Season Ticket Member Standard Terms & Conditions

Thank you for your support of the Sacramento Kings. By signing your order form or purchasing a Sacramento Kings Season Ticket Membership (“Membership”) you accept this Agreement, and understand it is a legally binding agreement between you and Sacramento Kings Limited Partnership (“SKLP”). SKLP may enforce the terms and conditions contained herein in its sole discretion.

REVOKABLE LICENSE

An order to purchase a Membership is an offer, which SKLP may accept or reject at any time in its sole discretion. SKLP owns and controls all rights to the seat locations for all home games. If you purchase a Membership, you will receive a ticket as a revokable license to use the seat location for designated home games. Access to digital ticket management shall be granted no later than 7 days prior to the 1st game of the season, and only upon receipt of full payment. The license is subject to all Sacramento Kings, Golden 1 Center, and National Basketball Association (“NBA”) rules, regulations and policies. The Sacramento Kings may revoke the license at any time.

MONTHLY MEMBERSHIP PLANS

I understand that by selecting the Monthly Membership Plan, the initial payment will be charged today (or has already been charged per my authorization) and subsequent equal monthly installment charges will be made to my authorized credit card and due on the 1st of each month (or next business day thereafter) beginning on the date of this Agreement for the 2023-24 season (the “Initial Term”). Each twelve (12) month period beginning April 1 and ending March 28 shall be referred to herein as a “Contract Year”; provided that the initial Contract Year shall begin upon signing this Agreement and the final Contract Year shall terminate at the end of the Sacramento Kings regular season during which the Membership is cancelled. By way of example, if the Membership is cancelled on March 28, 2024, the final Contract Year will terminate at the end of the 2023-24 regular season. I acknowledge that my Kings Membership will automatically renew in March of each successive year after the initial term. The Sacramento Kings reserve the right to deny membership renewal privileges to any season ticket member for any reason in its sole discretion. Payments must be made on the dates specified by SKLP. In the event you fail to make any timely required payments, your Membership will terminate, and any payments you made prior to the termination date will be forfeited by you. I hereby authorize SKLP to charge my credit/debit card for all Membership dues, including season ticket payments. The foregoing payment authorization shall remain in effect for so long as your Membership remains in effect. I hereby warrant that I have the authority to authorize charges to the listed account for the purpose of paying my Membership dues. I understand that SKLP reserves the right, upon written notification, to terminate this payment option and/or my Membership. SKLP reserves the right to restrict entry to Sacramento Kings games or Membership events and/or revoke Membership privileges if scheduled installment payments are not timely paid and/or if any authorized charge is refused by the credit card company or banking institution for any reason. I will promptly notify SKLP of any changes to my credit/debit account numbers and this authorization shall remain in effect for the new account number(s). Failure to continue scheduled payments in the event of canceled or rescheduled games may subject your membership to cancellation. SKLP reserves the right to attempt to collect all or portions of declined charges on any date following the agreed upon payment date and to charge a processing fee in the event a charge is refused for any reason.

PER SEAT PER GAME CAPITAL REPAIR FEE

In addition to the per seat per game price, a fee of $1.28 per seat per game will increase the price of Kings Season Membership (which amount shall increase each NBA season by the greater of 3% and the increase in the Consumer Price Index as required by the City of Sacramento), and such amounts shall be due and payable concurrently with Membership dues with respect to the corresponding NBA season.

ACCOUNT REGISTRATION

You will be required to register for an account and provide certain contact information to manage your tickets electronically. Your account username may not include the name of another person. SKLP reserves the right to deny account access or require you to change your username (e.g. if the username is vulgar, or the account is not secure) in its sole discretion. You are responsible for all activity and purchases through your account. You must notify us in writing immediately if you discover any unauthorized use of your account. SKLP may accept or reject payment from a third party in its sole discretion.

CANCELLATION

After the Initial Term you may cancel your Membership for any subsequent Contract Year by completing a form provided by your Membership Manager. The form must be complete and submitted by March 28 of the then-current Contract Year. Each Contract Year, SKLP will provide one (1) email reminder prior to the March 28 deadline to the email address on file. Upon receipt by SKLP of a complete cancellation, you will no longer be obligated for any future payments toward the subsequent Contract Year, but shall not be entitled to any refund for payments made prior to the cancellation.

