Sprite Slam Dunk Showdown Official Rules
The Promotion will consist of two (2) components: 1) online and 2) on-site. By entering the Promotion, each participant represents that he/she is in good physical condition and that he/she has the physical capacity to participate in the Promotion and understands and accepts all risks associated with participation in the Promotion. Each participant also expressly acknowledges his/her understanding that the Promotion can be dangerous and can involve the risk of serious physical injury. Each participant represents that he/she is participating in the Promotion voluntarily, with full knowledge of the potential risks entailed and he/she is expressly, knowingly and voluntarily assuming the risk of any and all physical injury associated with or caused by his/her participating in the Promotion.
To Participate: There are two (2) ways to enter the Promotion during the period commencing 3:00:00PM Eastern Time (“ET”) on 5/7/09 and concluding 12:00:00AM ET on 7/12/09 (“Promotion Period”): 1) Online: a) Visit nba.com/dunk; b) Complete and submit the online registration form according to the instructions provided; c) Submit a video of no longer than thirty (30) seconds that demonstrates your basketball “dunking” abilities using a basketball hoop 10 feet in stature and either (i) in the case of male participants, an official regulation size NBA basketball (basketball specifications: circumference of 29.5 inches, inflated to 7-9 psi) or (ii) in the case of female participants, an official regulation size WNBA basketball (basketball specifications: circumference of 28.5 inches, inflated to 7-9 psi); and d) Click the “Submit” button. Video must be submitted in .mov, .avi and .wmv format and cannot exceed 50mb in size. Video should only depict the participant and his/her “dunking” abilities. Video may contain multiple dunks, but should only showcase the dunking ability of one single individual. All online entries must be received by 12:00:00 AM ET on 7/12/09 to be considered; or 2.) On-Site: Visit the designated basketball courts at certain national NBA tour stops (each, an “Event”) (see nba.com/dunk for Event locations) prior to the start of each Event’s portion of the Promotion. The first (20) eligible contestants to sign up onsite and up to (38) invited play-in contestants will be able to try-out for the Promotion (hereafter “play-in contestants”). Eligible play-in contestants will be able to register on a first-come, first-served basis. Sponsor does not guarantee that every eligible individual who wishes to participate will be able to do so. Each contestant will be directed to try-out for the Event, in a manner specified by Sponsor in its sole discretion. All details regarding the mechanics and other rules, procedures and conditions for participation in the try-out for the Event will be determined by Sponsor (in its sole discretion) and provided immediately prior to the start of the applicable Event. Any disputes will be resolved by the Sponsor (or the supervising staff designated by Sponsor for the Promotion), whose decision shall be final, conclusive and binding. The up to (38) invited play-in contestants and the (2) play-in contestants will be matched into groups of two and compete head–to-head in a manner specified by Sponsor in its sole discretion, to compete for the prize outlined below. Contestants must complete the Event in the sequence presented. Only basketball(s) in the designated area will be used for the Event. Up to (40) forty-two contestants will move on to Round One of the On-Site Event Judging.
On-Site Event Judging:Round One, Round Two, the Semi-Final Round, and the Final Round will be judged by a panel of judges designated by Sponsor. For Round One, Round Two, the Semi-Final Round, and the Final Round, contestants will be required to perform (2) total dunks, and each dunk will need to be completed within 2 minutes. Contestants will alternate dunks with the other contestants participating in each round. Each dunk will be rated on a score of 6 through 10 for skill and ability. The three scores will be combined to give an overall total score. The (20) contestants with the highest total score in Round One will move on to the Round Two. The (8) contestants with the highest total score in Round Two will move on to the Semi-Final round. The (4) contestants with the highest total score in the Semi-Final Round will move on to the Final round. The (2) contestants with the highest total score in the Final Round will advance to the Event Championship Round at the Event. In the event of a tie in any round (exactly 50.0% of votes for each dunker), a one-dunk dunk-off will take place to determine the contestant(s) that will move on to the next Round. Any dunk-off will be repeated as necessary until the tie is broken. The dunk-off will be judged by the panel of judges designated by Sponsor. Time limit rules will apply for any dunk-off.
