This Sweepstakes may be modified, canceled, or postponed by Sponsor at any time in its sole discretion due to pandemic (e.g., Coronavirus/COVID-19).
Eligibility: The NBA Member Days Sweepstakes (“Sweepstakes”) is only open to legal permanent residents of the fifty (50) United States, the District of Columbia, and Canada (excluding Quebec), who are the legal age of majority in their state of residence at the time of entry (each, an “Entrant”). Employees, officers, directors, representatives and agents of NBA Properties, Inc. (“Sponsor”), NBA Media Ventures, LLC, the National Basketball Association (“NBA”), the Women’s National Basketball Association, the NBA 2K League, their collective member teams, and any applicable Players Union including but not limited to the National Basketball Players Association and the National Basketball Retired Players Association (collectively, the “NBA Entities”), and each of their respective parent companies, subsidiaries, affiliates, officers, governors, owners, distributors, retailers, advertising/promotion agencies and teamDigital Promotions, Inc. (collectively, “Released Parties”), and the immediate family members (parent, spouse, sibling or child and their respective spouses, regardless of where they reside) and those living in the same household of each, whether or not related, are not eligible to participate or win a prize. Void in Quebec and where prohibited by law. The information you provide as detailed below will only be used for Sweepstakes purposes. Sweepstakes is subject to all applicable federal, state, and local laws.
Sweepstakes Period: The Sweepstakes begins at 7:00:00 am Eastern Time (“ET”) on 4/8/24 and ends at 11:59:59 pm ET on 4/19/24 (“Sweepstakes Period”).
How To Participate: During the Sweepstakes Period you may access the Sweepstakes in one of the following ways: i) Visit nba.com/id (the “Website”); or ii) Using a wireless device access the NBA App (the ‘App’) on iOS or Android and sign in with your NBA ID, or create a new NBA ID. Once signed into your NBA ID account you can follow the links to the enter the Sweepstakes in accordance with the instructions provided.
Limit one (1) Entry per NBA ID, person and e-mail address, regardless of the number of email addresses used per day. Additional entries received from any one person or email address thereafter during any one day will be void.
The NBA ID program is free. Data and usage rates may apply to download, installation, and use of the Sweepstakes’ mobile App (“App”) or of a mobile phone or other web-enabled device, check with your service provider for details on these and other charges. Wireless service is not available in all areas. Incomplete registrations are void.
Released Parties are not responsible for lost, incomplete, illegible, late, misdirected, stolen, undelivered, misdirected, damaged, or garbled entries; any error, omission, interruption, defect or delay in transmission, interrupted or unavailable network, cable, satellite, Internet Service Provider (ISP), server or other connections; miscommunications, failed computer hardware or software or technical failures; garbled, misrouted or scrambled transmissions; incomplete entries or communications; the cancellation or postponement of any game, or other errors; printing, typographical or other errors appearing within these Official Rules, in any Sweepstakes-related advertisements or other materials; or other errors or problems of any kind whether mechanical, human, computer, electronic, mail or otherwise relating to or in connection with the Sweepstakes, including, with limitation, errors or problems which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the prize, or the cancellation or postponement of any events or games. Sponsor reserves the right, in its sole discretion, to void any and all entries of an Entrant who they believe has attempted to tamper with or impair the administration, security, fairness or proper play of this Sweepstakes. ANY ATTEMPT BY A PERSON TO DAMAGE ANY WEBSITE (INCLUDING THE SWEEPSTAKES WEBSITE) OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK ALL LEGAL AND EQUITABLE REMEDIES FROM AND AGAINST ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Entries that are in excess of the stated limits, incomplete, illegible, corrupted, damaged, destroyed, forged, false, lost, late or misdirected, deceptive or otherwise not in compliance with the Official Rules may be disqualified from the Sweepstakes at Sponsor’’ sole and absolute discretion. The use of automated or similar devices, which subvert the entry process, including but not limited to entries submitted using any bot, macro, script, or Sweepstakes service (or any other devices intended to automate any aspect of entry) to enter this Sweepstakes is prohibited and entries through such devices are void. The Website’s database clock will be the official timekeeper for this Sweepstakes. Illegible and/or incomplete entries and entries submitted by Entrants who do not meet the eligibility requirements (including all requirements with respect to age and residence) are void. Those who do not follow all of the instructions, provide the required information in their entry form, or abide by these Official Rules or other instructions of the Sponsor may be disqualified. Entrants further agree to abide by these Official Rules and the decisions of the Sponsor and judges, which shall be final and binding.
Winner Determination: On or about 4/25/24, one (1) potential winner will be selected in an individual random drawing from among all eligible entries received during the Sweepstakes Period by Administrator, an independent judging organization, whose decisions will be final and binding in all matters relating to this Sweepstakes. Odds of winning the Prize will depend on the number of eligible entries received for the drawing.