PER PERSON LIMIT

SKLP retains the right to impose maximum purchase limits in its sole discretion. This includes all forms of ticket purchases, including but not limited to ticket packages, group tickets, discount or promotional offers or links, and any transactions through third party service provider or ticket sales links. You may not purchase more than the maximum tickets, as designated by SKLP, per Sacramento Kings game whether through one or multiple season ticket memberships or partial plan season subscriptions. You may not avoid the ticket limit by purchasing, coordinating, or directing purchases through aliases, separate forms of payment, separate corporate entities or third parties.

NON-TRANSFERABLE

You have no right to transfer contracts or seat locations to any person or entity. Any attempt to sell or otherwise transfer Membership privileges is invalid and may result in the cancellation of your Membership and all associated privileges. Any request to distribute tickets to a third party, whether as a result of bankruptcy or otherwise, may result in cancellation of your season ticket membership, including membership renewal privileges, without refund, credit, or makegoods.

ALL SALES FINAL. NO REFUNDS, CANCELLATIONS, OR EXCHANGES OF DEPOSIT MONEY ON ACCOUNT.

ALL sales are final. There will be no refunds, cancellations, or exchanges. Notwithstanding the termination of your Membership for any reason, you remain liable for the full payment of your Membership dues and you forfeit any payments you made prior to the termination date.

TICKET RESALE POLICY

You acknowledge the intent of your Membership is to support the Sacramento Kings and not to generate financial gain. In the event you are unable to use and desire to re-sell a ticket, you shall only do so through Ticketmaster’s resale feature. You acknowledge and agree that SKLP may monitor your ticket resale, trade and/or transfer activity. In the event that (a) you sell, attempt to sell, or engage a third party to sell on your behalf a substantial portion of your tickets or (b) SKLP determines that you have sold tickets for the primary purpose of generating financial gain or advertising or promotional gain, SKLP reserves the right, in its sole discretion, to revoke your Membership and license to use the tickets immediately upon written notice to you and pursue all legal rights and remedies available.

PLAYOFFS

You will receive an opportunity to purchase your seat(s) for home playoff games unless otherwise notified by SKLP. Playoffs are at an additional cost to your membership dues.

SEAT LOCATION CHANGES

Requests for seat relocation are processed during the renewal period only. Requests for relocation will be considered in SKLP’s sole discretion and only if Membership dues are paid up to date.

ROLL-OVER CREDIT

Upon selection of your seats for the 2023-24 season, funds from any games played without fans in Golden 1 Center due to government or NBA restrictions will be credited to your account for future Sacramento Kings games.

RESTRICTIONS

Your ticket(s) may not be used for any form of commercial or trade purposes, including, but not limited to, advertising, promotions, contests or sweepstakes, without the express written consent of SKLP and the NBA.

USE OF IMAGE

You (or the user of the ticket for any particular game) grant permission to SKLP and the NBA (and its designees and agents) to utilize your image, likeness, actions and statements in any live or recorded audio, video or photographic display or other transmission, exhibition, publication or reproduction made of or at the game in any medium or context for any purpose, including commercial or promotional purposes, without further authorization or compensation.

ASSUMPTION OF RISK AND RELEASE OF LIABILITY

You or the holder of the ticket to any game or event voluntarily assume all risk and danger of personal injury (including death) and all hazards arising from, or related in any way to, the game (including, but not limited to, injuries caused by players, fans, basketballs or other objects) whether occurring prior to, during or after the game, howsoever caused and whether by negligence or otherwise. You and your guests agree that neither SKLP, the NBA, or their respective affiliates, parents, subsidiaries, employees, agents or owners are liable for any injuries from such causes.

GOVERNING LAW AND DISPUTE RESOLUTION

This Agreement is subject to the laws of the State of California. All disputes arising from or relating to this Agreement, including failure to pay, shall be filed in the state and federal courts located in Sacramento County, California, unless SKLP advises you in writing that SKLP elects to have the dispute decided by arbitration. If SKLP elects to have a dispute arbitrated, then such dispute shall be determined by binding arbitration in Sacramento County, California before an arbitrator selected by SKLP. The parties shall equally advance the costs incurred by arbitration. The parties agree that the arbitrator shall award costs, including attorneys’ fees, to the prevailing party in the arbitration proceedings. The arbitration award shall be final and binding on the parties and judgment upon the arbitrator’s award may be entered in, and enforceable by, any court of competent jurisdiction. You acknowledge and agree that any arbitration arising under or related to this Agreement and any arbitrations arising under or relating to another similar agreement filed by SKLP, that have common issues of fact or law may be consolidated into one or more proceeding(s).

RIGHTS RESERVED SKLP

SKLP reserves the right in its sole discretion to amend, update or modify this Agreement and the terms and conditions herein from time to time.
