a prize claim form (including an affidavit of eligibility and liability and publicity release) within seven (7) days of date of issuance of notification. Participation in the Promotion constitutes each participant’s and each winner’s consent to the Club’s and its agents’ use of winner’s name, likeness, photograph, video, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration. By participating, participants agree that the Club reserves the right to conduct a background check and entry in the Promotion constitutes participant’s permission for Club to conduct such background check, provided that, to the extent additional authorization is necessary under law, participants shall authorize such check. Club reserves the right (at its sole discretion) to disqualify any participant based on the results of the background check or failure of the participant to properly authorize such check). The Club reserves the right, in its sole discretion, to modify, suspend, and/or terminate this Promotion (or portion thereof) for any reason, including should viruses, bugs, non-authorized human intervention or other causes corrupt or impair the administration, security, fairness or proper play of the Promotion or for any other reason and, in the case of termination, at its discretion, select the winners for the prizes at issue from all eligible non-suspect predictions and points tabulated prior to the event that required such termination. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE THUNDER MOBILE APPLICATION OR UNDERMINE THE LEGITIMATE OPERATION OF THIS PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, CLUB RESERVES THE RIGHT TO SEEK ANY AND ALL REMEDIES AVAILABLE FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

Agreement to Official Rules: By participating in the Promotion, participants agree to be bound by these Official Rules and the decisions of the Club (including but not limited to the Club’s employees or agents handling prize redemption), which are final and binding in all matters relating to the Promotion. The Club reserves the right to change these Official Rules at any time in their sole discretion. By participating in the Promotion, each participant waives any right to claim ambiguity in these Official Rules.

Release; Indemnification; Limitation of Liability: By participating in the Promotion, each participant agrees to forever and irrevocably release and hold harmless each of the Promotion Entities and each of their respective officers, directors, governors, members, partners, partnerships, principals, employees, volunteers, representatives, agents, affiliates, related entities, successors and assigns (collectively, the "Released Parties"), from any and all liability for any loss, harm, damage, injury, cost or expense whatsoever including without limitation, property damage, personal injury (including emotional distress), death, attorneys' fees, loss of enjoyment, defamation, invasion of privacy, or the violation of personal or publicity rights, which may occur in connection with (a) the Promotion or any element thereof, including entry or participation therein, (b) delivery, possession, acceptance and/or use or misuse of any prize or component thereof, or (c) participation in any Promotion-related activity or prize-related activity. In addition, by participating in this Promotion, each participant agrees to indemnify and hold harmless the Released Parties from and against any and all damages, losses, amounts paid in settlement, costs and expenses (including reasonable attorneys' fees and expenses) incurred by any of the Released Parties in connection with any third-party claim, demand, liability, suit, proceeding or action arising out of or resulting from (i) breach or alleged breach of any representations, warranties or agreements of participant hereunder, or (ii) participant's possession, use or misuse of any prize or component thereof. Each participant hereby acknowledges that the Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to any of the prizes (or any components thereof). Without limiting the generality of the foregoing, each prize is provided "as is" without warranty of any kind, either express or implied, and the Released Parties hereby disclaim all such warranties, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose and/or non-infringement. The Released Parties are not responsible or liable for entries that are: (i) entered by other than human means (such as by an automated computer program or any non-human mechanism, entity, or device), (ii) in excess of the stated entry limit, or (iii) illegible, incorrect, inaccurate, delayed, late, forged, destroyed, lost, misplaced, stolen, misdirected, tampered with, incomplete, deleted, damaged, garbled, altered or otherwise not in compliance with these Official Rules, whether caused by (A) any of the equipment or programming associated with or utilized in the Promotion, (B) any technical or human error which may occur in the processing of entries in the Promotion, or (C) for failure to receive entries due to transmission failures or technical failures of any kind, and all such entries will be disqualified. In addition, the Released Parties shall have no responsibility or liability in connection with: typographical errors in Promotion promotional material; cancellations and/or delays or any change by any company or any other persons providing any component of a prize due to reasons beyond the control of any of the Released Parties; any interruptions/postponement/cancellation of Promotion; human error; any technical malfunctions of the computer on-line system, computer dating mechanism, computer equipment, software, or internet service provider utilized by any of the Released Parties or by participant; interruption or inability to access the Promotion, any Promotion-related Web pages, or any on-line service via the Internet due to hardware or software compatibility or other problems; any damage to participant's (or any third person's) computer and/or its contents related to or resulting from any part of the Promotion; any lost/delayed data transmissions, omissions, interruptions, defects; and/or any other errors or malfunctions, even if caused by the negligence of any one or more of the Released Parties.

Arbitration: As a condition of participating in this Promotion, each participant agrees that: (i) any and all disputes and causes of action arising out of or connected with this Promotion, or any prizes awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration in Oklahoma City, Oklahoma conducted under the applicable rules promulgated by the American Arbitration Association; (ii) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; (iii) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion not to exceed $50 but in no event including attorneys' fees and (iv) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will participant be permitted to obtain awards for, and participant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys' fees, other than participant’s actual out-of-pocket expenses (i.e., costs associated with participating in this Promotion), and participant further waives all rights to have damages multiplied or increased.

Privacy and Use of Participant Information for Marketing Purposes: All personal information that participants submit will be subject to the Club’s privacy policy at okcthunder.com. By signing up, participant gives Club the right to use personally identifiable information collected during participant's participation in this Promotion for marketing and advertising purposes. Participant may opt-out of these communications from Club as provided in such communications. Further, by participating participants give the Club the right to share such personal information with Riverwind Casino, its affiliates, subsidiaries, agents and marketers to be used for marketing and advertising purposes. Participant may opt-out of these communications from Riverwind Casino as provided in such communications.

Choice of Law: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant and Promotion Entities in connection with the Promotion, shall be governed by, and construed in accordance with, the substantive laws of the State of Oklahoma.