For the Event Championship Round contestants will be required to perform (2) total dunks, and each dunk will need to be completed within 2 minutes. Contestants will alternate dunks with the other contestants participating in each round. Each Event Championship Round will be judged by an on-site fan vote at each Event via text message only. The letter “A” will be assigned to the dunker who goes first, and “B” for the other contestant. Fans will be directed to send a text message with their vote (either the letter “A” or “B”) to the number designated by Sponsor. Voting will open once the Championship Round begins. Voting will be closed five minutes after the final dunk has been completed.
The contestant with the most SMS fan votes for the Event Championship Round will be crowned the 1st Place Prize Winner for such Event. In the event of a tie in the Event Championship Round (exactly 50.0% of votes for each dunker), a one-dunk dunk-off will take place to determine the 1st Place Prize Winner for such Event. Any dunk-off will be repeated as necessary until the tie is broken. The dunk-off will be judged by the panel of judges designated by Sponsor. Time limit rules will apply for any dunk-off. Immediately following the close of each Event Championship Round, the potential 1st Place and 2nd Place winners will be required to execute (where permitted by law) an Affidavit of Eligibility/Liability & a Publicity Release on-site. Failure to comply with these Official Rules or to execute the above stated documents, may result in disqualification and, at Sponsor’s sole discretion, the applicable prize will be awarded to the next runner-up from the applicable Event. The 1st Place Prize Winner for each Event will receive $1,000 awarded in the form of a check and one (1) flip video camera (valued at $153) and will automatically advance to the Peer Voting Round (as described below). The 2nd Place winner for each Event will receive $500 awarded in the form of a check. Prize awards are subject to verification of eligibility and compliance with these Official Rules. Sponsor reserves the right not to award all on-site prizes or not to advance any Event participant to the Peer Voting Round if, in its sole discretion, it does not receive a sufficient number of eligible and qualified entries for any round of the Promotion.
Participation Details:All dunks MUST be performed on a 10’ hoop; any submissions containing dunks performed on hoops shorter than 10’ will be disqualified immediately. Any dunker (in either method of entry) employing props that improve their jumping ability or bring them closer to the hoop will forfeit their ability to move onto the next round. This includes the use of ladders, trampolines, pogo sticks, stilts, chairs, shoes with lifts or added bouncing ability and any other item that the Sponsor deems as aiding a dunker's reach, distance or height. Props & third parties MAY be used and are encouraged to aid in the theatrics of a dunk, but the Sponsor reserves the right to disqualify based on any third party help they see as aiding the dunker's height, distance or ability to reach the hoop. Each participant video must be such participant’s original work, may not feature any individuals other than the participant, and must not infringe or include materials that infringe or potentially infringe, upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity. Videos containing prohibited content, or violating any law or these Official Rules will be void. For videos in Entry Method 1, any special effects added during production are strictly forbidden. This includes any and all digital editing that takes places between when the dunker leaves the ground and when the ball goes through the hoop. Videos should show dunks only in their true form, without digital manipulation or additions. Videos containing such prohibited content will not be accepted. Sponsor reserves the right to photograph, videotape and otherwise record the dunk competition(s). All footage submitted or captured as part of the Promotion and any participant video submissions (collectively, “Footage”) will be owned by Sponsor, which will have the right, along with its designees, to use, edit, adapt, post, stream, copy and exploit such Footage and all elements embodied therein, including any names, voices, likenesses and performance embodied therein, in any and all media, now or hereafter devised, without further payment or consideration, notification or permission, worldwide and in perpetuity, except where prohibited by law. Without limiting the foregoing, by entering the Promotion and without limiting any other rights granted hereunder, each participant hereby grants permission for the Footage of him/her and/or his/her video entry to be posted on nba.com/dunk or other websites. There is a limit of one (1) entry per person and per e-mail address per of method of entry (total of two (2) potential entries). Additional entries received in excess of two (2) from any person, e-mail address or household will be void and could render all entities from such person, email address or household void. Noncompliance with foregoing or with these Official Rules may result in disqualification and all associated entries will be void. Each participant agrees that Released Parties are not responsible for any unauthorized use of videos and/or Footage by third parties. Released Parties do not guarantee the posting of any video and/or Footage. Released Parties reserve the right to edit the videos and/or Footage for posting on nba.com/dunk