Eligibility: The NBA/JCPenney Playoffs Sweepstakes (“Sweepstakes”) is open to legal residents of the 50 United States and the District of Columbia, who are 13 years of age or older as of 4/7/08. Eligible minors must obtain their parent’s or legal guardian’s consent prior to participation. Employees, officers, directors, representatives and agents of J.C. Penney Corporation, Inc., JCP Media L.P., NBA Properties, Inc. (“Sponsor”), NBA Media Ventures, LLC, the NBA, Telescope and its member teams and each of their respective parent companies, subsidiaries, affiliates, governors, owners, distributors, retailers, agents, assignees, advertising/promotion agencies, and Project Support Team, Inc. (“P/S/T”) (collectively, “Released Parties”) and the immediate family members (parents, spouses, siblings, children and their respective spouses, regardless of where they reside) and/or those living in the same household of any such individual, whether or not related, are not eligible to enter or win. This Sweepstakes is subject to all applicable federal, state, provincial and local laws and regulations. Void in U.S. territories and where prohibited by law.

Participating NBA Teams/Markets (Teams may vary. If any of the below teams do not advance to the NBA Playoffs 2008 the team will be removed from the Promotion and may be replaced with a team advancing to the NBA Playoffs 2008): :
Boston Celtics, Detroit Pistons, Orlando Magic, Cleveland Cavaliers, Dallas Mavericks, and Phoenix Suns (each, a “Market”).

How to Enter:
There are two (2) ways to enter. Between 12:00:01AM Eastern Time (“ET”) on 4/7/08 and 11:59:59PM ET on 4/11/08 (“Promotion Period”): 1) Via Text Message: Using a Wireless handset, successfully send the keyword found in select newspapers in each market to the designated shortcode 30391. Each text message entry will be included in the drawing for the market corresponding to the keyword entered. Once you have properly text messaged the keyword to 30391, you will be sent a reply via text messaging confirming your entry into the Sweepstakes. You may opt-out from receiving future text messages from Sponsor at anytime by sending any of the following words to 30391: STOP, QUIT, END, UNSUBSCRIBE or CANCEL. Important Notice for Text Messaging Method: Standard text message rates apply. Your wireless service provider may charge you for each text message you send and receive. Please consult your wireless service provider regarding its pricing plans. You must be a wireless service subscriber with text messaging service using a participating service provider in order to enter via this method. Not all cellular phone providers carry the necessary service to participate. Check your phone capabilities for specific text messaging instructions. Text-message entries must be received by 11:59:59 PM ET on 4/11/08 to be eligible. Limit one (1) text-message entry per person or wireless phone number per day. Additional entries received from any one person or wireless phone number during any one day of this Sweepstakes will be void; or 2.) Via Mail: To enter without sending a text message, hand print your name, complete mailing address, date of birth, telephone number (including area code) and the name of participating NBA team (from the list above) nearest to your residence on a plain 3”x 5” piece of paper and mail it in an envelope with proper postage affixed to: NBA/JCPenney Playoffs Sweepstakes, P.O. Box 14065, Bridgeport, CT 06673-4065. Enter as often as you wish by mail, but each mail-in entry must be mailed separately. Mail-in entries must be received by 4/15/08 to be eligible. Each mail-in entry must also indicate the name of participating NBA team (from the list above) nearest to your residence in the lower left hand corner of the outer mailing envelope. Each mail-in entry will be included in the drawing for the market indicated on the mailing envelope. Failure to denote a NBA team from the list above on the outer mailing envelope will result in disqualification. Released Parties are not responsible for incomplete, late, garbled, lost, illegible, delayed or misdirected stolen, postage-due or mutilated entries or text messages, failures or malfunctions of phones (including wireless phones/handsets), phone lines, cellular equipment towers, telephone systems, lost entries, text messages or transmissions, interrupted or unavailable network, server, wireless service provider or other connections, miscommunications, failed computer hardware or software or technical failures, garbled, misrouted, scrambled transmissions, printing, typographical or other errors in these Official Rules, in any Sweepstakes-related advertisements or other materials, or other errors or problems of any kind whether computer, network, cellular, human, electronic or otherwise relating to or in connection with this Sweepstakes, including, without limitation, any errors or problems which may occur in connection with the administration of the Sweepstakes, delay of the start date of the Sweepstakes, the processing of entries or text messages or in the announcement of the prizes, or the cancellation, suspension or preemption of NBA games. The use of automated or similar devices, including but not limited to entries submitted using any bot, macro, script, or sweepstakes service (or any other devices intended to automate any aspect of entry) to enter this Sweepstakes is prohibited and any entries made through such means are void. Mechanically reproduced mail-in entries are void. Released Parties are not responsible for any injury or damage to entrant’s or any other person’s wireless phone/handset related to or resulting from participation in this Sweepstakes. By entering this Sweepstakes, entrants (and, if eligible minors, their parents or legal guardians) give their express permission to be contacted by Sponsor by telephone, e-mail and/or postal mail for Sweepstakes purposes only. CAUTION: Any attempt to deliberately damage or undermine the legitimate operation of this Sweepstakes is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek damages (including attorneys’ fees) and/or other remedies from any such person(s) responsible for the attempt to the fullest extent permitted by law.

