Toyota half-court shot rules 2009-10

OFFICIAL PROMOTION RULES


1. NO PURCHASE NECESSARY TO ENTER OR TO WIN. A PURCHASE WILL NOT INCREASE YOUR ODDS OF WINNING. ALL FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.

2. ELIGIBILITY. PROMOTION open to Oregon & SW Washington residents 18 years of age and older, except employees (former and current), agents, successors and assignees of Trail Blazers Inc., Toyota Motor Corp., the Portland Metro Toyota Dealers Advertising Association, SCA Promotions Inc., the National Basketball Association and its Member Teams, NBA Properties Inc., and each of their respective affiliated companies, subsidiaries, and advertising or promotional agencies, and the family members of, agents, successors, or assigns of, and any persons domiciled with, such employees are not eligible for entry. The following are also not eligible to enter: (a) Current or former professional or semi-professional basketball players and coaches; (b) Current or former high school or collegiate basketball players or coaches who have played or coached at that level anywhere in the world within the past five (5) years (includes freshmen, junior varsity and varsity, for both men and women); and (c) persons who have been chosen as a previous contestant in this half court promotion during the past 12 months are also not eligible for entry.

3. ENTRY. Toyota ½ Court Shot for a 2010 Toyota (the "PROMOTION") will begin at 12:01 am prevailing Pacific Time on October 27, 2009 and all entries must be received by 11:59 p.m. prevailing Pacific Time on April 8, 2010 (the "PROMOTION Period"). One entry per person. There are two (2) ways to enter: (1) Enter online by visiting the Toyota ½ Court Shot for a 2010 Toyota official registration page on the trailblazers.com website and completing all of the required information, and following all instructions. Submit your entry by clicking on the "SEND" button. You must complete the entire form in order to enter the PROMOTION online, (2) Send in a post card with your name, address, city, state, zip and phone number to the Toyota ½ Court Shot for a 2010 Toyota, One Center Court, Ste 200, Portland, OR 97227. All entries must be received no later than April 8, 2010. No mechanical reproductions permitted. Trail Blazers Inc. and the Portland Metro Toyota Dealers Advertising Association (together “Sponsor”) will not be responsible for incomplete, lost, late, postage-due, misdirected or illegible entries, or for failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with sender or Sponsor. In the event of a dispute, all e-mail entries will be deemed to have been submitted by the owner of the e-mail account from which they were sent. For these purposes, an email account holder shall mean the natural person assigned to such email account by the Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with such e-mail account. Any questions regarding the number of entries submitted or the owner of an e-mail account shall be determined by Sponsor in its sole, reasonable discretion, and Sponsor reserves the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the PROMOTION.

. PRIZES. Sponsor will choose, at random one (1) contestant approximately twenty-four (24) hours prior to six (6) Trail Blazers home games during the 2009 - 2010 Trail Blazers season. The six (6) Trail Blazers home games are as follows: 11/8/09, 12/5/09, 1/10/10, 2/6/10, 3/25/10, and 4/12/10. Sponsor reserves the right in its sole discretion to change this schedule. Each of the six (6) contestants randomly selected will get two (2) game tickets to the Trail Blazers home game at which the contest (described below) will take place (seat selection determined by Sponsor in its sole discretion). Retail value of the tickets is $40.00. Odds of being chosen as a winner of the tickets/contestant for the contest depends on the number of eligible entries up to the date of each random drawing. The contestant chosen may not choose another person to participate on his/her behalf.

