Cowens Camps Scholarships Official Rules
NO PURCHASE NECESSARY TO WIN: To apply for or nominate someone age 10 to 18 for a scholarship, complete the online entry form on celtics.com; or mail completed entry to Boston Celtics, Attn: “Celtics Cowens Camps Scholarship”, Corporate Partnerships, 226 Causeway Street, 4th floor, Boston, MA 02114. Banner Seventeen, LLC (d/b/a the Boston Celtics) (“Celtics”), Reebok, CampCo LLC, the National Basketball Association and its Member Teams, NBA Properties, Inc., and their respective parents, subsidiaries, affiliates, directors, officers, governors, owners, employees, and agents (all collectively, the “Sponsoring Entities”) will not be responsible for lost, misdirected, late, postage due, incomplete, illegible or unintelligible entries or for inaccurate entry information whether caused by participant or by any of the equipment or programming associated with or utilized in this scholarship program, or by any technical or human error that may occur in the processing of entries. Mechanically reproduced or automated entries are not permitted and will be deemed void. Incomplete and/or duplicate entries from the same address will be void. The scholarship program runs from 5/17/2013 to 6/24/2013. All entries must be received by 6/28/2013, regardless of entry method. Reebok, CampCo LLC and the Celtics are not responsible for late, lost, misdirected, torn, altered, incomplete or illegible entries. By submitting an entry or accepting a prize, participants accept and agree to be bound by these rules and the decisions of Reebok, CampCo LLC, and the Celtics, which shall be final on all matters.
ELIGIBILITY: Open to individuals who reside within a 75-mile radius of Boston, MA, and who (a) will be between the ages of 10 and 18 on 7/8/2013, or (b) are nominating someone who will be between the ages of 10 and 18 on 7/8/2013, who reside within a 75-mile radius of Boston. Scholarship program not open to employees or immediate family members (spouses, parents, siblings and children) of employees of the Sponsoring Entities, or any male who played or is playing for any high school program or any other competitive basketball program (e.g., an AAU team). Void where prohibited, or otherwise restricted, by law. All federal, state and local laws and regulations apply. Winners must sign an affidavit of eligibility and liability/publicity release or prize will be forfeited. If winners cannot be located within three (3) business days of drawing date, alternate winners will be chosen and the prize will be awarded. All entries become property of Reebok, CampCo LLC and the Celtics. One submission per person.
PRIZES. Fourteen (14) winners, deemed to be the most deserving in the Celtics’ sole discretion, will be chosen on or about 6/28/2013 by a Selection Committee consisting of Celtics staff. Winners will receive a scholarship to one week of Celtics Cowens Camps, with specific date and camp location (among the scheduled sessions) to be determined by the Celtics in their sole discretion, following consultation with each winner’s parent or guardian. Eight (8) scholarships to Waltham location camps, with approximate retail value (“ARV”) $475 each, four (2) scholarships to Hanover location camp, with approximate retail value (“ARV”) $475 each, two (2) scholarships to Hampton location camp, with approximate retail value (“ARV”) $475 each, and two (2) scholarships to Canton location camp, with approximate retail value (“ARV”) $475 each shall be awarded. Approximate retail value (“ARV”) of all prizes is $6,650. Winners’ parents or guardians are solely responsible for all applicable federal, state and local taxes and any expenses associated with the scholarship, unless otherwise indicated. In the event a winner cannot be contacted within three (3) business days of application deadline date or declines the prize, another winner will be selected. Camp participants shall be required to comply with all camp rules and shall be required to execute (or have a parent or guardian execute) the camp’s standard waiver and/or release from liability forms and/or any other any other agreements which all campers (or parents and guardians) are required to execute.
ODDS OF WINNING. Odds of winning are dependent on the number of eligible entries received. There will be a total of fourteen (14) winners chosen. Selection of the winners will be made by the Celtics in their sole discretion.
