2008-09 Pistons-Palace Foundation/Detroit Free Press Gift of Reading Scholarship Contest Rules and Regulations

NO PURCHASE REQUIRED TO ENTER. SCHOLARSHIP CONTEST VOID IN NEW YORK, FLORIDA, RHODE ISLAND, PUERTO RICO, QUEBEC, AND WHERE PROHIBITED OR OTHERWISE RESTRICTED BY LAW. SUBJECT TO ALL FEDERAL, STATE AND LOCAL LAWS.

Eligibility: The Scholarship Contest is open only to residents in the state of Michigan. Online entrants must be at least thirteen (13) years of age or older as of September 17, 2008. Employees and immediate families (spouse, parents, siblings, and children) of the Detroit Pistons, the National Basketball Association and its Member Teams, NBA Properties, Inc., and their respective parents, subsidiaries, affiliates, directors, officers, governors, employees, and agents, are not eligible.

Agreement to Official Rules: By participating in the Scholarship Contest, entrant warrants that he/she fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Sponsor and/or Administrator, which are final and binding in all matters related to the Scholarship Contest.

How to Enter: Scholarship Contest begins on September 17, 2008 at 9:30 a.m. Eastern Time and ends on April 1, 2009 at 11:59 p.m. Eastern time. Limit one entry per school aged child. There are two (2) ways to enter.

  1. Entrants who are thirteen (13) year of age or older as of September 17, 2008 can complete the online entry form at www.pistons.com. To be considered for the first Scholarship award drawing entries must be received by October 1, 2008 by 5:00 p.m. Eastern time. All entries received after 5:00 p.m. Eastern time on October 1, 2008 will be considered for the later drawing and previous submissions not chosen will be automatically entered for the later drawing on April 1, 2009 at 11:59 p.m. Eastern time. Automated or mechanically reproduced entries are void. All information submitted by entrants is subject to the National Basketball Association Privacy Policy accessible at: http://www.nba.com/news/privacy_policy.html. Entrants must complete all non-optional data requested on the online entry form. Incomplete entries are void. The written submission must clearly express what the topic "Sportsmanship" means to the individual and be written with a maximum of 2,000 words.


  2. All entrants, including entrants who are under thirteen (13) years of age as of September 17, 2008 can send name(s), address, phone number, to "Detroit Pistons Scholarship Contest, ATTN: Community Relations, The Palace of Auburn Hills, 5 Championship Drive, Auburn Hills, MI 48326." To be considered for the first Scholarship award drawing mailed entries must be received by October 1, 2008 5:00 p.m. Eastern time. All entries received after 5:00 p.m. Eastern time on October 1, 2008 will be considered for the later drawing and previous submissions not chosen will be automatically entered for the later drawing on April 1, 2009 at 11:59 p.m. Eastern time. All entries become the property of the Detroit Pistons and will not be acknowledged or returned. Incomplete entries are void. Entrants who submit a mailed version need to clearly define "Sportsmanship" in a written story with a maximum of 2,000 words and also can include drawn pictures in the place of words if age appropriate.

Prize: Eight (8) winners will receive a $2,500 scholarship to be used towards tuition of a higher education. The scholarship is held by Detroit Free Press Gift of Reading until Winner reaches the appropriate age to advance to a higher education school. Detroit Free Press Gift of Reading will directly invest the scholarship to the University, College or Vocational School of the Winner's choice. Winner, or Winner's guardian if Winner is under the age of 18, must fill out additional paperwork with Detroit Free Press Gift of Reading and provide a school name, class schedule and student identification number when available.

Winner: Winners will be selected based on their understanding and ability to express what the theme "Sportsmanship" means to them. The story must be 2,000 words or less and either tell a story about sportsmanship, caring or giving, provide an example about the term "Sportsmanship" or create a drawing and pictures to do so. Essays are judged on originality, writing style, grammar, content, and overall message.

One (1) winner will be chosen on the first drawing date and seven (7) on the later drawing date listed above. All eligible entries received by the Detroit Pistons whose decisions regarding all aspects of the Scholarship Contest shall be final and binding. Winners will be contacted on October 7, 2008 and April 3, 2009. Limit of one (1) prize per grade level student. Winner will be notified via phone, email, and/or overnight courier. In the event that the Winner does not respond to any such notification within five (5) days after we send out notification, or if Winner declines the prize, is ineligible or otherwise fails to qualify, a disqualification will result and, if time permits, an alternate winner shall be randomly chosen from among all remaining eligible entries.

As a condition of being awarded any prize, Winner (or if a minor, his/her parent or legal guardian) will be required to execute and deliver to The Detroit Pistons a signed affidavit of eligibility, acceptance of these Official Rules and release of liability. Failure to execute, or return of the affidavit of eligibility and release of liability will also result in disqualification. Except where prohibited, in consideration for being awarded the prize, winner hereby agrees and consents, without further authorization, compensation or remuneration of any kind, to the use of winner's name and likeness in any and all advertising, promotions and other publicity conducted by the Detroit Pistons, the National Basketball Association and its Member Teams, NBA Properties, Inc. and their respective parents, subsidiaries, affiliates, directors, officers, governors, employees and agents.

