"KIA PERFORMANCE SWEEPSTAKES" ("KPS") CONTEST
(the "Contest")
OFFICIAL RULES
  1. ELIGIBILITY. NO PURCHASE NECESSARY. Void where prohibited. The Contest is open only to legal residents of New York, New Jersey and Connecticut who are at least eighteen (18) years of age at the time of entry, and who reside within a 75-mile radius of Madison Square Garden. Employees, household members (related or otherwise) and/or the immediate family member of those employed by Kia Motors America, Inc., the New York Knicks ("Knicks"), (together, "Sponsors"), Madison Square Garden, L.P. ("MSG"), the National Basketball Association and its member teams, NBA Properties, Inc. (collectively, the "NBA Entities"), and each of their respective parents, subsidiaries, affiliates, directors, owners, and agents, are not eligible to participate. The Contest is subject to all applicable federal, state and local laws and regulations. Entering the Contest constitutes full and unconditional agreement to these Official Rules and MSG's and Sponsors' decisions, which are final and binding in all matters related to the Contest. Winning a prize is contingent upon fulfilling all requirements set forth herein. Sponsors are not responsible for late, stolen, lost or illegible entries or for typographical or other errors in the printing of this offer or administration of this Contest.
  2. TIMING. The Contest begins at 12:01 AM Eastern Time ("ET") on October 29, 2008 and ends at 11:59 PM ET on April 15, 2009 (the "Promotional Period").
  3. HOW TO ENTER. Limit one (1) entry per person, regardless of method of entry.

    (A) In-Arena Entry: [Eligible KPS Games: 11/14/08, 12/19/08, 1/17/09, 2/6/09] Valid ticket holders attending any or all of the four (4) pertinent "Kia Performance Sweepstakes" Knicks basketball games at Madison Square Garden ("MSG") (the "KPS Games"), and who meet the Contest's eligibility requirements will be automatically entered in the Contest. To enter via this method without a KPSGame ticket, hand print your full name, address, city, state, zip code, e-mail address (if any), age, daytime and nighttime phone numbers on a 3x5 index card and deposit the card in the Official Entry Box located in the lobby of Madison Square Garden six (6) hours in advance until one (1) hour in advance of the scheduled tip-off of the KPS Games. (See table below for KPS Game schedule and Entry Box hours.)

    (B) Online Entry: [Eligible KPS Games: 3/20/09, 4/15/09] Visit www.nyknicks.com and click on the Kia Performance Sweepstakes Contest button located at the bottom of the website. You will be taken to the Contest's registration page and asked to submit your first and last name, address, city, state, zip code, email address, daytime and evening phone number and date of birth. Online entries must be submitted no later than 11:59PM on April 8, 2009. Winning Online entry will be notified via phone or email on April 13, 2009. If winning Online Contestant cannot be reached, fails to respond within 24 hours, or is not present at KPS Game during time of Contest, s/he will forfeit the prize and an alternate Winner will be selected from among the pool of available ticket stubs. (See table below for KPS Game schedule.)

    (C) Entry by Mail: [Eligible KPS Games: 3/20/09, 4/15/09] Send a postcard containing the contestant's first and last name, address, city, state, zip code, daytime and evening phone number and date of birth to: New York Knicks, Attn: Kia Performance Sweepstakes Contest, 2 Penn Plaza - 14th Floor, New York, New York 10121. Mail-in entries must be postmarked by April 5, 2009 and received no later than April 10, 2009. If selected, winning Mail entries will be notified via phone or email three days prior to the respective KPS game date. If winning Mail Contestant cannot be reached, fails to respond in 24 hours, or is not present at KPS Game during time of Contest, s/he will forfeit the prize and an alternate Winner will be selected from among the pool of available ticket stubs. (See table below for KPS Game schedule.)

  4. SELECTION OF CONTEST WINNERS.

    (A) Ticket holders and Lobby Drop-Box Contestants. At each of the four (4) pertinent KPS Games, one (1) contestant will be selected in a random drawing from a pool comprised of scanned ticket numbers and the index cards collected from the Official Entry Box, if any. If the contestant selected is a ticket holder, s/he will be informed by public address announcement, staff member, and/or video scoreboard message within the first thirty (30) minutes after tip-off of each KPS Game. If the contestant selected used the drop-box entry method, s/he will be informed via an announcement made in the MSG lobby within the first thirty-five (35) minutes after tip-off during the applicable KPS Game (together, the "Potential In-Arena Winner"). Potential In-Arena Winners must be present at the time of the announcement, must meet eligibility requirements, must have a valid form of identification and, if a ticket holder, must be in possession of the ticket associated with the ticket number, in order to become the Official In-Arena Winner. If a Potential In-Arena Winner is unable to fulfill any of the requirements, an alternate Potential In-Arena Winner will be selected from among the remaining eligible entries.