as they deem necessary in their sole discretion & participants acknowledge & agree that Released Parties shall not be responsible for any alleged consequences of such editing. The use of any device to automate or subvert the entry process is prohibited and any such entries will be void. Other than for prize notification or for promotional emails, neither Sponsor, nor anyone acting on its behalf, will enter into any communications with any participant regarding this Promotion or acknowledge any entry not meeting all entry requirements stated herein & such entries will be void. Entries that are deemed by the judges and/or Sponsor in their sole discretion to be immoral, obscene, profane or not in keeping with Sponsor’s image or in violation of these Official Rules will be void. Released Parties are not responsible for incomplete, lost, late, inaccurate, delayed, undelivered, garbled, stolen, damaged or misdirected entries or text messages (or any component thereof), inaccurate Promotion-related information provided by Sponsor or for interrupted or unavailable network, server, cable, satellite, Internet Service Provider (ISP), wireless or other connections, miscommunications, computer or software malfunctions or telephone line, cellular tower, or transmission problems or technical failures, garbled transmissions, damage to a user's computer equipment (software or hardware) or other errors or malfunctions of any kind whether caused by equipment, programming used in this Promotion, mechanical, electronic, network, technical or human error or otherwise relating to or in connection with the Promotion, including, without limitation, errors which may occur in connection with the administration of the Promotion, the processing or judging of entries, the uploading of videos, the cancellation or postponement of any Event, the tabulation of votes and/or text messages, the taping of onsite entries, the announcement of the prizes or in any Contest-related materials. Released parties reserve the right, in their sole discretion, to void suspect entries or to modify, cancel, terminate or suspend Promotion (or portion thereof) should virus, bugs, non-authorized human intervention or other causes corrupt or impair the administration, security, fairness or proper play of the Promotion &, in the event of such cancellation or termination, at its discretion, determine the winners and/or Finalist for the applicable portion of the Promotion from all eligible non-suspect entries received prior to event requiring cancellation or termination using the judging procedure stated herein. By participating, participants agree to abide by these Official Rules & the decisions of the Sponsor and judges, which shall be final & binding.
Online Judging: On or about 7/13/09 based on the following criteria, a panel of qualified independent judges (designated by Sponsor) will select the top two (2) videos submitted online: 1) How original/creative is the submission: 0-30 points; 2) How difficult was the slam dunk: 0-30 points; 3) How well does the video showcase the entrant’s athleticism: 0-20 points; and 4) What is the overall impression of the submission: 0-20 points. The two (2) online entrants with the highest total scores based on above judging procedure will move on to the Peer Voting Round (subject to verification of eligibility and compliance with the terms of these Official Rules). In the event of a tie, entrant from among those tied with the highest score in originality/creativity will move on to the Peer Voting Round. If a tie still exists, from among remaining pool of tied entrants, entrant with highest score in difficulty, athleticism and then in overall impression (if and as necessary to break tie), will move on to the Peer Voting Round. All judges’ decisions will be final and binding in all matters relating to this Promotion. The two (2) highest scoring online entrants will be notified by telephone and/or overnight courier and will be required to execute and return an Affidavit of Eligibility and a Release of Liability and (where legal) a Publicity Release within two (2) days of date of issuance of notification.
Peer Voting Round: On or about 7/21/09 at 3:00:00PM ET the First Place winners from each NBA Event (eight (8) total) and the top two (2) videos from the online judging will be posted online at nba.com/dunk for peer voting. Individuals will be invited to follow the directions provided at www.nba.com/dunk to vote for the two (2) participants who they believe best demonstrate basketball “dunking” abilities in each category, by no later than 3:59:59 PM ET on 8/20/09. Individuals may vote as often as they wish. Votes generated by script, macro or other automated means or with the intent to affect the integrity of or subvert the peer voting process will be void. Participants are prohibited from obtaining votes by any fraudulent or inappropriate means, including, without limitation, offering prizes or other inducements to members of the public, as determined by Sponsor in its sole discretion. Subject to verification of eligibility and compliance with these Official Rules, the four (4) entries with the highest number of valid votes, as determined by Sponsor in its sole discretion, will be deemed “Finalists” and will move forward to the Sprite Slam Dunk Showdown Championship Round (as described below). In the event of a tie in any category, such tied Entries will be judged by a “tie-breaking” judge based on originality/creativity to determine the Finalist for the category at issue.
