Pacers Gold Star Rewards Program Official Rules
1) No purchase necessary. Promoter/Sponsor of this sweepstakes is Pacers Basketball, LLC d/b/a Indiana Pacers, Pacers Sports & Entertainment, Conseco Fieldhouse and Home Court (“Pacers”) with an address of 125 S. Pennsylvania Street, Indianapolis, IN, 46204. (2) Sweepstakes open to legal residents of Indiana 18 years of age or older that have been Indiana Pacers 2009-10 full season ticket holders since October 30, 2009. Employees and immediate family members (spouse, parents, siblings and children) of employees of Pacers, the National Basketball Association and its Member Teams, NBA Properties, Inc., and each of their respective parents, subsidiaries, affiliates, directors, officers, owners, members, employees and agents are not eligible. (3) Sweepstakes begins December 16, 2009 and ends February 27, 2010. There will be 3 separate drawings during the sweepstakes: the first drawing will be conducted on or before January 6, 2010 and will include all accounts in which all tickets in the respective account were used for all December 2009 Indiana Pacers home games during this promotion; the second drawing will be on or before February 5, 2010 and will include all accounts in which all tickets in the respective account were used for all January 2010 Indiana Pacers home games; the third drawing will be on or before March 5, 2010 and will include all accounts in which all tickets in the respective account were used for all February 2010 Indiana Pacers home games. To be eligible for each monthly drawing, all tickets in your account must be used for each applicable home game of the prior month (e.g., to be eligible for the February 2010 drawing all tickets in your account must be used for each January 2010 home game). (4) One first prize and thirty-three secondary prize winners will be randomly selected from all eligible accounts per drawing. (5) First prize for the January drawing is a Krieg DeVault Club Level Suite for twelve people for the January 16, 2010 Pacers vs. New Orleans game($3,000 value)with four parking passes ($48 value) and a preset menu of food and soft drinks ($500 value) ($3,548 total value). First prize for the February drawing is a VIP Night for four people to the Saturday, February 27, 2010 Pacers vs. Chicago game including four Row 1 tickets ($2,200 value ), limo ride from winner’s home to game and back only ($600 value ) (winner and guests of winner (or their parent/legal guardian if guest is under 18 years of age) will be required to sign a release provided by Pacers to participate), and a $300 voucher for dinner at a local restaurant before the game ($3,100 total value). First prize for the March drawing is four “Hollywood” seats ($4,000 value) next to the Indiana Pacers Bench for the Friday, March 26, 2010 Pacers vs. Utah game and one parking pass ($12 value)($4,012 total value). (6) The following secondary prizes will also be awarded in each drawing: (i) a Pacers Blue & Gold Elite T-shirt to ten winners ($10 per shirt; $300 total value); (ii) Two Courtside tickets to five winners for an Indiana Pacers game in the following month as selected by the Pacers($318 per pair; $4,770 total value); (iii) Two Legends presented by Bright House Networks tickets to five winners for an Indiana Pacers game in the following month as selected by the Pacers($260 per pair; $3,900 total value); (iv) One Larry Bird and Jim O’Brien photoball to five winners ($20 per ball; $300 total value); (v) A Pacers Blue & Gold Elite leather portfolio notebook to four winners ($15 per notebook; $180 total value); (vi) A signed Indiana Pacers player jersey to two winners ($75 per jersey; $450 total value); and (vii) One $30 Home Court Gift Card to two winners ($30 per card; $180 total value). Retail values reflect unautographed merchandise (where applicable). Retail value of hand-signed merchandise is subject to fluctuation based on the featured player(s)/person(s) and current market value at the time of prize award. (7) Total value of all prizes combined is: $20,740. (8) No prize winner can win more than one prize per drawing. (9) Odds of winning dependent on the number of eligible accounts per drawing. (10) Additionally, all eligible accounts in which all tickets in the respective account were used for all December, January and February Indiana Pacers home games will receive an invitation for two to attend a Pacers Bunker Suite Experience at a 2009-10 Pacers home game in the Bunker Suite of Conseco Fieldhouse ($275 per person value). (11) Only the account holder of record for each account will be awarded the prize if said account is selected as a winner. All prizes are non-transferable to any other person, including relatives or friends. (12) All winners will be contacted via phone or email by a Pacers Ticket Service representative. In the event a winner cannot be contacted within seventy-two (72) hours of the initial call or declines the prize another winner will be chosen from all eligible accounts. (13) Each winner is solely responsible for all applicable federal, state and local taxes and any expenses (including but not limited to travel expenses) associated with the sweepstakes, unless otherwise indicated. No substitution, cash equivalent or transfer of prize permitted except at the Pacers’ option for a prize of comparable or greater value. (14) A list of winners can be obtained by writing the Indiana Pacers, Ticket Services Dept, Attn: Pacers Gold Star Rewards Program, 125 S. Pennsylvania Street, Indianapolis, IN 46204. (15) By participating, each participant agrees to follow the Official Rules and forever releases, discharges, and waives any and all claims, liabilities and actions of any kind, howsoever caused or arising and whether by negligence, any intentional act or otherwise, that entrant may have or that may arise against Pacers Basketball, LLC d/b/a Indiana Pacers, Pacers Sports & Entertainment, Conseco Fieldhouse and Home Court, and/or the National Basketball Association and its Member Teams, NBA Properties, Inc., and each of their respective parents, subsidiaries, affiliates, directors, officers, owners, members, shareholders, employees, successors, assigns and agents (“collectively, the “Released Parties”), with respect to or arising out of either (i) entrant’s participation; or (ii) the receipt or use of the prizes awarded in the sweepstakes. By participating, each participant further agrees to defend, indemnify and hold harmless the Released Parties and their insurers against any and all damages, costs, judgments, and/or expenses (including but not limited to legal fees) they may incur as a result of claims made against them in connection with either (i) entrant’s participation; or (ii) the receipt or use of the prizes awarded in the sweepstakes. (16) Except where prohibited by law, in consideration for being awarded the prize, each winner hereby agrees and consents, without further authorization, compensation or remuneration of any kind, to the use of winner’s name, likeness, voice, photograph, performance, personal statements and/or biographical information in any and all advertising, promotions and other publicity conducted by Pacers, and/or the National Basketball Association and its Member Teams, NBA Properties, Inc., and each of their respective parents, subsidiaries, affiliates, agents, successors and assigns. (17) Pacers reserve the right to cancel the sweepstakes, modify the sweepstakes and prizes as deemed necessary by Pacers and/or change dates relating to the sweepstakes (including but not limited to dates for which Indiana Pacers tickets are provided) in case of game schedule changes/acts of God/force majeure events. (18) Each winner may be required to sign an Affidavit of Eligibility and Release attesting to the fact that he/she is eighteen years of age or older, as well as other terms and conditions as designated by Pacers and consent to the use of his/her likenessin order to collect the prize or an alternate winner may be selected. Noncompliance with this or any requirement in the Official Rules may result in disqualification and forfeiture of the prize and the random selection of an alternate winner from the eligible accounts. (19) Any disputes in connection with this sweepstakes will be resolved by Pacers, whose judgment shall be final. (20) All validly claimed prizes will be awarded. Any unclaimed prizes or prizes for which there are no eligible winners will not be awarded. (21) Void where prohibited.
