1. NO PURCHASE NECESSARY. The Hyundai Win and Drive Home NBA Sweepstakes (“Sweepstakes”) is open to legal residents of the 48 contiguous United States and the District of Columbia, at least 18 years of age at the time of entry. Employees and their immediate families (spouses, siblings, children, household members and the spouses and children of the foregoing) of Hyundai Motor America, Inc. and Turner Network Television LP, LLLP (“TNT”) (collectively the “Sponsors”), Time Warner, Inc., the National Basketball Association (“NBA”) and its Member Teams, NBA Properties Inc., NBA Media Ventures, LLC, Cottonwood Enterprises, and their respective parents, subsidiaries, divisions, trustees, franchisees, participating vendors, dealers, distributors, advertising and promotion agencies and affiliated entities (collectively, the "Sweepstakes Entities") are not eligible to enter the Sweepstakes. By entering the Sweepstakes, participants agree to abide by all terms of the Official Rules and Regulations applicable thereto. Subject to all local, state and federal laws and regulations. Some restrictions apply. Void wherever prohibited or restricted by law.
2. HOW TO ENTER: From May 13, 2005 through June 5, 2005 (the “Promotional Period”) viewers of the “Inside the NBA” program on TNT will be directed by announcers to either enter the Sweepstakes online or by mail. Online Method: Go to www.nba.com, click the Sweepstakes promotional banner, and provide name, address, city, state, zip code, date of birth (month, day and year), phone number (with area code), and email address (if available). Online entry ends 11:59 P.M. Eastern Time (“ET”) on June 5, 2005. Use of any automated entry software is prohibited. Mail-In Method: Send a postcard with your name, address, age, phone number (with area code), email address (if available) and mail to: Hyundai Win and Drive Home NBA Sweepstakes, P.O. Box 11508, Bozeman, MT 59719-1508. Mail-in entries must be postmarked by June 5, 2005 and received by June 12, 2005. Each mail-in entry must be hand printed and must bear sufficient postage. No mechanical reproductions or facsimiles accepted. Limit one (1) entry per person regardless of method of entry. Sponsors are not responsible for incomplete, misdirected, lost, late or illegible entries. Sponsors are also not responsible for technical, hardware or software failures of any kind, lost or unavailable network connections or failed, incomplete, garbled or delayed software transmissions which may limit an entrants ability to participate in the Sweepstakes or damage to user’s system as a result of participation in the Sweepstakes or downloading any information necessary to participate in the Sweepstakes. Sponsors reserve the right in their sole discretion, to cancel or modify the Sweepstakes should any computer virus, malfunction or other cause beyond their control corrupt the administration, security or proper operation of the Sweepstakes. All entries become the property of the Sponsors and will not be acknowledged or returned. False or deceptive entries or acts, as determined by Sponsors, will render the entrant ineligible. If an NBA game or the NBA season is cancelled, postponed, delayed or rescheduled for any reason whatsoever, Sponsors may elect in their sole discretion to cancel, postpone, delay or reschedule the Sweepstakes. Should the Sweepstakes be canceled, the prize will be awarded as outlined in Paragraph 4.
3. HOW TO WIN: One (1) grand prize winner (“Grand Prize Winner”) will be selected on or about June 15, 2005 by random drawing conducted by Cottonwood Enterprises, an independent judging agency, from among all eligible entries received. The odds of winning will be determined by the number of eligible entries received from the Online Method and Mail-In Method. Sweepstakes will be administered by Cottonwood Enterprises and the Sponsors, the decisions of which in all matters regarding the Sweepstakes are final and binding. The Grand Prize Winner will be notified by phone; email and/or mail and must meet all eligibility requirements including the execution and delivery of all necessary releases. If a dispute arises regarding who submitted an on-line entry, the entry will be deemed submitted by the holder of the e-mail account as determined by Sponsors.
4. PRIZES: One (1) Grand Prize Winner will receive the following: One (1) 2005 Hyundai Santa Fe LX 4WD w/optional sunroof of Grand Prize Winner’s color choice (subject to availability) (“Grand Prize”). The approximate market value of Grand Prize is Twenty-Six Thousand Eight Hundred Ninety Four Dollars ($26,894.00). Grand Prize Winner may be responsible for any and all shipping or additional charges. Prices, equipment and specifications are subject to change without notice. The reporting and payment of any tax liabilities incurred by the entrant, including license, title, registration fee and insurance for the vehicle as a result of this sweepstakes are the sole responsibility of the entrant. No substitution or transfer of prize or cash redemptions permitted by Grand Prize Winner. The Sponsors reserve the right to substitute a prize of like value in the event the described prize, or any portion thereof, is unavailable for any reason whatsoever.
5. GENERAL RULES AND REGULATIONS: By entering the Sweepstakes, participants grant Sweepstakes Entities the right, unless prohibited by law, to use their names, voices, pictures and likenesses, without further authorization or compensation, for the purpose of advertising and publicizing the goods and services of the Sweepstakes Entities and all matters related to the Sweepstakes in any manner or medium, throughout the world in perpetuity. Grand Prize Winner may be required to sign affidavits of eligibility, tax acknowledgement forms, liability releases and, except where prohibited by law, use of name and likeness releases (“Winner Documents”) and return within ten (10) days of issuance. Noncompliance within this time period may result in disqualification. The Hyundai Santa Fe LX 4WD will be delivered at a dealership designated by Sponsors. Grand Prize Winner must have a valid driver’s license and provide proof of automobile insurance at the time the vehicle is awarded. Return of the prize or prize notification as undeliverable, failure of Sponsors to contact winner based on contact information provided at registration, or failure of potential winner to respond to notification attempts will result in disqualification and an alternate may be selected at the Sponsors’discretion. In the event the winner declines the prize or fails to return completed releases, Sponsors or their agency may elect, at their own discretion, an alternate winner. By entering, participants agree to release the Sweepstakes Entities from any and all liability claims or actions of any kind whatsoever for injuries, damages or losses to persons and property which may be sustained in connection with the receipt, ownership or use of the prize, or while preparing for, participating in, and/or traveling to any prize-related activity. The Sweepstakes Entities expressly disclaim any responsibility or liability for injury or loss to any person or property relating to the delivery and/or subsequent use of the prize awarded. In the event more winner notifications are issued, or more winning prize claims are received, than the number of prizes set forth in these Official Rules due to computer, printing, seeding, human, or other error or problem, a random drawing will take place from all eligible prize claims for the prize(s) at issue to award the proper number of prizes as set forth in these Official Rules.
In the event of sabotage, acts of God, computer virus or other events or causes beyond the Sponsors’ reasonable control which corrupt the integrity, administration, security or proper operation of the Sweepstakes, Sponsors reserve the right to cancel or suspend the Sweepstakes. In the event of cancellation, prizes will be awarded from among all eligible, non-suspect entries received prior to the event requiring such cancellation. Notice of cancellation will be posted at www.nba.com.
6. CONSTRUCTION: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any contestant and Sweepstakes Entities, shall be governed by, and construed in accordance with the laws of Georgia. In any action brought to enforce the obligation or right of any party hereunder they consent to personal jurisdiction and venue in any court of appropriate jurisdiction in Fulton County, Georgia, USA. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision.