    (B) Online and Mail-In Contestants. One (1) contestant will be randomly selected on March 17, 2009 (for the KPS game on March 20, 2009) and one (1) contestant will randomly be selected on April 13, 2009 (for the KPS game on April 15, 2009) from among all eligible online and mail-in entries received (the "Potential Online/Mail-in Winners"). Potential Online/Mail-In Winners will be contacted by phone approximately 72 hours prior to the respective KPS contest chosen for, and subject to verification of eligibility requirements, will be declared the Official Online/Mail-In Winners. If a Potential Online/Mail-In Winners are unreachable or do not make direct contact with Sponsor by a date specified, or are unable to fulfill any prize requirements, the prize will be forfeited in its entirety and an alternate Potential Online/Mail-In Winner will be selected from among the remaining eligible entries. Qualified Official Winners will have an opportunity to participate in one (1) of the six (6) On-Court Contests (defined below) for the chance to win one (1) of six (6) possible prizes, as designated by the Contest format below.
  5. ON-COURT CONTESTS.

    (A) First Round. During each KPS Game, that Game's Official Winner (the "Contestant") will be given the opportunity to compete in an on-court contest to be held either during a timeout, a quarter break or halftime during that night's Game (the "On-Court Contests"). The Contestant will be allowed as many shot attempts as possible in thirty (30) seconds to successfully sink five (5) baskets from the free-throw line (the "Free-Throws"). No practice or warm-up shots will be allowed. A successful Free-Throw consists of the Contestant sinking a regulation-sized basketball through a regulation-sized hoop from behind the free-throw line and without the ball touching any surface except the backboard, rim and/or net. If the Contestant steps on or over the free-throw line before releasing the ball, such shot will be disqualified and considered a miss. No part of the contestant's body or clothing may come in contact with the free-throw line prior to releasing the ball. Contestants will be assisted by three (3) MSG staff members to rebound and retrieve balls. If the Contestant successfully makes exactly one (1) Free-Throw within the allotted time, they will win a Fifth Prize. If the Contestant successfully makes exactly two (2) Free-Throws within the allotted time, they will win a Fourth Prize. If the Contestant successfully makes exactly three (3) Free-Throws within the allotted time, they will win a Third Prize. If the Contestant successfully makes exactly four (4) Free-Throws within the allotted time, they will win a Second Prize. If the Contestant successfully makes exactly five (5) Free-Throws within the allotted time, they will win a First Prize and the opportunity to compete in the Final Round of the Contest for a chance to win a Grand Prize ("Finalists"). First through Fifth Prizes are exclusive of each other, and contestants will only win the highest value of these prizes based on number of free-throws they make. If the Contestant does not make five (5) Free-Throws during their designated On-Court Contest, then they will not move on to the Final Round.

    (B) Final Round. Each Finalist will have one (1) shot attempt from behind the half-court line to win the Grand Prize - a brand new 2009 Kia Borrego. No practice or warm-up shots will be permitted. If the Finalist steps on or over the half-court line before releasing the ball, the shot will be disqualified and counted as a miss. A successful Half-court shot consists of the Contestant sinking a regulation-sized basketball through a regulation-sized hoop from behind the half-court line and without the ball touching any surface except the backboard, rim and/or net. No part of the Finalist's body or clothing may come in contact with the demarcation line prior to releasing the ball.
  6. PRIZES.

    The Knicks will be responsible for all Participation Prizes and First through Fifth Prizes. Kia Motors America will be responsible for all Grand Prizes (and/or Grand Prize-related insurance).

    Participation Prize: Each Winner will receive a Knicks t-shirt and gift bag. (Approximate Retail Value ("ARV") $15 per set.
    Fifth Prize: Up to six (6) First Prizes will be awarded. Each Fifth Prize Winner will receive One hundred Dollars ($100.00). Only those Contestants who make exactly one (1) Free-throw as described above will win a First Prize.
    Fourth Prize: Up to six (6) Second Prizes will be awarded. Each Fourth Prize Winner will receive Two hundred dollars ($200.00). Only those Contestants who make exactly two (2) Free-throws as described above will win a Second Prize.
    Third Prize: Up to six (6) Third Prizes will be awarded. Each Third Prize Winner will receive Three Hundred Dollars ($300.00). Only those Contestants who make exactly three (3) Free-throws as described above will win a Third Prize.
    Second Prize: Up to six (6) Fourth Prizes will be awarded. Each Second Prize Winner will receive Four Hundred Dollars ($400.00). Only those Contestants who make exactly four (4) Free-throws as described above will win a Fourth Prize.
    First Prize: Up to six (6) Fifth Prizes will be awarded. Each First Prize Winner will receive One Thousand Dollars ($1000.00). Only those Contestants who make exactly five (5) Free-throws as described above will win a Fifth Prize. Grand Prize: Up to six (6) Grand Prizes will be awarded. Grand Prize Winner(s) will receive a new 2009 Kia Borrego LX (ARV $26,995) in addition to the First Prize.