Winner Notification: By entering, Entrants agree to be bound by these Official Rules and to the decisions of the Sponsor and judges, which will be final and binding in all respects. The potential Prize winner will be notified by email.
The potential Prize winner will be required to execute and return an Affidavit of Eligibility, Liability Release and (where legal) Publicity Release within (5) days of date of issuance of notification. Non-compliance with the foregoing or with these Official Rules in any way, the inability to contact a potential winner (as specified above) or return of prize or prize notification as non-deliverable may result in disqualification and, at Sponsor’s discretion, the awarding of the applicable prize to an alternate potential winner in a random drawing from among all remaining entries. Prize will be awarded to the person named on the applicable entry (subject to verification of eligibility and the terms of these Official Rules). In the event of a dispute as to the identity of any Entrant, the Entrant will be deemed the authorized account holder of the e-mail address submitted at the time of entry provided that such individual is eligible and such individual complied with these Official Rules. “Authorized account holder” is defined as the natural person who is assigned to the e-mail address by an Internet access provider, online service provider or other organization (e.g., business, educational institution, etc.) which is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Proof (to Sponsor’s satisfaction) of being the authorized account holder may be required by Sponsor. In the event a dispute regarding the identity of the individual who actually submitted an entry cannot be resolved to Sponsor’s satisfaction, the affected entry will be deemed ineligible. The Released Parties are not responsible for electronic communications that are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in Entrant’s e-mail account to receive e-mail messages. The Released Parties are not responsible for false, incorrect, changed, incomplete or illegible contact information. A potential winner from Canada will be required to correctly answer a skill testing question prior to being confirmed as a winner. In the event: (a) a potential winner cannot be reached for whatever reason after a reasonable effort has been exerted based on the information stated in the Registration, (b) of noncompliance with the above or within any of the aforesaid time periods, (c) a potential winner is found to be ineligible to enter this Sweepstakes or receive the given prize, (d) a potential winner cannot or does not comply with the Official Rules, (e) any email notification to a potential winner is returned as undeliverable for whatever reason, (f) a potential winner in Canada fails to correctly answer the skill testing question, or (g) the potential winner declines to receive the prize to be awarded for whatever reason, the potential winner shall be disqualified from this Sweepstakes and the prize may be awarded to an alternate potential winner in a random drawing from among all remaining entries.
Prize: One (1) Grand Prize: A prize package which includes the following trips:
Trip 1: A 3-day/2-night trip for two to Game 2 of the NBA Finals 2024 presented by YouTube TV consisting of round-trip coach air transportation from major airport nearest to winner’s residence in the U.S., standard double-occupancy hotel accommodations, and two (2) tickets to the designated game;
Trip 2: A 3-day/2-night trip for two to the NBA Draft 2024 presented by State Farm between June 26, 2024 and June 28, 2024 consisting of round-trip coach air transportation from major airport nearest to winner’s residence in the U.S., standard double-occupancy hotel accommodations, and two (2) tickets to the 2024 NBA Draft; and
Trip 3: A 3-day/2-night trip for two to the 2024 NBA2K Summer League in July 2024 consisting of round-trip coach air transportation from major airport nearest to winner’s residence in the U.S., standard double-occupancy hotel accommodations, and two (2) tickets to the designated events on July 12, 2024-July 13, 2024.
Total Approximate Retail Value for the Grand Prize Package: $23,212 USD/$31,302.54 CAD
Trip Conditions: Actual prize value will vary depending on the winner’s city of departure and the location of the respective venues. Sponsor, in its sole discretion, reserves the right to provide ground transportation in place of air transportation if winner lives within a reasonable driving distance of respective Venue as determined by Sponsor, and to award no additional compensation or substitution for the difference in prize value. Travel and hotel arrangements determined by Sponsor in its sole discretion and must be made through Sponsor’s agent, on a carrier of Sponsor’s choice. Trip(s) must be taken on dates and times designated by Sponsor or prize will be forfeited in its entirety and may be awarded to an alternate winner. Sponsor reserves right to change dates. Winner and their respective guest must travel together on the same itinerary. Guest must be of legal age of majority in his/her jurisdiction of residence (and at least 18) unless child or legal ward of applicable winner. Winner and their respective guest are responsible for obtaining all necessary travel documents, including passports and visas (if applicable) prior to travel. The Grand Prize winner’s guest will be required to sign and return a Liability Release and (where legal) Publicity Release within five (5) days of date of issuance of notification. If the potential Guest is/are a minor child or legal ward of the respective Grand Prize winner, the Grand Prize winner will be required to execute the Liability Release and Publicity Release (unless prohibited by law) on his/her Child’s behalf. In the event that the Prize winner or their guest are unable to obtain the necessary travel documents prior to trip departure date the Prize winner in question will forfeit the respective trip in its entirety and the Prize may be awarded to an alternate winner if time permits. If any event is canceled or postponed for any reason, travel prize may be substituted with something of comparable or greater value as determined solely by Sponsor. Winner and their respective guest must comply with arena rules and regulations. Failure to do so may result in forfeiture of applicable prize element. Exact seat locations at the designated events to be determined by Sponsor in its sole discretion. All prize details are at Sponsor’s sole discretion. Certain travel restrictions may apply. In the event that the selected winner is unable to accept the prize in its entirety, the remaining Prize elements may be awarded to an additional potential winner (or winners, where applicable) in a random drawing from among all remaining entries. That potential winner will be required to comply with all the winner criteria noted above and throughout these Official Rules.