Finalist Notification: The four (4) potential Finalists will be notified by telephone and/or overnight courier and will be required to execute and return an Affidavit of Eligibility and a Release of Liability and (where legal) a Publicity Release within two (2) days of date of issuance of notification. Finalists must be able to travel to Dallas, TX between 2/11/10 and 2/15/10. Traveling companion of each Finalist must be of legal age of majority in his/her jurisdiction of residence (and at least 18) unless child or legal ward of Finalist and (if minor, Finalist) will be required to sign and return a Liability Release and (where legal) Publicity Release prior to the issuance of travel documents. Released Parties are not responsible for lost, late, stolen, undelivered, delayed, damaged, postage-due or misdirected mail. Noncompliance with the foregoing, with these Official Rules, the inability to contact a potential Finalist within a reasonable time period or any notification being returned as non-deliverable may result in disqualification and, at Sponsor’s discretion, a runner-up Finalist may be notified (at the sole discretion of the Sponsor) for the Event and/or category at issue (as applicable).
Sprite Slam Dunk Showdown Championship Round: The four (4) Finalists will be flown to Dallas, TX (as described further in the Prizes section below) where they will compete in the Sprite Slam Dunk Showdown Championship Round. For Round One, the Finalists will be required to perform (2) total dunks, and each dunk will need to be completed within 2 minutes. Finalists will alternate dunks with the other Finalists participating in Round One. Each dunk will be rated on a score of 6 through 10 for skill and ability. The three scores will be totaled to give an overall average score. The (2) contestants with the highest average score in the Round One will advance to the Championship Round. In the event of a tie in Round One, a one-dunk “dunk-off” involving the tied players will take place to determine which player(s) will advance to the Championship Round.
For Championship Round, the (2) remaining Finalists will be required to perform (2) total dunks, and each dunk will need to be completed within 2 minutes. Finalists will alternate dunks with the other Finalist participating in the Championship Round. The Championship Round will be judged by fan vote via text messages only on-site at the 2009 NBA All-Star Jam Session in Dallas, TX (event location subject to change by Sponsor). The letter “A” will be assigned to the dunker who goes first, and “B” for the other contestant. Fans will be directed to send a text message with their vote (either the letter “A” or “B”) to the number designated by Sponsor. Voting will open once the Championship Round begins. Voting will be closed five minutes after the final dunk has been completed. The participant with the most SMS fan votes in the Championship Round will be crowned the Sprite Slam Dunk Showdown Grand Prize Winner. In the event of a tie in the Championship Round (exactly 50.0% of votes for each dunker), a one-dunk dunk-off will take place to determine the Grand Prize winner. Any dunk-off will be repeated as necessary until the tie is broken. The dunk-off will be judged by the panel of judges designated by Sponsor. Time limit rules will apply for any dunk-off.
SMS Voting Details: Important Notice: Standard text messaging fees will apply. Your wireless service provider may charge you for each text message you send and receive. Please consult your wireless service provider regarding your pricing plan. You must be a wireless service subscriber with text messaging service, using a participating service provider in order to vote via this method. Not all cellular phone providers carry the necessary service to participate. Check your phone capabilities for specific text messaging capabilities and instructions. : All votes must be received by the posted deadline to be eligible. Votes will be totaled by a panel of qualified independent judges selected by Sponsor, whose decisions will be final and binding in all matters relating to this Contest. Failure to comply with these Official Rules or to execute the above stated documents, may result in disqualification and, at Sponsor’s sole discretion, prize will be awarded to the next runner-up in the applicable Showdown. Number of votes per user is unlimited. Multiple votes generated by script, macro or other automated means or with the intent to affect the integrity of the peer voting process will be void.
