1. NO PURCHASE IS NECESSARY.
2. Mail a 3x5 index card with contestant’s name, contestant’s age, parent/guardian’s name, complete mailing address, daytime and evening phone numbers, city, state and zip code to Meritage Homes Toy Scramble, One AT&T Center, San Antonio, TX 78219.
3. Winners will be randomly selected in San Antonio, TX from all entries received in six separate drawings. Four Grand Prize winners per drawing, held on or around 12/21/11, 12/28/11, 1/7/12, 2/2/12, 3/9/12, 3/25/12. A winner is not constituted until verbal contact is made between winner and a Spurs representative. Odds of winning depend on the number of entries received. Only one winner per household per season. There is no limitation on the number of entries.
4. Each grand prize winner will receive four tickets to a 2011-12 Spurs home game, a parking pass and get to participate as a contestant in a timed “Toy Scramble” on the AT&T Center court. In each “Toy Scramble,” all winning contestants selected in that drawing will have a short time to collect toys from among those set out by the “Sponsor” (includes Meritage Homes and Legacy Homes, CHRISTUS Santa Rosa Health Care and San Antonio Spurs [and any and all of its affiliates] and the National Basketball Association and its Member Teams, NBA Properties, Inc. and their respective parent companies, subsidiaries, affiliates, directors, officers, governors, employees and agents) in the designated game area. All toys collected by each contestant during the Scramble will be awarded to the contestant to take home, subject to decisions of the judges. By participating, all contestants agree to act reasonably toward one another during the Toy Scramble. Any contestant acting unreasonably toward other contestants as determined by the judges, in their sole discretion, may be disqualified or may forfeit prizes. All decisions of the Toy Scramble judges are final and the contestants agree to hold Sponsors and the judges harmless regarding any matter arising out of such decisions. Transportation and/or accommodations to Spurs game or Toy Scramble not included.
5. The contest time frame is 12/20/11 – 3/25/12. Entries must be received 2 days prior to each drawing to be eligible for that drawing, or by 3/23/12 to be eligible for the final drawing.
6. By entering, entrant agrees to hold harmless and indemnify Meritage Homes and Legacy Homes, CHRISTUS Santa Rosa Health Care, the San Antonio Spurs (and any and all of its affiliates) and the National Basketball Association and its Member Teams, NBA Properties, Inc. and their respective parent companies, subsidiaries, affiliates, directors, officers, governors, employees and agents against any and all liability, damages or causes of action (however named or described), with respect to or arising out of either (i.) entrants participation; (ii.) The receipt or use of the prizes awarded in the promotion or (iii.) any decisions of the Sponsors/judges in any matter relating to the promotion.
7. Contest open to U.S. residents, ages 5-10, living within 75 miles of the San Antonio city limits, except employees and immediate family member (spouses, parents, siblings and children) of Meritage Homes and Legacy Homes, CHRISTUS Santa Rosa Health Care, the San Antonio Spurs (and any and all of its affiliates) and the National Basketball Association and its Member Teams, NBA Properties, Inc. and their respective parent companies, subsidiaries, affiliates, directors, officers, governors, employees, agents and owners. A parent or legal guardian of any potential winner selected must execute required documents confirming liability release, publicity release, and eligibility within the requested time or prize will be forfeit and an alternate winner selected. Parent or guardian must accompany any winner to “Toy Scramble”.
8. Federal, State and local laws and regulations apply. Contest void where prohibited.
9. Prizes are non-refundable and are not subject to exchange. No substitute prizes will be awarded and prizes may not be exchanged for cash. Winners are responsible for the payment of all federal, state and local taxes on the prizes. Approximate value of the grand prize is $400. Actual value of prize each winner receives will depend on Toy Scramble results. Prizes are non-transferable to any other person including relatives or friends.
10. Meritage Homes and Legacy Homes, CHRISTUS Santa Rosa Health Care, the San Antonio Spurs (and any and all of its affiliates) and the National Basketball Association and its Member Teams, NBA Properties, Inc. and their respective parent companies, subsidiaries, affiliates, directors, officers, governors, employees and agents accept no responsibility for lost, late, illegible, stolen, misdirected, postage due or mutilated entries.
11. Contestants understand that Meritage Homes and Legacy Homes, CHRISTUS Santa Rosa Health Care, the San Antonio Spurs (and any and all of its affiliates) and the National Basketball Association and its Member Teams, NBA Properties, Inc. and their respective parent companies, subsidiaries, affiliates, directors, officers, governors, employees and agents shall have the right to use the winner’s voice, name, likeness and photograph for advertising and promotional purposes without further authorization, compensation, remuneration or notification except where prohibited by law.
12. Grand prize winners will be contacted by a Spurs representative by phone. In the event the winner cannot be contacted or claim the prize, an alternate winner will be selected through a random drawing.
13. If you wish to receive a list of winner(s) names, please send a self-addressed stamped envelope to: Meritage Homes Toy Scramble, One AT&T Center, San Antonio, TX 78219 no later than 06/01/12.
14. All decisions as to contest and interpretations are exclusively within the sole discretion of the San Antonio Spurs, the NBA and NBA Properties, Inc. and may be changed from time to time without notice.
15. The San Antonio Spurs, the NBA and NBA Properties, Inc. reserve the right to cancel or modify contest at any time without notice.