Miscellaneous: No transfer, assignment, cash redemption, or substitution of prize (or portion thereof) except by Sponsor, who reserves the right to substitute a prize (or applicable portion thereof) with one of comparable or greater value (except as otherwise provided above), at its sole discretion. All federal, state, provincial, and local taxes (including income and withholding taxes, if any) and all other costs and expenses associated with acceptance and use of a prize not specified herein as being awarded are winner’s sole responsibility. Sponsor, in its sole discretion, reserves the right to: 1.) disqualify any person who tampers with the entry process, the operation of NBA.com, or any other component of this Sweepstakes, or who is otherwise in violation of these Official Rules; and 2.) modify, suspend or terminate this Sweepstakes for any reason, as determined by Sponsor in its sole discretion, including should virus, bug, worm, unauthorized intervention or other causes, including but not limited to war, strikes, pandemic, terrorist activities, and/or acts of God, corrupt or impair the administration, security, fairness or proper play of this Sweepstakes and, in the event of termination, at its discretion, select winner from among eligible, non-suspect entries received as of the date of the event requiring such termination. By participating, Entrants agree to be bound by these Official Rules and agree that: 1.) Released Parties and their designees and assigns may use (unless prohibited by law) such Entrant’s name, voice, city/state/province/territory of residence, biographical information, photograph, and/or other visual likeness for advertising and/or trade purposes and/or for the purpose of posting his/her name on NBA.com and/or for TV or radio broadcasts and/or for any other purpose in any media or format now or hereafter known worldwide in perpetuity without further compensation, permission or notification; and 2.) Released Parties are released, will have no liability whatsoever for, and shall be held harmless by Entrants against any liability for any injuries, losses or damages of any kind (whether due to negligence or otherwise) to person(s), including death, or property, resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize, or participation in this Sweepstakes.
Sweepstakes Entry Assignment of Rights: Entrants warrant and represent that (1) Sponsor shall own the Entry (and all material and rights embodied therein) and that such Entry (or portion thereof) will not be acknowledged or returned; and (2) that by entering, the Entrant irrevocably assigns to Sponsor and its designees any and all rights, title and interest in the Entry including but not limited to all intellectual property rights; and (3) that Sponsor and its designees shall have, without limitation, the perpetual non-exclusive right worldwide to edit, adapt, modify, publish, exploit and use the Entry in any way and in any and all media now known or hereinafter discovered or devised, world-wide for trade, advertising, promotional, public relations and/or other purposes as Sponsor and/or its designees may determine without further permission from, or notification or consideration to entrants or any third parties.
Limitation of Liability and Disclaimer of Warranties: IN NO EVENT WILL THE RELEASED PARTIES AND/OR THEIR PARENTS, AFFILIATES, SUBSIDIARIES AND RELATED COMPANIES, THEIR ADVERTISING OR SWEEPSTAKES AGENCIES OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS, BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING, BUT NOT LIMITED TO, DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE ENTRY FORM AND/OR THE WEBSITE. IN NO EVENT SHALL THE RELEASED PARTIES’ TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED $35,000. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THE WEBSITE INCLUDING THE PRIZES IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.
Arbitration: Except where prohibited by law, as a condition of participating in this Sweepstakes, Entrant agrees that: (1) any and all disputes and causes of action arising out of or connected with this Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action, and exclusively by final and binding arbitration under the rules of the American Arbitration Association and held in New York County, New York; (2) the Federal Arbitration Act shall govern the interpretation, enforcement and all proceedings at such arbitration; and (3) judgment upon such arbitration award may be entered in any court having jurisdiction. Under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim, punitive, incidental or consequential damages, or any other damages, including attorneys’ fees, other than Entrant’s actual out-of-pocket expenses (i.e., costs associated with participating in this Sweepstakes), and Entrant further waives all rights to have damages multiplied or increased.
Choice of Law: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of Entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the substantive laws of the State of New York, USA without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other state’s law.
Entry Information and Sweepstakes Communications: As a condition of entering the Sweepstakes, each Entrant gives consent for Sponsor to obtain and deliver his or her name, address and other information to third parties for the purpose of administering this Sweepstakes and to comply with applicable laws, regulations and rules. Any information Entrants provide to Sponsor may be used to communicate with Entrant in relation to this Sweepstakes or on a Sweepstakes winners list. The information provided by Entrants will be used pursuant to the NBA’s privacy policy available at: www.nba.com/privacy-policy.
