OFFICIAL SWEEPSTAKES RULES
1. Sweepstakes Period: Sweepstakes begins on February 15, 2010 and ends at 7:00 p.m. EDT on March 1, 2010 (the "Sweepstakes Period").
2. To enter: NO PURCHASE NECESSARY. A PURCHASE WILL NOT INCREASE THE CHANCES OF WINNING. There are two (2) ways to enter the "NETS Facebook and Twitter sign up for Jayâ€"Z Concert Tickets! (1) Sign up to follow "NETS Basketball" on Twitter - http://twitter.com/netsbasketball - and tweet, "Hey @NetsBasketball I want to win two tickets to the Jay-Z concert at the Izod Center on March 6th. More info: http://bit.ly/jayznets" during the Sweepstakes Period; or (2) Become a fan of "NETS Basketball" - http://www.facebook.com/netsbasketball - on Facebook and fill out the Jay-Z Giveaway form during the Sweepstakes Period.
To be eligible, all entries must be received by March 1, 2010.
Limit: One entry per person per social media platform during the Sweepstakes Period. To be eligible for the Grand Prize, all entries must be received by 7:00 p.m. EDT on March 1, 2010. The NETS are not responsible for late, incomplete, misdirected entries, administration of the Sweepstakes, or the announcement of the prize.
By becoming a Twitter follower of NETS Basketball or Facebook fan of NETS Basketball, you consent to being contacted through the social media platform or by email, as applicable, by the NETS and their affiliated companies.
3. Eligibility: VOID WHERE PROHIBITED. Sweepstakes open to legal residents who are 18 years of age or older at the time of entry and who reside within the NETS marketing territory as defined by the NBA (currently, a 75 mile radius from the contiguous border of the Borough of East Rutherford, NJ). Sweepstakes is void where prohibited or restricted by law. Employees and directors of New Jersey Basketball, LLC d/b/a the New Jersey NETS (the "NETS"), the National Basketball Association and its member teams, NBA Properties, Inc., and NBA Media Ventures, Inc. (collectively, the "NBA"), and all of their advertising and promotional agencies, parents, subsidiaries, affiliates, directors, officers and employees and the immediate family (spouse, parent, sibling, and children) and household members of such employees, directors, and officers are not eligible.
4. Selection of Winners: A random drawing conducted at the NETS Basketball headquarters will be conducted on or about March 2, 2010 to determine a winner for each social media platform.
The Winners will be notified through the social media platform for which they have entered the contest or by email and/or phone on or about March 2, 2010. If either of the Winners is unreachable or does not make direct contact with the NETS by date specified in the notification message, or fails to accept the Grand Prize, the prize will be forfeited in its entirety and an alternate winner will be selected from the remaining eligible entries, time permitting. Odds of winning depend upon the number of eligible entries received per social media platform.
5. Two (2) Prizes: Two (2) (i.e., one from Twitter, one from Facebook) Grand Prize Winners will each receive two (2) tickets to the Jay-Z concert at the IZOD Center in East Rutherford, NJ on March 6, 2010. (Approximate Retail Value for each Grand Prize Winner is $150.00)(Each, a Prize);
6. Prize Conditions: Prize values are expressed in U.S. Dollars. The prize cannot be transferred, assigned, or redeemed for cash. In the event of Prize unavailability, the Prize may be substituted for one of equal or greater value, in the NETS sole discretion. Each Prize Winner will be required to execute an Affidavit of Eligibility and Liability/Publicity Release, where permitted, no later than to March 5, 2010. If any of the foregoing documents are not completed, signed, and returned within the respective stated time, or if the potential Winner is found to be ineligible, or if he/she does not comply with these Official Sweepstakes Rules, then potential Winner will be disqualified and an alternate winner will be selected from the remaining eligible entries, time permitting. If any Prize or Prize notification is returned as undeliverable, this will result in disqualification and an alternate winner will be selected. All federal, state or other tax liabilities (including income taxes) will be the sole responsibility of the winners. Winners are solely responsible for any and all costs not specifically described as part of the Prize including any and all travel expenses. Except where prohibited by law, each Winner's acceptance of the Prize constitutes agreement for the NETS, National Basketball Association and its member teams, NBA Properties, Inc. and NBA Media Ventures, Inc., to use said Winner's name, photographs, video, likeness, statements (if true), biographical information, voice, and city and state of residence for advertising and trade purposes on a worldwide basis (without review by Winner) and in all forms of media, without further compensation, remuneration, or authorization.
7. Sweepstakes Conditions: This Sweepstakes is subject to all applicable federal, state, and local laws. By participating, Entrants waive any right to claim ambiguity in the Sweepstakes or these Official Sweepstakes Rules. WINNERS AND ENTRANTS RELEASE, DISCHARGE, AND AGREE TO INDEMNIFY AND HOLD HARMLESS THE NETS, NEW JERSEY BASKETBALL, LLC, P.C., THE NBA, LIVENATION, AND EACH OF THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, PARENTS, SUBSIDIARIES, AFFILIATES, AGENTS AND REPRESENTATIVES FROM AND AGAINST ANY LIABILITY FOR ANY DAMAGES, INJURY OR LOSSES, TO ANY PERSON (INCLUDING DEATH), OR PROPERTY, OF ANY KIND RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY FROM ACCEPTANCE, POSSESSION, MISUSE OR USE OF ANY PRIZE OR PARTICIPATION IN ANY SWEEPSTAKES RELATED ACTIVITY OR PARTICIPATION IN THIS SWEEPSTAKES.
8. Limitations of Liability: NETS is not responsible for late, misdirected, incomplete, or undeliverable, entries. NETS may prohibit an Entrant from participating in the Sweepstakes or winning a prize if, in its sole discretion, it determines that said Entrant is attempting to undermine the legitimate operation of the Sweepstakes by cheating, hacking, deception, or other unfair playing or intending to annoy, abuse, threaten or harass any other Entrants or the NETS representatives or employees. If for any reason this Sweepstakes is not capable of running as planned, including but not limited to, by reason of tampering, unauthorized intervention, fraud, or any other causes beyond the control of the NETS which, in the sole opinion of the NETS, corrupt or affect the administration, security, fairness, integrity or proper conduct of the promotion, then the NETS reserves the right at its sole discretion to cancel, terminate, modify or suspend this Sweepstakes and select winners received prior to the action taken.
9. Claims/Choice of Law: (a) Any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes but in no event attorneys fees; and (b) under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than actual out-of-pocket expenses, and any and hereby waives all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Sweepstakes Rules, or the rights and obligations of Entrant, the NETS in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of New Jersey, without regard for conflicts of law doctrine, and all proceedings shall take place in that State. All contestants who enter the Sweepstakes agree to submit to the exclusive jurisdiction of the courts of the State of New Jersey and agree to waive the right to a jury trial with respect to any claim or dispute with regard to any aspect of the Sweepstakes or Official Sweepstakes Rules.
