Terms and Conditions

The following Terms and Conditions (“Agreement”) describe the terms and conditions that apply to the use of your Milwaukee Bucks Gift Card, electronic or physical, that is sold or issued in the United States as described herein (“Bucks Gift Card”). This Agreement is between you, the holder of a Bucks Gift Card (the “Cardholder”), and Milwaukee Bucks, LLC (the “Issuer”). By purchasing, accepting or using your Bucks Gift Card, you agree to be bound by this Agreement. If you do not agree with this Agreement, do not purchase, use or accept the Bucks Gift Card.

IMPORTANT: This Agreement includes a mandatory arbitration provision that, as further set forth below, requires the use of arbitration on an individual basis to resolve disputes.

  1. No Cash Redemption. The Bucks Gift Card has no cash value and may not be redeemed or returned for cash except as required by applicable law.
  2. Non-Payment. The Issuer reserves the right to refuse to honor any Bucks Gift Card in the event of a disputed credit card charge, bounced check or other failure of consideration.
  3. Acceptance Locations. Unless other restrictions apply, Bucks Gift Cards may be used at shop.bucks.com, Fiserv Forum ticket office, Bucks administrative ticket office, Bucks Pro Shop at Fiserv Forum, and at Fiserv Forum food and beverage areas (where credit cards are accepted).
  4. Bucks Gift Card Balance Inquiry. For Bucks Gift Card balance inquiries, please visit https://www.nba.com/bucks/shop/gift-cards.
  5. Expiration; No Fees. The Bucks Gift Card generally expire sixty (60) months from the date of purchase. No inactivity or “dormant” fees apply to any Bucks Gift Card.
  6. Reloadable.  Bucks Gift Cards are not able to be reloaded.
  7. Refunds and Returns. The Bucks Gift Card is not refundable except as required by applicable law. Products and services purchased using a Bucks Gift Card will be subject to the return policy of the applicable location of purchase.
  8. No Resale. The Bucks Gift Card may not be resold or traded. A Bucks Gift Card is not valid and will not be honored, and the Issuer will not be liable for the value of the Bucks Gift Card, if the Bucks Gift Card is obtained from an unauthorized seller or reseller, including through any Internet auction site.
  9. Use of Marks. Use of Issuer’s name, logo, trade dress (including any image/likeness of the cards) or trademarks (or those of any of its subsidiaries or affiliates) in connection with the purchase or use of Bucks Gift Card in any manner that states or implies that any person, website, business, product or service is endorsed or sponsored by, or otherwise affiliated with, Issuer or any of its subsidiaries or affiliate is prohibited.
  10. Lost, Damaged or Stolen Bucks Gift Cards. A Bucks Gift Card cannot be replaced or refunded if lost, damaged or stolen The Issuer is not responsible for unauthorized use of any Bucks Gift Card.
  11. Fraud. The Issuer reserves the right to refuse to honor a Bucks Gift Card if the Issuer suspects that the Bucks Gift Card was obtained fraudulently.
  12. BINDING ARBITRATION AND CLASS ACTION WAIVER. Please read this section carefully. It affects legal rights that you may otherwise have and requires individual, final and binding arbitration of most disputes instead of resolution in court. 

EXCEPT FOR DISPUTES THAT QUALIFY FOR SMALL CLAIMS COURT, ALL DISPUTES ARISING OUT OF OR RELATED TO THIS AGREEMENT OR ANY ASPECT OF THE RELATIONSHIP BETWEEN YOU AND ISSUER (INCLUDING ANY PRODUCTS OR SERVICES OFFERED OR SOLD BY ISSUER), WHETHER BASED IN CONTRACT, TORT, STATUTE, FRAUD, MISREPRESENTATION, OR ANY OTHER LEGAL THEORY, WILL BE RESOLVED THROUGH FINAL AND BINDING ARBITRATION BEFORE A NEUTRAL, SINGLE ARBITRATOR INSTEAD OF IN A COURT BY A JUDGE OR JURY, AND YOU AGREE THAT ISSUER AND YOU ARE EACH WAIVING THE RIGHT TO SUE IN COURT AND TO HAVE A TRIAL BY A JURY.   DISPUTE SHALL BE INTERPRETED AS BROADLY AS PERMITTED UNDER THE LAW AND SHALL COVER ANY CLAIMS THAT AROSE BEFORE THESE OR ANY PRIOR AGREEMENTS.  YOU AGREE THAT ANY ARBITRATION WILL TAKE PLACE ON AN INDIVIDUAL BASIS; AS SET FORTH BELOW, CLASS ARBITRATIONS AND CLASS ACTIONS ARE NOT PERMITTED AND YOU ARE AGREEING TO GIVE UP THE ABILITY TO PARTICIPATE IN A CLASS ACTION.  The arbitration will be administered by Judicial Arbitration Mediation Services, Inc. (“JAMS”) pursuant to the JAMS Streamlined Arbitration Rules & Procedures effective July 1, 2014 (the “JAMS Rules”) and as modified by this agreement to arbitrate.  The JAMS Rules, including instructions for bringing arbitration, are available on the JAMS website at https://www.jamsadr.com/rules-streamlined-arbitration/. The Minimum Standards are available at https://www.jamsadr.com/consumer-minimum-standards/.

