Valero/Nesquick Bowling for Cash Official Rules

2. The “Contest” commences on 11/4/08 at 8:00 a.m., Central Standard Time ("CST") and will end at 11:59 p.m. CST on 04/15/09.

3. To enter, register at participating Valero Cornerstore’s in San Antonio by completing and submitting an official entry form or register online at spurs.com. Entry forms or registration must be completed and submitted by 3:00 p.m., CST on 04/01/09, the ”Deadline,” to be eligible.

4. All participants who complete entry forms or register by the Deadline and meet the eligibility requirements set forth in paragraph 8 are eligible to participate in the Contest.

5. Contestants will be selected by random drawing after completing and submitting an official entry form by the Deadline. Odds of being selected as a contestant to bowl for cash are dependent upon the number of official entries received by the Deadline. Once a contestant is picked from the entries received, such contestant will be invited to come on-court and bowl for a cash prize. Contestants will draw a card on-court and that card will determine where on the court they bowl from and how much money they could possibly win. The possible dollar amount of cash prize the contestant will play for will depend on the location on the court the contestant draws. Cash prize will only be awarded if the contestant bowls a strike or a spare. Odds of winning cash prize are dependent upon the performance of the contestant.

6. Each entrant who is selected will have 24 hours to accept the invitation to bowl including game tickets set forth in paragraph 11. Prizes not claimed within the 24 hour period will be forfeited. If winner is unable to use their prize or any part of the prize within the time frame to use the prize, such prize will be forfeited entirely and the entrant will forfeit any and all rights to the prize. The San Antonio Spurs reserve the right to select another entrant, by random drawing in such instance and award the prize to an alternate entrant. Prizes are not transferable. No substitutions or exchanges (including for cash) of any prizes will be permitted, except that the San Antonio Spurs reserves the right to substitute a prize of equal or greater value for any prize. Limit one prize per household or address. All prizes are awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND, express or implied, (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose).

7. By entering the Contest, entrant releases Valero Services, Inc. (and any and all of its affiliates), Nestle USA (and any and all of its affiliates), the San Antonio Spurs (and any and all of its affiliates) and the National Basketball Association and its Member Teams, NBA Properties, Inc., and each of their respective parent companies, subsidiaries, affiliates, directors, officers, governors, employees and agents from any liability whatsoever and waives any and all causes of action related to any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Contest or delivery, misdelivery, acceptance, possession, use of or inability to use any prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity, privacy or defamation, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory.

8. This Contest is only open to U.S. residents 18 years of age or older at the time of entry, living within 75 miles of the San Antonio city limits, except employees and immediate families (spouses, parents, siblings and children) of Valero Services, Inc. (and any and all of its affiliates), Nestle USA (and any and all of its affiliates), the San Antonio Spurs (and any and all of its affiliates), the National Basketball Association and its Member Teams, NBA Properties, Inc., and each of their respective parent companies, subsidiaries, affiliates, directors, officers, governors, employees, agents and owners.

9. Valero Services, Inc. (and any and all of its affiliates), Nestle USA (and any and all of its affiliates), the San Antonio Spurs (and any and all of its affiliates) and the National Basketball Association and its Member Teams, NBA Properties, Inc., and each of their respective parent companies, subsidiaries, affiliates, directors, officers, governors, employees and agents will not be responsible for: (a) any late, lost, misrouted or damaged entries; (b) any Contest disruptions, injuries, losses or damages caused by events beyond the control of the San Antonio Spurs or NBA Properties, Inc; or (c) any printing or typographical errors in any materials associated with the Contest.

10. Contest void where prohibited. The Contest and these Contest Rules will be governed, construed and interpreted under Texas law.

11. Prizes are non-refundable and are not subject to exchange. No substitute prizes will be awarded and prizes may not be exchanged for cash. Contestants are responsible for payment of all federal, state and local taxes on the prizes. Approximate retail value of the prizes is as follows: Four San Antonio Spurs game tickets ($41.40 for all four tickets). Prizes do not include airfare, lodging or any other costs associated with claiming or utilizing the prizes awarded. Prizes are non-transferable to any other person including relatives or friends. Cash prize will only be awarded if the contestant bowls two strikes, a strike or a spare during the on-court competition.

12. Valero Services, Inc. (and any and all of its affiliates), Nestle USA (and any and all of its affiliates), the San Antonio Spurs (and any and all of its affiliates) and the National Basketball Association and its Member Teams, NBA Properties, Inc., and each of their respective parent companies, subsidiaries, affiliates, directors, officers, governors, employees and agents accept no responsibility for lost, late, illegible, stolen, misdirected, postage due or mutilated entries.

13. By entering this Contest, entrant(s) understand that Valero Services, Inc. (and any and all of its affiliates), Nestle USA (and any and all of its affiliates), the San Antonio Spurs (and any and all of its affiliates) and/or the National Basketball Association and its Member Teams, NBA Properties, Inc., and each of their respective parent companies, subsidiaries, affiliates, directors, officers, governors, employees and agents shall have the right to use the contestant’s voice, name likeness and photograph for advertising and promotional purposes without further authorization, compensation, remuneration or notification.

14. Entrants agree to be bound by these Official Contest Rules and by the decisions of the San Antonio Spurs, the NBA and NBA Properties, Inc., which are final and binding in all respects. The San Antonio Spurs, the NBA and NBA Properties, Inc., and each of their respective parent companies, subsidiaries, affiliates, directors, officers, governors, employees and agents reserves the right to change these Official Contest Rules at any time, in its sole discretion, and to suspend or cancel the Contest or any entrant's participation in the Contest should causes beyond its control affect the administration, security or proper play of the Contest or if San Antonio Spurs, the NBA and NBA Properties, Inc., and each of their respective parent companies, subsidiaries, affiliates, directors, officers, governors, employees and agents or otherwise become (as determined in its sole discretion) incapable of running the Contest as planned.

15. Entrants who violate these Official Contest Rules, tamper with the operation of the Contest or engage in any conduct that is detrimental or unfair to Valero Services, Inc. (and any and all of its affiliates), Nestle USA (and any and all of its affiliates), the San Antonio Spurs (and any and all of its affiliates), the National Basketball Association and its Member Teams, or NBA Properties, Inc., and each of their respective parent companies, subsidiaries, affiliates, directors, officers, governors, employees and agents or any other entrant (in each case as determined in the San Antonio Spurs, the NBA and NBA Properties, Inc.'s sole discretion) are subject to disqualification from entry into the Contest. The San Antonio Spurs, the NBA and NBA Properties, Inc. and each of their respective parent companies, subsidiaries, affiliates, directors, officers, governors, employees and agents reserve the right to exclude persons whose eligibility is in question or who have been disqualified or are otherwise ineligible to enter the Contest.
