Eligibility: Open to legal residents of the 50 United States and the District of Columbia, 18 years of age or older as of 4/1/04. Employees of NBA Properties, Inc. ("Sponsor"), NBA Media Ventures, LLC, the NBA and its member teams, Henkel Corporation, and each of their respective parent companies, subsidiaries, affiliates, officers, directors, governors, owners, distributors, retailers, agents, assignees, advertising/promotion agencies, and Project Support Team, Inc. ("PST") (collectively, "Released Parties") and the immediate family members and/or those living in the same household of any such employees are not eligible to enter or win. This Promotion is subject to all applicable federal, state, and local laws and regulations. Void where prohibited by law. How to Enter: Visit http://www.nba.com/features/contests_promotions.html between 12:00:01AM Eastern Time ("ET") on 4/1/04 and 11:59:59PM ET on 5/31/04 ("Promotion Period") and complete and submit the entry form according to the instructions provided. Limit one entry per person and per email address during each day of the Promotion (with a day defined for the purpose of this Promotion being the 24-hour period beginning at 12:00:00AM ET and ending at 11:59:59PM ET). Additional entries received from any person or email address thereafter during any one day will be void. Released Parties are not responsible for incomplete, late or misdirected entries, failures or malfunctions of phones, phone lines, telephone systems, lost entries or transmissions, interrupted or unavailable network, server or other connections, miscommunications, failed computer hardware or software or technical failures, garbled, misrouted, scrambled transmissions, printing or other errors in these Official Rules, in any Promotion-related advertisements or other materials, or other errors or problems of any kind whether human, electronic or otherwise. The use of automated devices, including but not limited to entries submitted using any bot, macro, script, or sweepstakes service (or any other devices intended to automate any aspect of entry) to enter this Promotion is prohibited. Winner Selection: Winners will be selected in a random drawing on or about 6/14/04 from among all eligible entries received by PST, an independent judging organization whose decisions will be final and binding in all matters relating to this Promotion. Odds of winning will depend on the number of eligible entries received. Winners will be notified by email, telephone and/or mail. Prizes will be awarded to the person named on the applicable entry form (subject to verification of eligibility and the terms of these Official Rules) regardless of whether that is the name of the authorized account holder of the email address from which said entry form was submitted. Limit one prize per person, family or household. Prizes: (1) Grand Prize: A 3-day/2-night trip for the winner and (1) guest to a 2004 or 2005 NBA regular season game designated solely by Sponsor consisting of round-trip coach air transportation from a major U.S. airport near winner's residence, standard double-occupancy hotel accommodations, ground transportation to/from the airport and the applicable hotel, (2) tickets to the designated game, and an exclusive behind the scenes experience at the designated game including participation in select game-day activities to be determined solely by Sponsor (Approximate Retail Value "ARV" =$3,500). Actual prize value will vary depending on winner's city of departure and site of designated game. Travel and hotel arrangements determined by Sponsor in its sole discretion. Winner and guest must travel together on the same itinerary, and any minor traveling companion must be accompanied by a parent or legal guardian. Trip must be taken on dates and times designated by Sponsor or prize will be forfeited in its entirety and may be awarded to an alternate winner. Sponsor, in its sole discretion, reserves the right to provide ground transportation in place of air transportation. If any prize-related activity(s) is canceled or postponed for any reason, travel prize will be awarded less applicable prize-related activity(s) and Sponsor will substitute that activity(s) with an item(s)/activity(s) of equal or greater value as determined solely by Sponsor. Exact nature and duration of activities surrounding winner's exclusive behind the scenes experience shall be determined by Sponsor in its sole discretion. Exact seat locations at designated game to be determined by Sponsor in its sole discretion. Prize details not specifically set forth herein are at Sponsor's sole discretion. (100) First Prizes: Gift basket consisting of select DepÒ products (exact products to be determined by Sponsor) (ARV=$14). Total ARV of all prizes=$4,900. Miscellaneous: No transfer, assignment, cash redemption or substitution of prizes except by Sponsor due to prize (or portion thereof) unavailability, and then for a prize (or applicable portion thereof) of equal or greater value. Federal, state and local taxes and all other expenses not specified herein are winners' sole responsibility. Grand Prize winner will be required to execute and return an Affidavit of Eligibility, Liability Release and (where legal) Publicity Release within (5) days of issuance of notification. Grand Prize winner's traveling companion (if a minor, his/her parent or legal guardian) will also be required to sign and return a Liability Release and (where legal) Publicity Release prior to the issuance of travel documents. Non-compliance with any of the foregoing may result in disqualification and awarding of prize to an alternate winner at Sponsor's sole discretion. If any prize notification letter or prize is returned as undeliverable, winner will be disqualified and an alternate winner may be selected. Grand Prize winner and his/her traveling companion also agree to comply with all NBA rules, regulations, and directions relating to attendance at NBA sanctioned events and/or other activities and, in accordance therewith, agree not to act in an unsportsmanlike or disruptive manner, or with any intent to annoy, abuse, threaten or harass any other person at such event. Sponsor, in its sole discretion, reserves the right to: 1.) disqualify any person and void any entries of any person who it believes has tampered with the entry process, the operation of NBA.com, or any other component of this Promotion, whose conduct or actions affect the administration, integrity, security, fairness or proper conduct of this Promotion, or who is in violation of these Official Rules; and 2.) modify, suspend or terminate this Promotion should virus, bugs, non-authorized human intervention or other causes beyond the reasonable control of Sponsor, including but not limited to war, strikes, and/or acts of God, corrupt or impair the administration, security, fairness or proper play of this Promotion and, in the event of termination or suspension, at its discretion, select winners from among eligible, non-suspect entries received as of the date of the event requiring such termination or suspension. By participating, entrants agree to be bound by these Official Rules and agree that: 1.) Released Parties and their designees and assigns may use (unless prohibited by law) such entrant's name, voice, city/state of residence, photograph, and/or other visual likeness for advertising and/or trade purposes and/or for the purpose of posting their name on NBA.com and/or for any other purpose in any media or format now or hereafter known without further compensation, permission or notification and 2.) Released Parties and all of their respective officers, directors, employees, representatives and agents shall have no liability and will be released and held harmless from any claim, action, liability, loss, injury or damage, including, without limitation, personal injury or death to winner or any third party or damage to personal or real property due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of a prize (including any travel or prize activity related thereto) or participation in this Promotion.