ASSIGNMENT OF RIGHTS. Entrants and winners agree that the Sponsoring Entities and their designees may use their entry, entrant’s name, voice, city/state of residence, photograph and/or likeness for advertising and/or trade and/or for any other purpose in any media or format now or hereafter known without further compensation, permission or notification. Entrants and winners further grant the Sponsoring Entities a royalty-free, world-wide, perpetual, non-exclusive license to display, distribute, reproduce, and create derivative works of the entries, in whole or in part, in any media now existing or subsequently developed, for any purpose, including, but not limited to advertising and promotion. The Sponsoring Entities will not be required to pay any additional consideration or seek any additional approval in connection with any use of any portion of any entry. By entering or accepting a prize, entrants and winners warrant that they have the rights to use (and assign to the Sponsoring Entities the above rights to use) any materials submitted as part of their entry or entries, agree to grant and agree to hold the Sponsoring Entities harmless for any liability, loss, injury, or damage to property or to person (all, collectively, “Losses”), including claims of infringement, misappropriation, or other misuse or alleged misuse of the intellectual property rights, rights of privacy, or rights of publicity of a third party by the Sponsoring Entities, due in whole or in part, directly or indirectly, to any use by Sponsors or their designees of any portion of a particular entry, even if such Losses were caused or contributed to by the negligence of the Sponsoring Entities. By entering or accepting a prize, entrants or winners also acknowledge that the Celtics may edit entrants’ submissions in any way the Celtics deem fit on an as needed basis.
MISCELLANEOUS. By entering or accepting a prize, participants agree to be bound by these rules. In addition, all entrants and winners agree that the Celtics maintain the right to decide all matters and disputes arising from the scholarship program, and that the Celtics’ determination of the winners will be final and binding. No transfer, assignment, cash redemption or substitution of any prize is permitted, except by Sponsors due to prize availability and then with a prize of equal or greater value. By accepting prizes, winners agree that the Sponsoring Entities will have no liability and will be held harmless by winners for any liability, loss, injury, or damage to property or to person, including death, due in whole or in part, directly or indirectly, by reason of the acceptance, participation in, use or misuse of the prizes or participation in the scholarship program, even if caused or contributed to by the negligence of sponsors.
ADDITIONAL TERMS. The Sponsoring Entities reserve the right, in their sole discretion, to modify, terminate, or suspend this scholarship program should viruses, bugs, unauthorized human intervention or other causes beyond Sponsors’ control corrupt or impair the administration, security or fairness of the scholarship program. The Sponsoring Entities are not responsible for any human error that may occur in the processing of the entries, nor are they responsible for any error, omission, interruption, deletion, defect, communications line failure, theft or destruction of, unauthorized access to, delay in operation, transmission, or distribution of, or alteration of, entries, whether caused by the sender, any of the equipment or programming associated with or utilized in this scholarship program, or otherwise. Sponsors reserve the right, in their sole discretion, to disqualify any individual found to be tampering with the entry process or the operation of the scholarship program or web site; to be acting in violation of these rules; or to be acting in an unsportsmanlike or disruptive manner or with intent to annoy, abuse, threaten or harass any other person. Any use of robotic, automatic, programmed or similar entry methods will void all such entries submitted by such methods. In the event of a dispute as to entries submitted by multiple users having the same e-mail account, the authorized subscriber of the e-mail account used to enter the scholarship program at the actual time of the entry will be deemed to be the participant and must comply with these rules. The authorized account subscriber is deemed to be the natural person who is assigned an e-mail address by an Internet access provider, on-line service provider or other organization responsible for assigning e-mail addresses for the domains associated with the submitted e-mail addresses.
E-MAIL CHANGE OF ADDRESS POLICY. It is the sole responsibility of the entrant to notify the Celtics if his or her e-mail address or phone number changes.
DISPUTE/CHOICE OF LAW. All decisions of the Sponsor with regard to this scholarship program are final. Except where prohibited, each entrant and winner accepting a prize agrees that: (i) all issues and questions concerning these rules shall be governed by Massachusetts law without giving effect to any principles of conflicts of law of any jurisdiction; (ii) any and all disputes, claims and causes of action at law or in equity arising out of or relating to this scholarship program or any prize awarded shall be (A) resolved individually, without resort to any form of class action; and (B) filed only in the state courts situated in Massachusetts, and entrant hereby consents and submits to the personal jurisdiction of such courts for the purposes of litigating any such disputes, claims or causes of action; (iii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, but in no event attorneys' fees; and (iv) under no circumstances will any entrant be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental, special, consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
