The “Ring in the Basketball New Year with Nokia Sports Sweepstakes” (the "Sweepstakes”), brought to you by NBA Media Ventures, LLC and Nokia Inc. will be governed by these “Official Rules”.
Eligibility: Sweepstakes open to legal residents of the 50 United States and the District of Columbia, 18 years of age or older as of 10/26/04. Employees of NBA Media Ventures, LLC ("Sponsor"), NBA Properties, Inc., the NBA and its member teams, Nokia Inc., and each of their respective parent companies, subsidiaries, affiliates, officers, directors, governors, owners, distributors, retailers, agents, assignees, advertising/promotion agencies, and Project Support Team, Inc. (“PST”) (collectively, “Released Parties”) and the immediate family members (parent, spouse, sibling or child) and/or those living in the same household of any such employees are not eligible to enter or win. This Sweepstakes is subject to all applicable federal, state, and local laws and regulations. Void where prohibited by law.
How to Enter: Visit www.nba.com between 11:45:01 AM Eastern Time (“ET”) on 10/26/04 and 11:59:59PM ET on 11/5/04 (“Promotion Period”) and complete and submit the entry form according to the instructions provided. Limit one entry per person or e-mail address for the duration of the Promotion Period. Additional entries received from any person or e-mail address thereafter will be void. Released Parties are not responsible for incomplete, late or misdirected entries, failures or malfunctions of phones, phone lines, telephone systems, lost entries or transmissions, interrupted or unavailable network, server or other connections, miscommunications, failed computer hardware or software or technical failures, garbled, misrouted, scrambled transmissions, printing or other errors in these Official Rules, in any Promotion-related advertisements or other materials, or other errors or problems of any kind whether human, electronic or otherwise. The use of automated devices, including but not limited to entries submitted using any bot, macro, script, or sweepstakes service (or any other devices intended to automate any aspect of entry) to enter this Promotion is prohibited.
Winner Selection: Winners will be selected in a random drawing on or about 11/15/04 from among all eligible entries received by PST, an independent judging organization whose decisions will be final and binding in all matters relating to this Sweepstakes. Odds of winning will depend on the number of eligible entries received. Winners will be notified by email, telephone and/or mail. Prizes will be awarded to the person named on the applicable entry form (subject to verification of eligibility and the terms of these Official Rules) regardless of whether that is the name of the authorized account holder of the email address from which said entry form was submitted. Limit one prize per person, family or household.
Prizes: (1) Grand Prize: A 3-day/2-night trip between 12/31/04 and 1/2/05 to Miami, FL for the winner and (1) guest consisting of round-trip coach air transportation from a major U.S. airport near winner's residence, standard double-occupancy hotel accommodations, ground transportation to/from the airport, two tickets to the 1/1/05 NBA game and (1) phone call from an NBA player (designated by Sponsor) to the Grand Prize winner (Approximate Retail Value=$3,500). Actual prize value will vary depending on winner’s city of departure and site of designated game. Travel and hotel arrangements determined by Sponsor in its sole discretion. Winner and guest must travel together on the same itinerary, and any minor traveling companion must be accompanied by a parent or legal guardian. Trip must be taken on dates and times designated by Sponsor or prize will be forfeited in its entirety and may be awarded to an alternate winner. Sponsor, in its sole discretion, reserves the right to provide ground transportation in place of air transportation. If the designated 1/1/05 NBA game is canceled or postponed for any reason, travel prize will be awarded less tickets to game which Sponsor will substitute with an item(s)/activity(s) of equal or greater value as determined solely by Sponsor. Exact seat locations at designated game to be determined by Sponsor in its sole discretion. Prize details not specifically set forth herein are at Sponsor’s sole discretion. (2) First Prizes: Nokia Prize Pack consisting of: (1) Nokia 6620 model phone, (1) HS-11W Bluetooth wireless headset, (1) wireless Bluetooth Keyboard, and (1) phone call from an NBA player designated by Sponsor (ARV=$657). (2) Second Prizes: Select NBA Premiere Week merchandise and (1) phone call from an NBA player designated by Sponsor (ARV=$75). Sizing and choice of any apparel awarded will be at Sponsor’s sole discretion. Total ARV of all prizes=$4,964.
Miscellaneous: No transfer, assignment, cash redemption or substitution of prizes (or portion thereof) except by Sponsor due to prize unavailability, and then for a prize (or applicable portion thereof) of equal or greater value. Prizes are awarded “as is” without warranty or guarantee by Sponsor. Federal, state and local taxes and all other expenses not specified herein are winners’ sole responsibility. Grand and First Prize winners will be required to execute and return an Affidavit of Eligibility, Liability Release and (where legal) Publicity Release within (5) days of issuance of notification. Grand Prize winner’s traveling companion (if a minor, his/her parent or legal guardian) will also be required to sign and return a Liability Release and (where legal) Publicity Release prior to the issuance of travel documents. Non-compliance with any of the foregoing may result in disqualification and awarding of prize to an alternate winner at Sponsor’s sole discretion. If any prize notification letter or prize is returned as undeliverable, winner will be disqualified and an alternate winner may be selected. Grand Prize winner and his/her traveling companion also agree to comply with all NBA rules, regulations, and directions relating to attendance at NBA sanctioned events and/or other activities and, in accordance therewith, agree not to act in an unsportsmanlike or disruptive manner, or with any intent to annoy, abuse, threaten or harass any other person at such event. Sponsor, in its sole discretion, reserves the right to: 1.) disqualify any person and void any entries of any person who it believes has tampered with the entry process, the operation of NBA.com, or any other component of this Sweepstakes, whose conduct or actions affect the administration, integrity, security, fairness or proper conduct of this Sweepstakes, or who is in violation of these Official Rules; and 2.) modify, suspend or terminate this Sweepstakes should virus, bugs, non-authorized human intervention or other causes beyond the reasonable control of Sponsor, including but not limited to war, strikes, and/or acts of God, corrupt or impair the administration, security, fairness or proper play of this Sweepstakes and, in the event of termination or suspension, at its discretion, select winners from among eligible, non-suspect entries received as of the date of the event requiring such termination or suspension. By participating, entrants agree to be bound by these Official Rules and agree that: 1.) Released Parties and their designees and assigns may use (unless prohibited by law) such entrant’s name, voice, city/state of residence, photograph, and/or other visual likeness for advertising and/or trade purposes and/or for the purpose of posting their name on NBA.com and/or for any other purpose in any media or format now or hereafter known without further compensation, permission or notification and 2.) Released Parties and all of their respective officers, directors, employees, representatives and agents shall have no liability and will be released and held harmless from any claim, action, liability, loss, injury or damage, including, without limitation, personal injury or death to winner or any third party or damage to personal or real property due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of a prize (including any travel or prize activity related thereto) or participation in this Sweepstakes.
