2007 Clippers Charity Car Raffle Rules

RAFFLE DESCRIPTION: Tickets for the Los Angeles Clippers Foundation Charity Car Raffle (the “Raffle”)will be sold between November 30, 2006 at 9:00 a.m. Pacific Standard Time and 9:30 p.m. Pacific Standard Time on April 4, 2007 (the “Raffle Period”). To purchase a Raffle Ticket, visit the Los Angeles Clippers office, 1111 S. Figueroa Street, Los Angeles, California 90015 during regular business hours or visit www.clippers.com, to download a ticket form. Mail your form to the Los Angeles Clippers Foundation at the same address or fax along with payment or billing information to 213.742.7550. The purchase price of each Raffle Ticket is $100.00. Payment may be made in cash or by check, money order, American Express, Discover, Visa or Master Card. Checks or money orders should be made payable to the Los Angeles Clippers Foundation. Payments are not tax deductible contributions and are not refundable. A properly completed Raffle form and full payment are necessary to purchase a ticket. If a participant’s check or credit card is dishonored or declined, his or her ticket will be invalid unless full payment is received prior to the drawing. Notice of an invalid ticket will be given by mail to the address provided by the participant on his or her Raffle Form.

ELIGIBILITY: Only legal residents of the State of California who are 18 years of age or older are eligible to enter. Officers, directors, employees, partners, members agents, and their immediate or household members, of the Los Angeles Clippers Foundation, a California not-for-profit corporation (the “Sponsor”), the National Basketball Association and its Member Teams, NBA properties Inc, or any of their respective parents, subsidiaries or affiliates including, but not limited to, the Los Angeles Clippers Basketball Club Inc are ineligible to purchase raffle tickets.

PRIZES:

  • One (1) GRAND PRIZE: A 2007 Dodge Charger R/T ($30,000). Winner shall be responsible for payment of any income or sales tax associated with such prize.
  • One (1) SECOND PRIZE: A Road Trip for Two with the Los Angeles Clippers to a mutually agreed upon road game during the 2007-08 regular season. Package includes travel on the team charter, team transportation to the hotel, hotel accommodations for two and two tickets to the game. Choice of game must be decided upon by October 15, 2007.
  • One (1) THIRD PRIZE: One (1) Audio Bahn Full Power Package Custom Car Sound System
  • One (1) FOURTH PRIZE: A Trip for Two to Jamaica. Package includes: 2 roundtrip coach class tickets on Air Jamaica to Montego Bay, Jamaica and 3-night/4-day complimentary all-inclusive room accommodations for two adults in one room based on double occupancy and availability at the Sunset Jamaica Grande Resort & Spa in Ocho Rios, Jamaica. Certain restrictions and blackout periods apply. Winner shall be responsible for payment of service charges, international taxes and transfer fees associated with prize. Travel is valid on Air Jamaica operated flights only, not valid on code share flights. Winner and guest must travel together on the same itinerary and must possess required travel documents (e.g. valid U.S. passport). Trip must be taken by the date indicated on the award certificate.
  • One (1) FIFTH PRIZE: Polanti Ladies Watch Style- Tuscanny Color- Royal Blue Mother Of Pearl Face/Diamonds And Rubies Band- Blue Leather-Croc. Style-"Detachable" Specs- Water Resistant-Stainless Steel-One Time Zone With Date

  • One (1) EARLY BIRD PRIZE: $1,000 in cash.
ADDITIONAL PRIZES: ONE HUNDRED (100) as follows: One (1) BlackBerry 7250; one (1) BlackBerry 7130e; one (1) Xbox 360; one (1) Nintendo DS light; one (1) PSP; one (1) Xbox; two (2) round trip vouchers on jetBlue Airways; one (1) Ballboy/Girl package which includes the opportunity for one child between the ages of 12 and 17 to be a pregame ballboy for a mutually selected Clippers home game with four tickets to the game and a uniform; thirty (30) autographed pictures of a Clippers Player; fifteen (15) 2006-07 team autographed basketballs; twenty-five (25) 2006-07 team autographed hats; fifteen (15) Clippers Players autographed mini basketballs; six (6) Elgin Baylor autographed basketballs; All prizes, other than the Grand, Second, Third, Fourth, Fifth, Sixth and Early Bird Prizes are subject to change in the discretion of the Sponsor. No substitution or transfer of prize permitted except that Sponsor reserves the right to substitute any prize with one of equal or greater value in the event any prize is unavailable. Taxes on prizes are the responsibility of prize winners. Automobile winner must have a valid driver’s license and will be responsible for the payment of all sales taxes, insurance, dealer, title and registration fees associated with the transfer of title to the automobile and for any fees or costs for any changes or upgrades requested to the automobile. Winner must also execute all documents necessary to take title to such automobile. SPONSOR SPECIFICALLY DISCLAIMS ALL EXPRESS AND IMPLIED WARRANTIES INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE REGARDING THE AUTOMOBILE. Delivery of the automobile shall be made approximately eight (8) weeks after the winner executes the Prize Claim Documents (as defined below). Sponsor in its sole discretion may extend the Raffle Period and/or reschedule the Raffle drawings.

