1. ELIGIBILITY: Must be 18 years of age or older and a legal resident of one of the 50 United States or District Columbia to enter. Employees (“Employees”) of Sponsor (as defined below) and the National Basketball Association (the “NBA”) and its Member Teams and NBA Properties, Inc. (collectively, “NBA Entities”) (“Sponsor”); Hewlett-Packard Development Company, L.P (“HP”); Staples, Inc. or any of their respective promotion/advertising agencies are NOT eligible. The children, siblings, spouses, and legal wards of Employees are not eligible. Children who reside in the same household with any Employees, whether related or not, are not eligible. By participating, you agree to these Official Rules and all decisions of Sponsor and its agencies (including Sponsor representatives), which are final and binding. Void where prohibited.

2. PROMOTIONAL PERIOD: Game offered at various Staples, Inc. (“Staples”) stores between Wednesday 5/27/09 and Saturday 7/11/09. See below for a complete list of Game Locations and Promotional Times (collectively “Turnstile Game Locations and Times”).

Game begins and ends each day on the times noted above for each location. Game will officially end when all game cards have been distributed/used, subject to prize claim deadline.

3. HOW TO PLAY:

A. A game card can be received via one of two (2) methods.

The first method by which participants may receive a free game card is to obtain one at any of the twenty (20) participating Turnstile Game Locations, only during the Promotional Hours of each location on its respective promotional day and while supplies last. Participant will then have to visit the Turnstile Game kiosk with their game card during the promotional times listed above in order to play.

The second method by which participants may receive a free game card is to obtain one during each of the seven (7) pre-promotional event days. The pre-promotional event days will be held every Thursday from 11:00AM – 5:00PM in the city center of each respective tour market and while supplies last. Specific dates, times and markets are listed below. Participant will then have to visit the Turnstile Game Kiosk with their card at any of the Turnstile Game Locations during the promotional times listed above.

No purchase necessary to enter. Limit one game card per person per Turnstile Game Location and pre-promotional event days.

B. Scan your Game Card under the reader at Kiosk as directed by Sponsor representative. Scan must be done in one fluid motion of hand. Only one scan per game card. ANY CONTACT WITH THE READER OTHER THAN SCANNING OF GAME CARD OR MULTIPLE SCANS/ATTEMPTED MUTLIPLE SCANS OF GAME CARD/OR ANY FRAUDULENT ATTEMPTS AT PARTICIPATION WILL RESULT IN DISQUALIFICATION. Attempts to scan game card are available on a first come-first served basis. If multiple participants wish to scan game cards at the same time, each participant must follow the instructions of Sponsor representative and form a line, at all times acting in an orderly and civil manner, and attempt game card scan only after being called by Sponsor representative.

C. If you’ve won, the prize description and quantity will appear on the screen after you have swiped (subject to verification). All participants will receive one (1) branded NBA-HP photo frame with desktop theme regardless of whether participant is a potential instant winner. NBA-HP photo frame availability, while supplies last.

D. To claim prize, give game card to Sponsor representative within one (1) minute of prize level being displayed on screen. PRIZE CLAIMS WILL NOT BE ACCEPTED AFTER SUCH TIME. Prize claim is also subject to verification at Sponsor’s sole discretion. Before being awarded any prize, winners may be required to sign an Affidavit of Eligibility and Publicity Release at the time the prize is awarded. UNCLAIMED AND FORFEITED PRIZES WILL NOT BE AWARDED.

4. PRIZES/APPROXIMATE RETAIL VALUES ("ARV"s)/ODDS PER STORE LOCATION (unless otherwise specified).

Note: Prize levels will not appear on the screen – only the prize and quantity will appear after each scan is completed.

LEVEL 1 : (1) NBA Suite Night: $7,000 each* *NOTE: Only one (1) NBA Suite Night Prize will be awarded at only one (1) event location throughout the duration of the Promotion. This will include tickets for one (1) winner and fifteen (15) guests. Food and beverage will also be included in the suite.

LEVEL 2 : (1) HP DV2 Notebook $749.99 each

LEVEL 3 : (1) HP Printer $299.99 each

LEVEL 4 : (1) Pair of NBA Game Tickets (2 total tickets): $500.00 each pair

LEVEL 5 : (2) NBA Authentic NBA Basketball Jersey: ARV: $179.99 each

LEVEL 6 : (3) NBA Official Game Basketball: ARV $99.99 each

LEVEL 7: (3) Staples Gift Card: ARV $50.00 each

LEVEL 8 : (15) NBA Hat: ARV $14.99 each

LEVEL 9 : (10) NBA Store Gift Card ARV: $25.00 each

LEVEL 10: All participants with a valid game card will receive one (1) NBA-HP branded photo frame ARV: $0 each.

LEVEL 11: All participants with a valid game card will be able to download an NBA desktop theme. ARV: $0 each.

Odds of winning will be determined by the total number of participants who scan their cards at each Turnstile Game Location during respective Promotional Times.

5. CONDITIONS: Game cards are void if they (a) contain printing, mechanical or other errors; (b) have been reproduced or tampered with in any way; (c) were not obtained directly from Sponsor representative. Game card (and right to scan same) is NOT transferable. Game cards cannot be redeemed/exchanged for cash or credit. Any use/attempted use of game cards other than in accordance with these Official Rules or other violation of Official Rules (including attempting to tamper with game cards or reader), as determined in Sponsor’s sole discretion, will result in disqualification and prize forfeiture. No prize transfer; no prize substitution. Limit one prize per person. In the event that production, seeding, printing, programming failures, or other reasons/errors cause more than the stated number of prizes in each prize category to be available and/or claimed, Sponsor reserves the right to award only the prizes in each affected prize category as stated in these Official Rules (if previously not awarded), by a random drawing among all legitimate eligible prize claimants in the affected prize category. Sponsor and its agencies not responsible for any printing error in these Official Rules, administration of Game or announcement of winners. Taxes, if any, are the sole responsibility of each winner.

6. RELEASES: By participating, you agree that Sponsor, the NBA Entities, HP, Staples, Inc., ION Marketing, LLC and each of their respective parents, subsidiaries, affiliates, promotion/advertising agencies and their respective officers, directors, employees and agents shall be released and held harmless by participants from and against any liability of any kind arising from acceptance, misuse/use of prize or participation in the Promotion. By accepting prize, where legal, winner agrees to the use of his/her name, likeness, photograph or other indicia or persona for advertising/trade/publicity purposes by the NBA Entities, HP and Sponsor without further compensation or notice.

7. LIMITATIONS OF LIABILITY: Sponsor, the NBA Entities, HP, their respective agencies, and their respective affiliates and related entities are not responsible for lost, late, stolen, misdirected, illegible, irregular or defective game cards, or for any technological, electronic, computer, network or other error malfunction/failure/error of game card, reader (and/or computer screen) or unauthorized human intervention; or the incorrect, incomplete or inaccurate capture of game play information or display of game play results (regardless of cause). Any Game Piece containing printing or other errors is limited to replacement with another Game Piece, during the promotional period while supplies last. If, for any reason, the Game is not capable of running as planned, Sponsor reserves the right, at its sole discretion, to make prizes available by some other means determined by Sponsor in its sole discretion to be fair, appropriate and consistent with these Official Rules. Notice of such action will be posted at Kiosk.