    Prize monies to be paid via company check, and mailed to Winners' place of residence. Grand Prize Winner(s) will be solely responsible for insuring and registering the Vehicle, all Vehicle title, license and registration fees, sales tax, delivery, dealer prep, emissions inspection, additional equipment, insurance, gasoline, maintenance and all other fees and expenses associated with the receipt and use of the Vehicle, unless listed in these rules as part of the Grand Prize. The interior/exterior colors and specific package details of Vehicle to be determined by Sponsor. Any vehicle options and/or upgrades not specifically part of the package chosen by Sponsor will solely be the Grand Prize Winner's responsibility. Grand Prize Winner(s) must provide proof of valid insurance and a valid driver's license to take delivery and must take delivery at a retailer designated by Sponsor within two (2) weeks of notification. Grand Prize Winner(s) agree that Sponsor has neither made nor is responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to the Vehicle, including but not limited to its quality, mechanical condition or fitness, except the Vehicle does include Sponsor's standard vehicle limited warranty as set forth in the vehicle's Owner's Guide. Grand Prize Winner is solely responsible for all federal, state and local taxes on the Vehicle. Grand Prize is non-transferable. No substitutions or cash redemptions. In the case of unavailability of the Grand Prize, Sponsor reserves the right to substitute a prize of equal or greater value.
  7. Each contestant accepts and agrees to be bound by these Official Rules and the decisions of the Sponsors, which shall be final and binding in all respects. By participating in the Contest, each Contestant consents to the use of his/her name and/or photograph for advertising and publicity purposes without additional compensation by sponsors and NBA Entities. No substitution, cash equivalent or transfer of prizes (except at the option of Sponsors for a prize of equal or greater value). Odds of winning depend on the number of eligible entries received and/or ticket holders attending each of the Kia Performance Sweepstakes Games. Taxes, if any, are the sole responsibility of the Prize Winner(s).
  8. This offer is void where prohibited and subject to all federal, state and local laws and any disputes shall be resolved in the courts of New York County. All entries become the property of Sponsors, who are not responsible for incomplete, late, stolen, lost, damaged or misdirected mailed entries, postage due, illegible or mutilated mail which prevents user's ability to participate in the Contest or by any human error which may occur in the processing of the entries in this Contest or for typographical or other errors in the printing of the offer, administration of the Contest or in the announcement of the prizes. Sponsors reserve the right to cancel, suspend or modify the Contest, or any part thereof, at their sole discretion or if there is any suspected or actual evidence of electronic or non-electronic tampering, fraud or technical failure which may destroy the integrity of the Contest as determined by the Sponsors, in their sole discretion and, in such event, to select Winners for any remaining prizes by randomly drawing from among all valid entries received, up to such time of cancellation, termination, or suspension, and/or solely from the mailed entries.
  9. Winners agree that the Sponsors, the National Basketball Association and its Member Teams, NBA Properties, Inc., and each of their respective parents, subsidiaries, affiliates, directors, officers, employees and agents shall not be liable for, and winner shall hold such entities and individuals harmless against any and all liability relating to, damages or causes of action (however named or described), with respect to or arising out of either (i) entrant's participation; or (ii) the receipt or use of the prizes awarded in the Contest including, without limitation, injury, loss or damage of any kind resulting from participation in this promotion or from the acceptance or use of the prizes awarded.
  10. USE OF DATA. Sponsors will be collecting personal data about entrants via internet, drop-boxes and mail-in entries including first and last name, street address, phone number, and email address, in accordance with its privacy policy. Please review the Sponsors' privacy policy at www.nba.com and www.kia.com. By participating in the Contest, entrants hereby agree to Sponsors' collection and usage of their personal information and acknowledge that they have read and accepted Sponsors privacy policy.
  11. For the names of winners or copy of the Official Rules, send a self-addressed stamped envelope to: Kia Performance Sweepstakes Contest, 2 Penn Plaza, New York, New York 10121 by May 15, 2009.