Prizes:(4) Finalist Prizes: (5)-day/(4)-night trip for two (2) to Dallas, TX between 2/11/10 and 2/15/10, consisting of round-trip coach air transportation from a major U.S. gateway airport nearest to Finalist’s residence, standard double-occupancy hotel accommodations (one (1) room), two (2) tickets to select NBA All-Star events (NBA All-Star Jam Session presented by adidas, NBA All-Star Saturday Night, NBA All-Star Game), the opportunity to participate in the Sprite Slam Dunk Showdown and ground transportation to/from the airport and the applicable hotel (Approximate Retail Value: $1,500/each). Actual prize value will vary depending on winner's city of departure. Sponsor, in its sole discretion, reserves the right to provide ground transportation in place of air transportation if Finalist lives within a reasonable driving distance of Dallas, TX as determined by Sponsor, and to award no additional compensation or substitution for the difference in prize value. Travel and hotel arrangements determined by Sponsor in its sole discretion and must be made through Sponsor’s agent, on a carrier of Sponsor’s choice. Trip must be taken on dates and times designated by Sponsor or prize will be forfeited in its entirety and may be awarded to a runner-up Finalist. Each Finalist and his/her guest must travel together on the same itinerary. Guest must be of legal age of majority in his/her jurisdiction of residence (and at least 18) unless child or legal ward of Finalist. Each Finalist and his/her guest are responsible for obtaining all necessary travel documents prior to travel. If events are canceled or postponed for any reason, travel prize will be awarded less applicable prize-related activity(s) and Sponsor will substitute that activity(s) with an item(s)/activity(s) of comparable or greater value as determined solely by Sponsor. Each Finalist and his/her guest must comply with each event venue’s rules and regulations. Failure to do so may result in forfeiture of applicable prize element(s). Exact seat locations at event(s) to be determined by Sponsor in its sole discretion. (1) Grand Prize: $10,000 awarded in the form of a check. Total ARV of all prizes: $16,000. All prize details are at Sponsor’s sole discretion.
Miscellaneous: Finalists and winners are responsible for all federal, state and local taxes and any other costs and expenses associated with prize acceptance and use not specified herein as being provided including, if selected as a Finalist, luggage fees, additional ground transportation, meals, gratuities and souvenirs. No transfer, assignment, or substitution of prizes except by Sponsor, which may substitute a prize (or portion thereof) with one of comparable or greater value, at its sole discretion. By entering, each participant warrants & represents that his entry submitted does not defame or otherwise violate the rights of any third party & does not violate any federal, state or local laws or ordinances. Each participant further warrants & represents: (1) that Sponsor shall own the entry (including video and/or Footage) (as applicable) (& all material embodied therein); (2) that by entering, the participant irrevocably assigns to Sponsor & its designees any & all rights, title & interest in the entry including but not limited to all copyright or intellectual property rights; & (3) that Sponsor & its designees shall have, without limitation, the perpetual, right worldwide to edit, adapt, modify, publish, exploit & use the entries (including video and/or Footage) (as applicable) in any way & in any media now or hereafter known (including on Sponsor’s website) for trade, advertising, promotional &/or other purposes as Sponsor &/or its designees may determine without further permission, notification or consideration to participants, or any third parties. Each participant further agrees that: (1) entry (& all components thereof) will become property of the Sponsor and will not be returned; (2) Released Parties & their designees shall have the right & permission to use (unless prohibited by law) each participants’ name, voice, city & state of residence, photograph &/or likeness for advertising &/or trade &/or any other purpose in any media now or hereafter known without further compensation, permission, authorization or notification to participant& (3) the Released Parties shall have no liability & will be held harmless by participant for any liability, loss, injury or damage to participants or any other person or entity, including personal injury or death to participants or any other person or damage to personal or real property, due in whole or in part, directly or indirectly, by reason of his/her participation in this Promotion, the use of any entry or the acceptance and/or use of any prize (including any travel or activity related thereto) or use of any of the rights granted herein. Released Parties are not responsible for any inability of the winner and/or Finalists to accept a prize & reserves the right, at its sole discretion, to disqualify or eliminate any Finalist. CAUTION: Any attempt to deliberately damage the website or undermine the legitimate operation of this Promotion is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek damages (including attorneys’ fees) and/or other remedies from any such person(s) responsible for the attempt to the fullest extent permitted by law. In the event of a dispute as to online entries by multiple users having the same email account, the authorized subscriber of the email account used to enter the Promotion at the actual time of entry will be deemed to be the participant and must comply with these Official Rules. Authorized account subscriber is deemed to be the natural person who is assigned an email address by an Internet access provider, on-line service provider or other organization, which is responsible for assigning email addresses for the domain associated with the submitted email address.
