The Miami Heat/Nova Southeastern University’s Fischler School of Education and Human Services (NSU’s Fischler School) contest begins at 11:00 a.m. (EST) on February 25, 2009 and ends at 11:00 p.m. (EST) on March 25, 2009 (the “Contest Entry Period’). The essay must be 250 words or less and should be written based on the theme provided. Void outside the state of Florida and where prohibited. 1. Contestants need not be present when a determination is made to qualify for a chance to win any prize. Contest subject to all federal, state, and local laws. 2. ELIGIBILITY: One (1) contestant will win a Grand Prize, One (1) contestant will win the First Place Prize, and one (1) contestant will win the Second Place Prize. Contest is open only to legal residents of South Florida who reside within a seventy-five mile radius of the AmericanAirlines Arena and who are at least 18 years of age at the time of entry. Contest void where prohibited by law. Employees of the Nova Southeastern University, Miami Heat, the National Basketball Association and its Member Teams, NBA Properties, Inc., NBA Media Ventures, LLC and each of their respective parents, subsidiaries, affiliates, partners, directors, owners, employees and agents (collectively, the “NBA Entities”) and members of the immediate families and those living in the same household of each are not eligible to enter in the contest. 3. Official entry forms are available online at www.heat.com. Entrants must complete the Official Entry Form or mail in their essay and include entrant’s name, age, address, e-mail address and daytime phone number and mail it to the address listed in Section 5 below. The essays will be judged by a panel of Fischler School faculty and administrators on the basis of content and overall theme concept. The winner will be notified by phone, email, and certified letter. No reproductions will be accepted and entrants who submit plagiarized essays may be subject to disqualification. The Miami Heat, NSU’s Fischler School, the National Basketball Association and its Member teams, NBA Properties, Inc., NBA Media Ventures, LLC, are not responsible for lost, late, misdirected, incomplete, mutilated, deleted, ineligible or otherwise deficient entries nor for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind, or inaccurate transmissions of or failure to receive entry information by NSU’s Fischler School, through www.heat.com, on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof. If for any reason the program is not capable of running as planned, due to, for example, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Miami Heat or NSU’s Fischler School which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, the Miami Heat and/or NSU’s Fischler School reserve the right at their sole discretion to terminate, modify or suspend the Contest. Their decision regarding adequacy of entry forms will be final. Caution: Any attempt by a contestant to deliberately damage any website or undermine the legitimate operation of the game is a violation of criminal and civil laws and should such an attempt be made, the Miami Heat reserves the right to seek damages from any such contestant to the fullest extent of the law. "Miami Heat/ NSU’s Fischler School” begins February 25, 2009 and ends March 25, 2009. 4. Enter as many as 5 times. Any individual who enters more than 5 times will be automatically disqualified. Miami Heat and NSU’s Fischler School reserve the right to cancel, terminate or suspend this Contest or any part of this Contest should any virus, bug, non-authorized intervention, telecommunications or computer failure, or malfunction, or other causes beyond its control, corrupt or impair the security, administration, fairness and/or operation of this Contest as determined by Miami Heat and NSU’s Fischler School in their sole discretion. Miami Heat, NSU’s Fischler School, the National Basketball Association and its Member Teams, AmericanAirlines Arena, NBA Properties, Inc. and NBA Media Ventures, LLC (including any affiliates thereof) are not responsible for injury or damage to participant’s (or any other person’s) computer, modem, or other electronic device, related to or resulting from participating or receiving materials in this Contest, or any other liability or damage of any kind related to this Contest. 5. All entries must be received online or postmarked no later than March 25, 2009. Further, mailed entries must be received no later than March 27, 2009 and must be sent to the following address: “Miami Heat/NSU’s Fischler School” Contest, 1750 NE 167 Street, North Miami Beach, FL 33162. 6. The Grand Prize Winner will win a prize package that includes a $10,000 scholarship to Nova Southeastern University’s Fischler School of Education and Human Services. The First Place Prize Winner will win a prize package that includes a $5,000 scholarship to Nova Southeastern University’s Fischler School of Education and Human Services. The Second Place Prize Winner will win a prize package that includes a $2,500 scholarship to Nova Southeastern University’s Fischler School of Education and Human Services. 7. The total value of the Grand Prize is $10,000, the First Prize is $5,000, and the Second Prize is $2,500. Odds of winning the Grand Prize depends upon the number of eligible entries received on or before the dates set forth in Section 5 above. Winners will be selected on or about April 1, 2009. Winner will be required to sign and return an affidavit of eligibility as well as a liability and publicity release within three (3) days of prize notification. In the event of non-compliance within this time period, prize will be forfeited and an alternate winner will be selected. 8. By participating, entrants agree to abide by these rules. Acceptance of prize constitutes permission for NSU’s Fischler School, the Miami HEAT and its affiliates, AmericanAirlines Arena, the National Basketball Association and its Member Teams, NBA Properties, Inc., NBA Media Ventures, LLC and their respective parents, subsidiaries, affiliates, directors, officers, governors, employees and agents to use winner’s name, biographical information, and/or likeness for purposes of advertising and promotion without further compensation, authorization, or remuneration, as permitted by law. 9. NSU’s Fischler School shall have the sole right to disqualify any entrant for violation of these rules or any applicable laws relating to the contest or who make any misrepresentations relative to the contest and/or redemption of prizes. NSU’s Fischler School shall resolve all disputes in their sole discretion. All prizes are non-refundable, non-redeemable for cash, non-transferable and non-endorsable, cannot be combined with other offers or discounts, and cannot be applied to application fees, registration fees, or student service fees. Recipients must satisfy the program’s admission criteria prior to acceptance. Although not required hereby to do so, NSU’s Fischler School reserves the right to, and may in its sole discretion, substitute a prize of equal or greater value. In the event of cancellation for any reason, NSU’s Fischler School and Miami Heat reserve the right to reschedule the prize at a future date to be determined by NSU’s Fischler School and Miami Heat in their sole discretion. 10. By entering the Contest, entrant agrees to release, discharge, and hold harmless NSU’s Fischler School, the Miami HEAT, the AmericanAirlines Arena, the National Basketball Association and its Member Teams, NBA Properties, Inc., NBA Media Ventures, LLC, Basketball Properties, Ltd., Miami Heat Limited Partnership, the County of Miami-Dade, and their respective parents, subsidiaries, affiliates, directors, partners, officers, governors, employees and agents harmless from and against any and all losses, liability, costs, expenses, damages, rights, claims and/or actions (however named or described), resulting directly or indirectly from participation in this Contest and/or acceptance, possession or use of any prize, including without limitation, personal injuries, death and property damage. 11. Each prize winner is responsible for any federal, state or local tax liability, charges or other expenses which may result from any prize received and are not expressly listed in these rules as being a part of the prize. The contest cannot be used in conjunction with any discounts, other promotions, or contests. Entries become the property of NSU’s Fischler School and Miami Heat and will not be returned. 12.