RAFFLE DRAWINGS: The Main Drawings to award all prizes other than the Early Bird Prizes will take place on April 5, 2007 from among all eligible raffle tickets purchased during the Raffle Period. Limit one (1) prize per ticket except that the winner of an Early Bird Prize may also win the Grand, Second, Third, Fourth, Fifth, Sixth or one of the other prizes awarded on April 5, 2007. The Early Bird Prize Winner will be randomly selected in a drawing on December 21, 2006 from among all eligible raffle tickets purchased on or before December 20, 2006. All random drawings will be supervised by an accounting firm whose decisions are final. Raffle ticket holders need not be present at the time of the drawings to win. The Early Bird Prize Winners may be announced at half time of the Los Angeles Clippers game on December 27, 2006. All other prize winners may be announced on Thursday, April 5. The potential prize winners will be notified by phone and/or mail and/or email using contact information provided on their raffle ticket forms. Names of potential winners will also be made available at www.clippers.com after April 5, 2007. Only those named as the ticket purchaser on a valid winning raffle ticket form are eligible to claim a prize, and such persons may be required to provide proof of identification acceptable to Sponsor. If a potential winner is found to be ineligible, has not complied with these Official Rules or, despite Sponsor’s reasonable efforts to contact the potential winner, does not respond within five (5) business days of the first notification attempt, such potential winner will forfeit his or her prize and an alternate winner may be selected in another random drawing from among the same eligible entries as the previous drawing.

ODDS: The odds of winning a prize depend on the number of eligible raffle tickets purchased during the Raffle Period, or in the case of an Early Bird Prize, during the Early Bird Period. No more than 1,500 Raffle tickets will be sold.

GENERAL PRIZE CONDITIONS: Winners shall be solely responsible for all federal, state and/or local taxes, including but not limited to, income and sales tax and all federal and state withholding requirements. Potential prize winners may be required to execute an Affidavit of Eligibility/Liability and where legally permissible a Publicity Release (collectively, “Prize Claim Documents”). If any potential winner fails or refuses to sign and return all Prize Claim Documents within ten (10) days of attempted delivery or if any Prize Claim Documents are returned as undeliverable, such potential winner may be disqualified and an alternate winner may be selected.

ENTRY OWNERSHIP/RELEASE. By entering, entrant agrees to follow the Official Rules and hold harmless and indemnify Los Angeles Clippers Foundation, Audiobahn, Polanti Watches, Sunset Jamaica Grande Resort & Spa, Air Jamaica Ltd, the Los Angeles Clippers Basketball Club Inc and/or the National Basketball Association and its Member Teams, NBA Properties, Inc., and each of their respective parents, subsidiaries, affiliates, directors, officers, employees and agents against any and all liability, damages or causes of action (however named or described), with respect to or arising out of either (i) entrant’s participation; or (ii) the receipt or use of the prizes awarded in the promotion.

In consideration for being awarded the prize, winner hereby agrees and consents, without further authorization, compensation or remuneration of any kind, to the use of winner’s name and/or likeness in any and all advertising, promotions and other publicity conducted by the Los Angeles Clippers Foundation, Audiobahn, Polanti Watches, Sunset Jamaica Grande Resort & Spa, Air Jamaica Ltd, the Los Angeles Clippers Basketball Club Inc. and/or the National Basketball Association and its Member Teams, NBA Properties, Inc., and each of their respective parents, subsidiaries and affiliates, except where prohibited by law. Any personal information collected by Sponsor from those who purchase Raffle Tickets may be used in accordance with Sponsor’s privacy policy at www.clippers.com. By participating in this Raffle, participants agree to be bound by these Official Rules and the decisions of Sponsor, which are final and binding in all respects. Participants agree that Sponsor shall not be responsible or liable for losses or injuries of any kind resulting from participation in the Raffle, or the acceptance, use or misuse of any prize. Sponsor reserves the right, in its sole discretion to cancel, terminate or suspend this Raffle should non-authorized human intervention or other causes outside of Sponsor’s control corrupt, undermine or impair the administration, security, fairness or proper play of the Raffle.

GOVERNING LAW/JURISDICTION: ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL RULES OR THE RIGHTS AND OBLIGATIONS OF PARTICIPANTS OR SPONSOR IN CONNECTION WITH THE RAFFLE SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE INTERNAL LAWS OF THE STATE OF CALIFORNIAWITHOUT GIVING EFFECT TO ANY CHOICE OF LAW OF CONFLICT OF LAW RULES OR PROVISIONS THAT WOULD CAUSE THE APPLICATION OF ANY OTHER STATE’S LAWS. THE INVALIDITY OR UNENFORCEABILITY OF ANY PROVISION OF THESE RULES SHALL NOT AFFECT THE VALIDITY OR ENFORCEABILITY OF ANY OTHER PROVISION. IN THE EVENT THAT ANY PROVISION IS DETERMINED TO BE INVALID OR OTHERWISE UNENFORCEABLE OR ILLEGAL, THESE RULES SHALL OTHERWISE REMAIN IN EFFECT AND SHALL BE CONSTRUED IN ACCORDANCE WITH THEIR TERMS AS IF THE INVALID OR ILLEGAL PROVISION WERE NOT CONTAINED HEREIN. EACH PERSON WHO PARTICIPATES IN THE RAFFLE IRREVOCABLY AGREES THAT THE STATE AND FEDERAL COURTS LOCATED IN LOS ANGELES, CALIFORNIA SHALL HAVE EXCLUSIVE JURISDICTION OVER ANY SUIT OR OTHER PROCEEDING ARISING OUT OF OR BASED UPON THIS AGREEMENT, AND EACH HEREBY WAIVES ANY CLAIM THAT IT IS NOT SUBJECT PERSONALLY TO THE JURISDICTION OF SAID COURTS OR THAT ANY SUCH SUIT OR OTHER PROCEEDING IS BROUGHT IN AN INCONVENIENT FORUM OR IMPROPER VENUE. THIS RAFFLE IS VOID WHERE PROHIBITED BY LAW.