During the game, the contestant will have the chance to make a ½ court shot to win a new Toyota vehicle. Contestants shall not be permitted any practice, warm up or qualifying shots at anytime after his/her notification of participation in the contest, nor will any one contestant be selected to participate in this half court promotion on more than one occasion during the past 12 months. To determine which Toyota Branded Vehicle the winner will be shooting for, they will spin a wheel and whichever vehicle space it lands on, that will be the vehicle they could win. The vehicles on the wheel (and their retail values) will be as follows: 2010 Corolla - $17,750, 2010 Matrix (AWD) - $23,150, 2010 Prius - $22,750, 2010 Camry (gas) - $22,650, 2010 Avalon - $38,335, 2010 RAV4 - $30,725, 2010 Sienna - $35,905, 2010 Highlander (gas) - $37,765, 2010 Land Cruiser - $72,800, , 2010 Tacoma 4x4 - $31,915, 2010 Tundra: - $36,145, 2010 Sequoia - $63,000, 2010 4Runner - $43,500, 2010 FJ Cruiser - $29,720, 2010 Yaris - $16,275,, 2009 Venza - $38,205. Details and amenities included with each vehicle subject to Toyota’s sole discretion. Each spin of the wheel must complete no less than two (2) full revolutions in order to be considered for a prize. Spins completing less than two (2) revolutions are ineligible and must be spun again. Once contestant spins the wheel, the wheel must be not be touched or interfered with by anyone or anything. If the wheel is touched or interfered with during a spin, the contestant will be disqualified. Each contestant will spin the prize wheel to determine the prize amount that he/she will win in the event of he/she successfully makes the half-court shot pursuant to these terms, said prize being the prize listed on the slot on which the prize wheel comes to a complete stop after completing at least two complete revolutions. The contestant will have only one chance to spin the wheel, unless the wheel completes fewer than 2 revolutions. Once the wheel completes 2 revolutions, the contestant may not spin again.

The contestant must attempt to make the ½ court shot using an NBA-regulations basketball (or one of equivalent specifications) through the NBA-regulation basketball hoop of the target goal. The rim of the target hoop will be not less than ten (10) feet above the floor. The contestant must attempt the shot from behind the demarcation line measured 43 feet from the backboard of the target goal. The contestant will have only one attempt to make the shot. An attempt has occurred when the basketball has been released by the contestant. No part of the contestant’s body or clothing may come in contact with or cross the demarcation line prior to releasing the ball. In order to be counted as a successful shot, the basketball must pass completely through the target hoop on the fly, from the point of release from the contestant’s hand(s), without coming in contact with the ground, any person, or any surface other than the backboard or hoop, and would otherwise constitute a successful shot scoring a goal under NBA regulations.

4. WINNER NOTIFICATION AND ACCEPTANCE. The contestants/winners of the game tickets will be notified by telephone and/or U.S. Mail within twenty-four (24) hours of the start of the next game at which he/she will be given the opportunity to attempt the half-court shot.. Return of prize notification as undeliverable may result in disqualification. If a contestant/winner of the game tickets is disqualified, a new contestant/winner of game tickets will be selected in a random drawing. The contestant/winners may waive their right to receive a prize. Prizes are nonassignable and nontransferable. No substitutions allowed, except that prizes and individual components of prize packages are subject to availability and Sponsor reserves the right to substitute prizes of equal or greater value. The contestants/winners are solely responsible for reporting and payment of any federal, state, local, and municipal taxes on prizes and for payment of all expenses associated with the game other than game tickets, such as, but not limited to, parking. The six (6) contestants chosen to attempt the half-court shot will be required to complete an affidavit of eligibility, and a liability and publicity release (except where prohibited by law) before attempting the half-court shot. The contestants will also be required to complete the “Contestant Agreement to Participate” provided by Sponsor’s prize indemnifier before attempting the half-court shot. Failure to sign and return the affidavit or release or the Contestant Agreement to Participate, or to comply with any term or condition of these Official Rules, may, at the sole discretion of Sponsor, result in disqualification and the forfeiture of his or her interest in the prize. Except where prohibited, participation in the Toyota ½ Court Shot for a 20-10 Toyota Promotion constitutes the winner’s consent to the publication, dissemination and use of his or her name, photograph, image, likeness and voice by Sponsor, SCA Promotions, their designees, and/or the National Basketball Association and its Member Teams, NBA Properties, Inc. in any media at any time for any purpose without any additional compensation to, permission from or inspection by the winner. If any of the contestants make the half-court shot, such contestants agree to execute all necessary and requested documents, including without limitation the “Winner’s Affidavit and Release”, as requested by Sponsor and Sponsor’s prize indemnifier and agree to provide a copy of a government issued identification card containing a photo of the winner.