Winner Selection:
Six (6) Grand Prize drawings will be conducted one (1) for each participating Market) on/about 4/16/08 by P/S/T, an independent judging organization whose decisions will be final and binding in all matters relating to this Promotion. Potential Grand Prize winners will be selected in individual random drawings from among all eligible entries received for each applicable participating Market as described above. The first randomly selected Grand Prize winner for each Market that answers a telephone call placed by P/S/T notifying him/her of his/her potential winning status and agrees to accept prize will be declared a Grand Prize winner, subject to verification of eligibility and compliance with the terms of these Official Rules. Messages will not be left on answering machines or with live persons. In the event that the selected potential Grand Prize winner declines the prize, is not eligible to accept the prize, does not comply with the terms of these Official Rules or is not available for any reason when called, his/her prize opportunity will be forfeited and P/S/T, at its discretion and time permitting, may select an alternate winner from among all remaining eligible entries. In the event of a dispute as to the identity of any text message entrant, entrant will be deemed the primary account holder associated with the wireless telephone number. In the event of a dispute as to the identity of an entrant that entered by mail, the person named on the applicable entry (3”x 5”) will be deemed the entrant. For text- message entry, the “primary account holder” is defined as the natural person who is assigned to a wireless telephone number by a wireless service provider responsible for assigning that wireless phone number. Proof (to Sponsor’s satisfaction) of being the primary account holder may be required by Sponsor. Odds of winning will depend on the number of eligible entries received for the applicable drawing. Entries from one Market drawing will not be included in the other Market drawings. Limit one (1) prize per person and per household.

Prizes:
(6) Grand Prizes/(1) Per participating Market: Each Grand Prize Winner will receive two (2) tickets to one first round 2008 NBA Playoffs Game (Approximate Retail Value (“ARV”)=$500US). Transportation and lodging not included. Game tickets must be used on the dates specified by Sponsor or prize will be forfeited and, at Sponsor’s discretion, an alternate winner selected from among all remaining eligible entries for the drawing at issue. Winner and guest are responsible for providing their own transportation and lodging. Exact seat locations at game to be determined by Sponsor in its sole discretion. Tickets are subject to terms and conditions specified thereon. All prize details are at Sponsor’s sole discretion. Total ARV of all prizes: $3,000US.

Miscellaneous:
No transfer, assignment, cash redemption or substitution of a prize is permitted, except by Sponsor who reserves the right to substitute a prize with one of comparable or greater value, at its sole discretion. All federal, state, and local taxes, including but not limited to any applicable income or withholding taxes, customs duties or like fees and all other costs and expenses associated with prize acceptance and use not specified herein as being provided are the sole responsibility of the winners. If an eligible minor is selected as a winner, prize will be awarded in the name of minor’s parent or legal guardian (however, minor will be required to accompany parent/legal guardian to game as the guest and in no event will more than two (2) tickets be awarded). Potential winners may be required to execute and return an Affidavit of Eligibility, Liability Release and (where legal) Publicity Release within one (1) day of date of notification. Failure to return documents within specified time period, non-compliance with any of the foregoing or these Official Rules may result in disqualification and, time permitting, awarding of prize to an alternate winner for the drawing at issue at Administrator’s sole discretion from among all remaining eligible entries. Each Grand Prize winner (and, if an eligible minor, his/her parent or legal guardian) and his/her guest agree to comply with all NBA and team arena rules and regulations relating to the use of NBA game tickets and, in accordance therewith, agree not to act in an unsportsmanlike or disruptive manner, or with any intent to annoy, abuse, threaten or harass any other person at such game. Failure to do so may result in forfeiture of prize. Sponsor, in its sole discretion, reserves the right to: 1.) disqualify any person and void any entries of any person who it believes has tampered with the entry process, the operation of NBA.com, or any other component of this Sweepstakes, whose conduct or actions affect the administration, integrity, security, fairness or proper conduct of this Sweepstakes, or who is in violation of these Official Rules; and 2.) modify, suspend or terminate this Sweepstakes should virus, bugs, non-authorized human intervention or other causes, including but not limited to war, strikes, and/or acts of God, corrupt or impair the administration, security, fairness or proper play of this Sweepstakes and, in the event of termination at its discretion, select the winner for the drawing at issue from among eligible, non-suspect entries received for such drawing as of the date of the event requiring such termination. By participating, entrants (and, if eligible minors, their parents and legal guardians) agree to be bound by these Official Rules and agree that: 1.) Released Parties and their designees and assigns may use (unless prohibited by law) such entrant’s name, voice, city/state of residence, photograph, and/or other visual likeness for advertising and/or trade purposes and/or for the purpose of posting their name on NBA.com and/or for any other purpose in any media or format now or hereafter known worldwide in perpetuity without further compensation, permission or notification; 2.) 1. How Do I Enter the NBA/JC Penney Playoffs Sweepstakes Using My Mobile Phone?
You can enter the NBA/JC Penney Playoffs Sweepstakes by sending a text message with the promoted keyword to the short code 30391 from your mobile phone. Keywords are linked to where you live and are prominently displayed on the advertisements.

3.How many times can I enter the sweepstakes?
The NBA allows you to enter the sweepstakes once per day by your mobile phone or by mail 4/7/2008 through 4/11/2008 (though mail in entries can be rec’d up until 4/15/08). You will only receive one MT per day, and any additional entries received that day will not be valid.

4.How do I send a text Message?
All phones have different menu options and buttons and you should consult your user manual for specific instructions for your phone. Generally, however, by going to the MESSAGES option, selecting TEXT MESSAGE and then choosing NEW MESSAGE/WRITE MESSAGE your phone will open a new text message. In the message area use the keypad to type in the keyword associated with the mobile service you would like (you may have to press the numeric key more then once to display the letter you would like to type). In the area where it asks for the phone number type in the 5 digit short code 30391 and press SEND/SELECT. If you are still unsure please see your phone’s user manual for instructions on text messaging.

6.What is a Keyword?