The arbitrator will conduct hearings, if any, by teleconference or videoconference, rather than by personal appearances, unless the arbitrator determines upon request by you or by us that an in-person hearing is appropriate.  Any in-person appearances will be held at a location in Milwaukee, Wisconsin.  The arbitrator will follow this Agreement and his or her award will be final and binding.  Notwithstanding any of the foregoing, nothing in this Agreement will preclude you from bringing issues to the attention of federal, state, or local agencies and, if the law allows, they can seek relief against us for you.

THERE SHALL BE NO RIGHT OR AUTHORITY FOR ANY DISPUTE TO BE ARBITRATED OR LITIGATED ON A CLASS ACTION, JOINT, OR CONSOLIDATED BASIS OR ON BASES INVOLVING CLAIMS BROUGHT IN A PURPORTED REPRESENTATIVE CAPACITY ON BEHALF OF THE GENERAL PUBLIC (SUCH AS A PRIVATE ATTORNEY GENERAL), OTHER ISSUER CUSTOMERS, OR OTHER PERSONS.  THE ARBITRATOR MAY AWARD RELIEF ONLY ON FAVOR OF THE INDIVIDUAL PARTY SEEKING RELIEF AND ONLY TO THE EXTENT NECESSARY TO PROVIDE RELIEF WARRANTED BY THAT INDIVIDUAL PARTY’S CLAIM.  THE ARBITRATOR MAY NOT AWARD RELIEF FOR OR AGAINST ANYONE WHO IS NOT A PARTY.  THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS, AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR CLASS PROCEEDING.  THIS WAIVER OF CLASS ACTIONS AND COLLECTIVE RELIEF PARAGRAPH IS AN ESSENTIAL PART OF THIS ARBITRATION PROVISION AND CANNOT BE SEVERED FROM IT.  THE REMAINING PORTIONS OF THIS ARBITRATION PROVISION ARE NOT ESSENTIAL PARTS OF THIS ARBITRATION PROVISION AND CAN BE SEVERED FROM IT BY A COURT OF COMPETENT JURISDICTION.  NOTWITHSTANDING THE FOREGOING, IF A COURT DETERMINES THAT PUBLIC INJUNCTIVE RELIEF MAY NOT BE WAIVED AND ALL APPEALS FROM THAT DECISION HAVE BEEN EXHAUSTED, THEN THE PARTIES AGREE THAT THIS ARBITRATION PROVISION SHALL SURVIVE AND ANY CLAIM FOR PUBLIC INJUNCTIVE RELIEF SHALL BE STAYED PENDING ARBITRATION OF THE REMAINING CLAIMS. 

This arbitration provision shall survive any termination of this Agreement.  Any amendments to this arbitration provision shall not affect any pending asserted claim or arbitration proceeding.

  1. Limitation of Liability. THE ISSUER MAKES NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO THE BUCKS GIFT CARDS, INCLUDING, WITHOUT LIMITATION, ANY EXPRESS OR IMPLIED WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. IN THE EVENT THAT A BUCKS GIFT CARD IS NON-FUNCTIONAL, YOUR SOLE REMEDY, AND THE SOLE LIABILITY OF THE ISSUER AND ITS AFFILIATES, SHALL BE THE REPLACEMENT OF SUCH BUCKS GIFT CARD. CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS OR LIMITATIONS MAY NOT APPLY TO YOU.
  2. Governing Law. The laws of the State of Wisconsin, without regard to principles of conflict of laws, shall exclusively govern this Agreement and the use of your Bucks Gift Card.
  3. Compliance with Laws. By purchasing a Bucks Gift Card, you are certifying and representing to Issuer that the activities in connection with which the Bucks Gift Card will be used will comply with this Agreement and all appliable laws, rules and regulations and that the Bucks Gift Card will not be used in any manner that is misleading, deceptive, unfair or otherwise harmful to consumers or Issuer. In addition, you agree to defend and indemnify Issuer and its subsidiaries and affiliates from and against any claims, expenses or liabilities made against or incurred by any of them in connection with your use of the Bucks Gift Card or violation of any of this Agreement.
  4. Severance. Notwithstanding anything herein to the contrary, if any part of this Agreement is deemed invalid or inapplicable, such provision shall be modified or restricted to the extent and in the manner necessary to render it valid, legal and enforceable. If such provision cannot be so modified or restricted, it shall be excised from this Agreement without affecting the validity, legality or enforceability of the remainder of this Agreement, which shall be fully enforced.
  5. Changes to Agreement. The Issuer reserves the right to modify, alter, change or amend this Agreement from time to time in its discretion without advance notice. The current version of this Agreement is available at https://www.nba.com/bucks/shop/gift-cards.