The scholarship is transferable only to immediate family members who live at the same address as the winner. Winner is solely responsible for all applicable federal, state and local taxes and any expenses associated with the prize, unless otherwise indicated. No substitution, cash equivalent or other transfer of prize is permitted except at the team's option.

Suspension of Contest and Use of Email Addresses: The Detroit Pistons disclaim any liability for damage to any computer system resulting from participating in, accessing and/or downloading information in connection with this Scholarship Contest, and further reserve the right, in their sole discretion, to cancel, modify or suspend the Scholarship Contest should a virus, bug, computer problem, unauthorized intervention or other causes beyond The Detroit Pistons' control, corrupt the administration, security or proper play of the Scholarship Contest. The Detroit Pistons may elect to identify winners and award the prizes by way of random drawing from among all entrants who had entered the Scholarship Contest at the time of such cancellations.

All online entries must include a valid e-mail address for the entrant. In case of multiple entries, only the first entry received will be considered and we reserve the right to void your entry entirely. In the event of dispute as to the identity or eligibility of a winner based on an e-mail address, the winning entry will be declared made by the "Authorized Account Holder" of the e-mail address submitted at the time of the entry. The "Authorized Account Holder" is the person to whom the applicable Internet service provider or other organization (such as business or educational institution) has assigned the e-mail address(es) for the domain associated with the submitted e-mail address.

The Detroit Pistons reserve the right to disqualify any entrant it finds to be tampering with the entry process or the operation of the Scholarship Contest or violating these Rules. The Detroit Pistons shall not be liable for: (i) late, lost, delayed, stolen, misdirected, postage-due, incomplete unreadable, inaccurate, garbled or unintelligible entries, communications or affidavits, regardless of the method of transmission; (ii) telephone system, telephone or computer hardware, software or other technical or computer malfunctions, lost connections, disconnections, delays or transmission errors; (iii) data corruption, theft, destruction, unauthorized access to or alteration of entry or other materials; (iv) any injuries, losses or damages of any kind caused by the prize or resulting from acceptance, possession or use of a prize, or from participation in the Scholarship Contest; or (v) any printing, typographical, administrative or technological errors in any materials associated with the Scholarship Contest. Sponsor may prohibit an entrant from participating in the Scholarship Contest or winning prize if, in its sole discretion, it determines such entrant is attempting to undermine the legitimate operation of the Scholarship Contest in any way by cheating, hacking, deception, or any other unfair playing practices of intending to annoy, abuse, threaten or harass any other players or The Detroit Pistons' representatives. Use of any automated system to participate is strictly prohibited and will result in disqualification. The Detroit Pistons may disqualify, at its sole discretion, any entries it believes to be created by an automated system.

Miscellaneous Rules: Any attempt by any person to undermine the legitimate operation of the Scholarship Contest may be a violation of criminal and civil law, and, should such an attempt be made, the Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. The Detroit Pistons reserve the right to seek remedies and damages (including attorney's fees and costs) against such persons. The Detroit Pistons failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Scholarship Contest, or any prizes awarded, other than those concerning the administration of the Scholarship Contest or the determination of winners, shall be resolved on an individual basis and not by class action, consolidation, joinder or in any other manner, and exclusively by the United States District Court for the Eastern District of Michigan (Southern Division) or the appropriate Michigan state court located in Oakland County, Michigan; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Scholarship Contest, but in no event attorneys' fees; and (iii) entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Scholarship Contest, shall be governed by, and construed in accordance with, the laws of the State of Michigan, without giving effect to any choice of law or conflict of law rules (whether of the State of Michigan or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Michigan.

Indemnification, Release and Limitation of Liability: By entering, entrant agrees to the Detroit Pistons, the National Basketball Association and its Member Teams, NBA Properties, Inc., Detroit Free Press Gift of Reading their respective parents, subsidiaries, affiliates, directors, officers, governors, employees and agents against any and all liability, damages or causes of action (however named or described), with respect to or arising out of either (i) entrant's participation; or (ii) the receipt or use of the prizes awarded in the promotion or any travel in connection with the use of the prizes. False or deceptive entries or acts will render the entrant ineligible. Except where prohibited by law, by participating in the Scholarship Contest, entrant agrees to release and hold harmless the Detroit Pistons, the National Basketball Association and its Member Teams, NBA Properties, Inc., and Detroit Free Press Gift of Reading and their respective parents, subsidiaries, affiliates, directors, officers, governors, employees and agents, (the "Released Parties") from and against any claim or cause of action arising out of participation in the Scholarship Contest or receipt or use of any prize, including, but not limited to: (a) unauthorized intervention in the Scholarship Contest; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) errors in the administration of the Scholarship Contest or the processing of entries; (e) late, lost, or undeliverable mail; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Scholarship Contest or receipt or use of any prize. Entrant further agrees that in any cause of action, the Released Parties' liability will be limited to the cost of entering and participating in the Scholarship Contest. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages. If for any reason an entrant's entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant's sole remedy is another entry in the Scholarship Contest; provided that if it is not possible to award another entry due to discontinuance of the Scholarship Contest for any reason, Sponsor, at its discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein.

Odds: The number of eligible entries received will determine the odds of winning.
