WIN A TUNDRA IN 2005! SWEEPSTAKES
1. SWEEPSTAKES PERIOD. The Sweepstakes will begin on November 6, 2004 and will end on April 1, 2005.
2. ELIGIBILITY. NO PURCHASE NECESSARY TO ENTER. Only legal residents of the United States age 18 and older, who live within 75 miles of the Houston city limits are eligible to participate in this Sweepstakes; provided that (i) current or former professional or semi-professional basketball players or coaches; (ii) current or former (within the last five (5) years) college, junior college, high school or Olympic basketball players or coaches; and (iii) employees and immediate family members (spouses, parents, siblings and children) of employees of the Houston Rockets, the Houston Comets, The National Basketball Association (the “NBA”) and its member teams, NBA Properties, Inc., and their respective parents, subsidiaries, affiliates, directors, officers, governors, employees, and agents are not eligible to enter. The Sweepstakes is void wherever prohibited or restricted by law.
3. ENTRIES. LIMIT OF ONE (1) ENTRY PER PERSON. In order to enter the Sweepstakes, you must properly fill out and submit an official Sweepstakes Entry Form (an “Entry Form”) as follows: (1) fill out and submit an internet Entry Form located on the Houston Rockets web site, www.rockets.com; (2) fill out and submit an official Entry Form, available at any Toyota Power Team dealership, by dropping such Entry Form in an official Sweepstakes registration box located inside Toyota Center or at a Toyota Power Team dealership; or (3) fill out an official Entry Form located on a Houston Rockets pocket schedule and submit such Entry Form by dropping such Entry Form in an official Sweepstakes registration box located inside Toyota Center or at a Toyota Power Team dealership. Entry Forms may not be photocopied or mechanically reproduced, such photocopied or mechanically reproduced Entry Forms will not be accepted. All Entry Forms must be received by the Houston Rockets before the end of the Sweepstakes Period, any Entry Form received after the Sweepstakes Period will not be accepted. A person who submits a properly completed Entry Form via the Internet or via an official Sweepstakes registration box within the Sweepstakes Period is considered an “Entrant.” By submitting a properly completed Entry Form, Entrants are acknowledging that they have read, understand and agree to be bound by these Official Sweepstakes Rules.
4. SELECTION OF FINALISTS. Employees of the Houston Rockets will conduct a random drawing to select five (5) finalists (the “Finalists”). The random drawing will be held on or about April 4, 2005 at the offices of the Houston Rockets. The Entrants whose Entry Forms are the first five Entry Forms selected will be the Finalists. The Houston Rockets will contact the Finalists by telephone within seven (7) days of the random drawing. If the Houston Rockets are unable to contact a Finalist after two attempts, then such Finalist will forfeit his or her right to compete in the Sweepstakes and the Houston Rockets may conduct another random drawing to select a replacement Finalist.
5. SELECTION OF GRAND PRIZE WINNER. During halftime of the Houston Rockets NBA basketball game versus the Denver Nuggets on April 16, 2005, or at any other game as determined by the Houston Rockets in its sole discretion (the “Game”), the Finalists shall compete for the Grand Prize in a basketball shooting contest (the “Grand Prize Contest”). The winner of the Grand Prize Contest will be the “Grand Prize Winner” (and together with the Finalists, the “Winners”).