5. PARTICIPATION. By participating and/or accepting the prize, the contestants/winners agree to be bound by these Official Toyota ½ Court Shot for a 2010 Toyota Rules and the decisions of Sponsor and SCA Promotions. By entering, the contestants/winners further agree to be bound by the terms relating to the use of this website, including its Privacy Policy. Sponsor reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of this Toyota ½ Court Shot for a 2010 Toyota Promotion as solely determined by Sponsor. In the event the Toyota ½ Court Shot for a 2010 Toyota Promotion is compromised by a virus, non-authorized human intervention, tampering or other causes beyond the reasonable control of Sponsor which corrupts or impairs the administration, security, fairness or proper operation of the Toyota ½ Court Shot for a 2010 Toyota Promotion, Sponsor reserves the right in its sole discretion to suspend, modify or terminate the Toyota ½ Court Shot for a 2010 Toyota Promotion. Should the Toyota ½ Court Shot for 2010 Toyota Promotion be terminated prior to the stated expiration date, Sponsor reserves the right to award prizes based on the entries received before the termination date.

6. PRIZE WINNERS. For a Winners list (available after April 20, 2010), send a self-addressed, stamped envelope to Toyota ½ Court Shot for a 2010 Toyota, One Center Court, Ste 200, Portland, OR 97227.

7. LIMITATIONS OF LIABILITY. By entering the Toyota ½ Court Shot for a 2010 Toyota Promotion and accepting the prize, the contestants/winners agree that (1) any and all disputes, claims, and causes of action arising out of or in connection with the Toyota ½ Court Shot for a 2010 Toyota Promotion, or any prizes awarded, shall be resolved individually without resort to any form of class action; (2) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Toyota ½ Court Shot for a 2010 Toyota Promotion, but in no event attorney's fees; and (3) under no circumstances will the contestants/winners be permitted to obtain any award for, and the contestants/winners hereby waive all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses.

8. CONSTRUCTION. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Toyota ½ Court Shot for a 2010 Toyota Rules, or the rights and obligations of the winner and Toyota and the Trail Blazers, shall be governed by, and construed in accordance with the laws of the State of Oregon, without giving effect to any choice of law or conflict of law rules or provisions (whether of Oregon, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than Oregon. The invalidity or unenforceability of any provision of these rules shall not affect the invalidity or unenforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein. Contestants agree that should any dispute arise between contestant(s) and Sponsor’s prize indemnifier, such dispute must be submitted to binding arbitration in accordance with the rules of the American Arbitration Association. The venue for such arbitration shall be Dallas, Texas.

9. WINNER RELEASES. By entering the Toyota ½ Court Shot for a 2010 Toyota Promotion and accepting the prize, the winner release Toyota, Trail Blazers Inc., the National Basketball Association and its Member Teams, NBA Properties Inc., any other promotional sponsors, and each of their respective affiliated companies, and subsidiaries, directors, officers, employees, representatives, partners and agents from any liability whatsoever for any claims, costs, injuries, losses or damages of any kind arising out of or in connection with the Toyota ½ Court Shot for a 2010 Toyota Promotion or with the acceptance, possession or use of any prize (including, without limitation, claims, costs, injuries, losses or damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light) .

10. SPONSOR. Toyota ½ Court Shot for a 2010 Toyota Promotion is sponsored by Trail Blazers Inc. and Portland Metro Toyota Dealers Advertising Association (together “Sponsor”). Sponsor’s decisions regarding the selection of Winners and all other aspects of the Toyota ½ Court Shot for a 2010 Toyota shall be final and binding in all respects. Sponsor will not be responsible for typographical, printing or other inadvertent errors in these Official Toyota ½ Court Shot for a 2010 Toyota Rules or in other materials relating to the Toyota ½ Court Shot for a 2010 Toyota Promotion.
