Official Rules.
No Purchase Necessary To Enter or Win.
(1) Eligibility: Sweepstakes open to legal residents (natural persons only) of the 50 United States and the District of Columbia, and Canada (excluding Quebec) who are 13 years of age or older at time of entry. Void in Quebec and where prohibited by law. Minors must obtain their parent’s or legal guardian’s consent prior to participation. Employees of NBA Properties, Inc. (“Sponsor”), NBA Media Ventures, LLC, the NBA and its member teams, Konami of America, and each of their respective parent companies, subsidiaries, affiliates, officers, directors, governors, owners, distributors, retailers, agents, assignees, advertising/promotion agencies, and Project Support Team, Inc. (“PST”) (“Released Parties”) and the immediate family members and/or those living in the same household of each are not eligible to enter or win. All national, state, provincial and local laws and regulations apply.

(2) How to Enter: Visit http://www.nba.com/videogames/NBA_Konami_Sweepstakes.html between 12:00:01AM Eastern Time (“ET”) on 10/25/02 and 11:59:59PM ET on 11/10/02 (“Promotion Period”). If you are a registered member of NBA.com, receive one sweepstakes entry when you fully complete and submit the online entry form according to the instructions provided. If you are not a registered member of NBA.com, registration is free. To register, complete the NBA User Registration form according to the instructions provided. As part of the registration process, you will be asked to consent to receive promotional e-mails. Consenting to receive promotional e-mails is optional and is not required for membership. Upon completion of the registration process, receive one sweepstakes entry when you submit the NBA User Registration form. Limit one entry per person and per e-mail address during each daily 24-hour period (beginning at 12:00:01AM ET on 10/25/02) of the Promotion Period. Additional entries received from any person or e-mail address thereafter during any such day will be void. The use of automated entry devices is prohibited. Sponsor is not responsible for lost, incomplete, late, or misdirected entries; failures or malfunctions of phones, phonelines or telephone systems; lost transmissions; interrupted or unavailable network, server or other connections; miscommunications, failed computer hardware or software or technical failures; garbled, misrouted or scrambled transmissions; printing errors appearing within these Official Rules, in any Sweepstakes-related advertisements or other materials; or other errors or problems of any kind whether mechanical, human, electronic or otherwise.

(3) Winner Selection: Potential winners will be selected in a random drawing on or about 11/15/02 from among all eligible entries received by PST, an independent judging organization whose decisions will be final and binding in all matters relating to this Sweepstakes. Odds of winning will depend on the number of eligible entries received. Potential winners will be notified by telephone and/or mail. If an eligible minor is selected as a potential winner, prize will be awarded in the name of said minor’s parent or legal guardian. If a Canadian resident is selected as a potential winner, to receive prize, he/she will be required to correctly answer, without assistance of any kind, whether mechanical or otherwise, a time-limited mathematical skill-testing question administered by telephone. If the selected Canadian entrant at issue cannot be reached by telephone within (72) hours of first attempt to administer skill-testing question, an alternate winner may be selected. Prizes will be awarded to the person named on the applicable online entry form regardless of whether that is the name of the authorized account holder of the e-mail address from which said online entry form was submitted (subject to verification of eligibility and the terms of these Official Rules).

(4) Grand Prizes: Hand-Signed Tracy McGrady Nike Swingman NBA Replica Jersey and the NBA Starting Five Konami video game (Approximate Retail Value “ARV”=$215). Total ARV of all prizes=$860. Grand Prize jerseys are not game worn, and sizes awarded are at Sponsor’s sole discretion.

Miscellaneous: No transfer, assignment, cash redemption or substitution of prize except by Sponsor due to prize unavailability, and then for a prize of equal or greater value. Federal, state, provincial and local taxes, including but not limited to any applicable income or withholding taxes, Customs duties or like fees and all other costs and expenses not specified herein as included in a prize are winners’ sole responsibility. Winners (if minor, his/her parent or legal guardian) will be required to execute and return an Affidavit of Eligibility, Liability Release and (where legal) Publicity Release within 7 days of issuance of notification. Non-compliance with the foregoing may result in disqualification and awarding of prize to an alternate winner at Sponsor’s sole discretion. If any prize notification letter or prize is returned as undeliverable, winner will be disqualified and an alternate winner may be selected. Sponsor, in its sole discretion, reserves the right to: 1.) disqualify any person and void any entries of any person who it believes has tampered with the entry process, the operation of NBA.com, or any other component of this Sweepstakes, whose conduct or actions affect the administration, integrity, security, fairness or proper conduct of this Sweepstakes, or who is in violation of these Official Rules and 2.) modify, suspend or terminate this Sweepstakes should virus, bugs, non-authorized human intervention or other causes beyond the reasonable control of Sponsor, including but not limited to war, strikes, and/or acts of God, corrupt or impair the administration, security, fairness or proper play of this Sweepstakes and, in the event of termination or suspension, at its discretion, award prizes from among eligible, non-suspect entries received as of the date of the event requiring such termination or suspension. By participating, entrants (if minor, his/her parent or legal guardian) agree to be bound by these Official Rules and agree that: 1.) Released Parties and their designees and assigns may use (unless prohibited by law) such entrant’s name, voice, city, state, province and/or territory of residence, biographical information, photograph, and/or other visual likeness for advertising and/or trade purposes and/or for the purpose of posting their name on NBA.com and/or for any other purpose in any media or format now or hereafter known without further compensation, permission or notification and 2.) Released Parties and all of their respective officers, directors, employees, representatives and agents shall have no liability and will be released and held harmless from any claim, action, liability, loss, injury or damage, including, without limitation, personal injury or death to winner or any third party or damage to personal or real property due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of a prize or participation in this Sweepstakes.