6. PRIZE DESCRIPTIONS; ODDS. Finalist Prize: Five (5) Finalists will receive two (2) tickets each to the Game (Approximate Retail Value: $50.00 per ticket), such tickets to be selected by the Houston Rockets in its sole discretion (the “Finalist Prize”). The odds of winning the Finalist Prize will depend on the number of eligible Entry Forms received. Each Finalist must pick up his or her Finalist Prize at the Toyota Center, on or before the date of the Game. If a Finalist fails to pick up his or her Finalist Prize before the date of the Game, such Finalist Prize shall be automatically forfeited by that Finalist and the Houston Rockets may or may not at its sole discretion, choose to conduct another random drawing to select a replacement Finalist. Grand Prize: One (1) Grand Prize Winner will receive one (1) Toyota Tundra Truck (Approximate Retail Value: $32,000.00), which will be selected (including available options) by Toyota in its sole discretion (the “Grand Prize”, and together with the Finalist Prize, the “Prizes”). The odds of winning the Grand Prize will depend on the Finalists’ performance in the Grand Prize Contest. The Grand Prize will be delivered to a delivery site specified by Toyota not more than 120 days after the date of the Game, and if the Grand Prize is not picked up within thirty (30) days of delivery to the delivery site, the Grand Prize will be automatically forfeited by the Grand Prize Winner and an alternate Grand Prize Winner may or may not be selected, at Toyota’s option. The Grand Prize Winner will be responsible for any tax, title, license, insurance and registration fees associated with the Grand Prize. Any vehicle displayed and/or pictured may not be the actual vehicle awarded, if any, and may not be of the same color, model, year or have the same features as the actual vehicle awarded, if any. General: The Winners may not assign, transfer or substitute the Prizes, or redeem the Prizes for cash value. The Winners will be responsible for any federal, state and local taxes associated with the Prizes. The Winners shall be required to sign a Release, an Affidavit of Eligibility and a Prize Acceptance Form in order to receive the Prizes. The Houston Rockets reserve the right to substitute the Prizes with any prize of greater or equal value.
7. LIMITATIONS ON LIABILITY. The Houston Rockets and Toyota shall not be responsible for Entry Forms that are incomplete, illegible, stolen, misdirected, lost, late, damaged, or postage due. All Entry Forms become the property of the Houston Rockets and will not be acknowledged or returned. By entering, each Entrant agrees to HOLD HARMLESS AND INDEMNIFY Toyota, the Houston Rockets, the NBA and its member teams, NBA Properties, Inc., and each of their respective parents, subsidiaries, affiliates, directors, officers, governors, employees, and agents (the “Released Parties”) from any and all liability, damages, claims and causes of action (however named or described) with respect to or arising out of (a) Entrant’s participation in this Sweepstakes, including the Grand Prize Contest, (b) Entrant’s Entry Form, (c) any typographical or other error in these Official Sweepstakes Rules or (d) the receipt and/or use of the Prizes or any replacement prize that may be awarded herein. The Winner acknowledges that the Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to the Prizes, including but not limited to their quality, merchantability, mechanical condition or fitness. The Grand Prize Winner shall bear all risk of loss or damage to the Grand Prize after it has been delivered to the specified delivery site.
8. CONSENT OF USE. Each Entrant hereby agrees and consents, without further authorization, compensation or remuneration of any kind, to the publication of Entrant’s name, likeness, photograph, voice, Entry Form and the like in any medium, whether now known or hereafter developed, including without limitation, the Houston Rockets website and in any and all advertising, promotions, and other publicity conducted by the Houston Rockets, and/or the NBA and its member teams, NBA Properties, Inc., and their respective parents, subsidiaries, affiliates, directors, officers, owners, governors, employees, and agents, except where prohibited by law.
9. WINNER’S LIST. Names of the Winners can be obtained by sending a self addressed stamped envelope to: Houston Rockets, c/o Win a Tundra in 2005! Sweepstakes Winner List, 1510 Polk St., Houston, TX, 77002, on or after April 11, 2005 for the Finalists and on or after April 17, 2005 for the Grand Prize Winner.
10. RULES. All decisions as to these Official Sweepstakes Rules and interpretations thereof are exclusively within the sole discretion of the Houston Rockets and Toyota and may be changed from time to time without notice. The Houston Rockets reserve the right to cancel or modify the Sweepstakes at any time without notice.
11. DISPUTES. Entrants agree that any dispute or cause of action arising out of or connected with the Sweepstakes shall be resolved individually, without resort to any form of class action, and exclusively by arbitration, which will be conducted in Houston, Texas in accordance with the Commercial Arbitration Rules of the American Arbitration Association.
12. FORCE MAJEURE. Neither Toyota nor the Houston Rockets shall not be responsible for the failure or interruption of www.rockets.com or the Houston Rockets e-mail server or of the cancellation or postponement of a Houston Rockets game or any drawing for any reason including, but not limited to, equipment failure or malfunction, electrical service interruption, or any act of God.
