Chalupa Player of the Game Official Rules
1. NO PURCHASE NECESSARY TO ENTER OR TO WIN. A PURCHASE WILL NOT INCREASE YOUR ODDS OF WINNING. ALL FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.
2. ELIGIBILITY. Promotion open to Oregon and Southwest Washington residents residing within 75 miles of Portland, Oregon, 18 years or older at the time of entry, except employees of Trail Blazers Inc., Taco Bell®, the National Basketball Association and its Member Teams, NBA Properties Inc., and each of their respective affiliated companies, subsidiaries, and advertising or promotional agencies, and the immediate family members of, and any persons domiciled with, such employees, who are not eligible to enter.
3. ENTRY. The “Taco Bell® Chalupa Player of the Game” Promotion (the "Promotion") will begin at 12:01 a.m. (prevailing Pacific time) October 20, 2009, and all entries must be received by 11:59 p.m. (prevailing Pacific time) on day before the last 2009-2010 game (regular season or playoff, as applicable) in which the Trail Blazers participate (the "Promotion Period"). To enter, visit www.trailblazers.com, provide all the required information and provide the name of the Trail Blazers’ player that you believe will score the 100th point for the Trail Blazers during a Trail Blazers game. Your player choice will be registered for the entire season. Entrants will be chosen by a random drawing (which drawing will occur no later than 48 hours before the official game time), and if you are chosen and have correctly guessed the player who scores the 100th Trail Blazers’ point in the next game, you will receive the prize described below. There are a maximum possible number of winners equal to the number of regular season games during the Promotion Period, which are 82 (in addition to playoff games in which the Trail Blazers participate, if any). One entry per person. No mechanical reproductions permitted. Trail Blazers Inc. and Taco Bell® (together "Sponsor") will not be responsible for incomplete, lost, late, postage-due, misdirected or illegible entries, or for failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with sender or Sponsor. In the event of a dispute, all e-mail entries will be deemed to have been submitted by the owner of the e-mail account from which they were sent. For these purposes, an email account holder shall mean the natural person assigned to such email account by the Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with such e-mail account. Any questions regarding the number of entries submitted or the owner of an e-mail account shall be determined by Sponsor in its sole, reasonable discretion, and Sponsor reserves the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the Promotion.
4. PRIZES AND ODDS. Each winner (those who were randomly-drawn as described above and also guessed the correct Blazers’ player’s name who scored the 100th Trail Blazers’ point of the game, if that occurs) will receive a Taco Bell® and Blazers gift pack (which includes a Trail Blazers sweatshirt, t-shirt, hat, bag, and basketball) with an estimated retail value of $150. Odds of winning depend on the number of eligible entries received up to the date of the drawing, and whether you have guessed correctly the player who actually scores the 100th Trail Blazers’ point, if applicable.
5. WINNER NOTIFICATION AND ACCEPTANCE. Persons whose names are drawn will be announced at the start of each radio broadcast. Winners (those people whose names were drawn and who guessed the correct Blazers’ player’s name who scored the 100th Trail Blazers’ point of the game, if that occurs) will be notified by telephone and/or electronic mail within five (5) business days of the game for which he/she is the winner. Return of prize notification as undeliverable may result in disqualification. Winners may waive their right to receive a prize. Prizes are nonassignable and nontransferable. No substitutions allowed, except that prizes and individual components of prize packages are subject to availability and Sponsor reserves the right to substitute prizes of equal or greater value. Winners are solely responsible for reporting and payment of any federal, state, local, and municipal taxes and for all costs associated with the prize (e.g., parking and transportation to the game). Winners may be required to complete an affidavit of eligibility, and a liability and publicity release (except where prohibited by law) which must be returned within ten (10) days of date of postmark. Failure to sign and return the affidavit or release within ten (10) days, or to comply with any term or condition of these Official Rules, may, at the sole discretion of Sponsor, result in a winner's disqualification, and the forfeiture of his or her interest in the prize. Except where prohibited, participation in the Promotion constitutes entrant's consent to the publication, dissemination and use of his or her name, photograph, image, likeness and voice by Trail Blazers Inc., and/or the National Basketball Association and its Member Teams, NBA Properties, Inc., and each of their respective parents, subsidiaries and affiliates in any media, at any time, for any purpose, without any additional compensation to, permission from or inspection by entrant.
6. PARTICIPATION. By entering and participating, entrant agrees to follow and be bound by these Official Rules and the decisions of the Sponsor and hold harmless and indemnify Sponsor, Trail Blazers Inc., the National Basketball Association and its Member Teams, NBA Properties, Inc., and each of their respective parents, subsidiaries, affiliates, directors, officers, employees and agents against any and all liability, damages or causes of action (however named or described), with respect to or arising out of either (i) entrant’s participation; or (ii) the receipt or use of the prizes awarded in the promotion. By entering, participants further agree to be bound by the terms relating to the use of this website, including its Privacy Policy. Sponsor reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of this Promotion as solely determined by Sponsor. In the event the Promotion is compromised by a virus, non-authorized human intervention, tampering or other causes beyond the reasonable control of Sponsor which corrupts or impairs the administration, security, fairness or proper operation of the Promotion, Sponsor reserves the right in its sole discretion to suspend, modify or terminate the Promotion. Should the Promotion be terminated prior to the stated expiration date, Sponsor reserves the right to award prizes based on the entries received before the termination date.
7. PRIZE WINNERS. For a prizewinners list, send a self-addressed, stamped envelope to “Taco Bell® Chalupa Player of the Game” Promotion Winners, One Center Court, Suite 200, Portland, Oregon 97227, after the end of the Trail Blazers’ 2009-2010 season, including any playoffs in which the team participates, but prior to July 31, 2010.
8. LIMITATIONS OF LIABILITY. By entering the Promotion, entrant agrees that (1) any and all disputes, claims, and causes of action arising out of or in connection with the Promotion, or any prizes awarded, shall be resolved individually without resort to any form of class action; (2) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Promotion, but in no event attorney's fees; and (3) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses.
9. CONSTRUCTION. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any entrant and Sponsor, shall be governed by, and construed in accordance with the laws of the State of Oregon, without giving effect to any choice of law or conflict of law rules or provisions (whether of Oregon, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than Oregon. The invalidity or unenforceability of any provision of these rules shall not affect the invalidity or unenforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.
10. GENERAL RELEASE. By entering the Promotion, entrants release Taco Bell® Corporation, Trail Blazers Inc., the National Basketball Association and its Member Teams, NBA Properties Inc., any other promotional sponsors, and each of their respective affiliated companies, directors, officers, employees, representatives, partners and agents from any liability whatsoever for any claims, costs, injuries, losses or damages of any kind arising out of or in connection with the Promotion or with the acceptance, possession or use of any prize (including, without limitation, claims, costs, injuries, losses or damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light) .
