2. ELIGIBILITY. Ford Fly Away Sweepstakes open to Oregon and Southwest Washington residents, 18 years at the time of entry, except employees of Trail Blazers Inc., NW Ford Stores, the National Basketball Association and its Member Teams, NBA Properties Inc., and each of their respective affiliated companies, subsidiaries, and advertising or promotional agencies, and the immediate family members of, and any persons domiciled with, such employees are not eligible for entry.

3. ENTRY. The Ford Fly Away Sweepstakes will begin at 12:00 AM (P.S.T.) on October 30, 2008 and all entries must be received by 11:59 p.m. (P.S.T.) on March 15, 2009 (the “Ford Fly Away Sweepstakes Period"). There are two (2) ways to enter: Enter online by visiting the contest page on www.trailblazers.com, clicking on the Ford Fly Away link, completing all of the required information and following all instructions or enter online by visiting compareford.com/trailblazers, completing all of the required information and following all instructions. Submit your entry by clicking on the "SEND" button. One (1) entry per person. Trail Blazers Inc. and NW Ford Stores (together "Sponsor") will not be responsible for incomplete, lost, late, postage-due, misdirected or illegible entries, or for failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with sender or Sponsor. In the event of a dispute, all e-mail entries will be deemed to have been submitted by the owner of the e-mail account from which they were sent. For these purposes, an email account holder shall mean the natural person assigned to such email account by the Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with such e-mail account. Any questions regarding the number of entries submitted or the owner of an e-mail account shall be determined by Sponsor in its sole, reasonable discretion, and Sponsor reserves the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the Ford Fly Away Sweepstakes.

PRIZES AND ODDS. There will be a total of four (4) winners. The odds of winning any prize depends on the number of eligible entries received up to the date of the respective drawings.

The first winner will be chosen from among all eligible entries on or about December 1, 2008. That winner will receive two (2) upper level tickets to a Trail Blazers home game determined by the Trail Blazers in its sole discretion, and a jersey autographed by a current Trail Blazers player (player chosen by the Trail Blazers in its sole discretion). Retail value of this prize is $250.

The second winner will be chosen from among all eligible entries on or about January 5, 2009. That winner will receive two (2) upper level tickets to a Trail Blazers home game to be determined by the Trail Blazers in its sole discretion, and a jersey autographed by a current Trail Blazers player (player chosen by the Trail Blazers in its sole discretion). Retail value of this prize is $250.

The third winner will be chosen from among all eligible entries on or about February 15, 2009. That winner will receive one (1) VIP Reception, including food and non-alcoholic beverage, in the Blazers Box Lounge on the 300 Level along with 10 upper level game tickets, game chosen by the Trail Blazers in its sole discretion. Retail value of this prize is $650.

The fourth winner will be chosen from among all eligible entries on or about March 15, 2009. That winner (the “Grand Prize Winner”) will receive roundtrip coach airfare for two (2) people to Los Angeles, CA (leaving Portland, OR on April 11, 2009, to Los Angeles and returning to Portland on April 12, 2009), one night’s lodging (hotel chosen by Sponsor in its sole discretion), two (2) game tickets to the Portland Trail Blazers vs. the Los Angeles Clippers game on April 11, 2009 (seat location chosen by Sponsor in its sole discretion), the use of a rental car while in Los Angeles (renter of the car subject to all requirements generally applicable to renters of cars, including, without limitation, possession of a valid drivers’ license) and $100 spending money. The retail value of this prize is $3500. Winner and winner’s guest (or the guest’s parent or legal guardian if the guest is under the age of 18) will be required to complete an affidavit of eligibility, and a liability and publicity release (except where prohibited by law). Failure to sign and return the affidavit or release as requested by Sponsor, or to comply with any term or condition of these Official Rules, may, at the sole discretion of Sponsor, result in a winner's disqualification, the forfeiture of his or her interest in the prize, and the award of prize to an alternate winner.

Expenses associated with the prizes not specifically mentioned (e.g., parking at Trail Blazers games) are the sole responsibility of the winners. All prizes will be awarded. Once you have won a prize, you are no longer eligible for additional prize drawings.

4. GRAND PRIZE WINNER NOTIFICATION AND ACCEPTANCE. Winner(s) will be notified by telephone within two (2) business days of the drawing. Return of prize notification as undeliverable may result in disqualification and an alternate winner may be selected randomly from among the remaining eligible entrants. Winner(s) may waive their right to receive a prize. Prizes are nonassignable and nontransferable. No substitutions allowed, except that prizes and individual components of prize packages are subject to availability and Sponsor reserves the right to substitute prizes of equal or greater value. Winner(s) are solely responsible for reporting and payment of any federal, state, local, and municipal taxes on prizes. Winner(s) are also responsible for all expenses associated with the prize, unless otherwise indicated. Except where prohibited, participation in the Ford Fly Away Sweepstakes constitutes entrant's consent to the publication, dissemination and use of his or her name, photograph, image, likeness and voice by Sponsor and/or the National Basketball Association and its Member Teams, NBA Properties Inc. in any media at any time for any purpose without any additional compensation to, permission from or inspection by entrant.

5. PARTICIPATION. By participating, entrants agree to be bound by these Official Rules and the decisions of the Sponsor. By entering, entrants further agree to be bound by the terms relating to the use of this website, including its Privacy Policy. Sponsor reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of this Ford Fly Away Sweepstakes as solely determined by Sponsor. In the event the Ford Fly Away Sweepstakes is compromised by a virus, non-authorized human intervention, tampering or other causes beyond the reasonable control of Sponsor which corrupts or impairs the administration, security, fairness or proper operation of the Ford Fly Away Sweepstakes, Sponsor reserves the right in its sole discretion to suspend, modify or terminate the Ford Fly Away Sweepstakes. Should the Ford Fly Away Sweepstakes be terminated prior to the stated expiration date, Sponsor reserves the right to award prizes based on the entries received before the termination date.

7. LIMITATIONS OF LIABILITY. By entering the Ford Fly Away Sweepstakes, entrants agree that (1) any and all disputes, claims, and causes of action arising out of or in connection with the Ford Fly Away Sweepstakes, or any prizes awarded, shall be resolved individually without resort to any form of class action; (2) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Ford Fly Away Sweepstakes, but in no event attorney's fees; and (3) under no circumstances will any entrant be permitted to obtain any award for, and entrants hereby waive all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses. By entering, entrant agrees to follow the Official Rules and hold harmless and indemnify NW Ford Stores, the Portland Trail Blazers, and the National Basketball Association and its Member Teams, NBA Properties, Inc., and each of their respective parents, subsidiaries, affiliates, directors, officers, employees and agents against any and all liability, damages or causes of action (however named or described), with respect to or arising out of either (i) entrant’s participation; or (ii) the receipt or use of the prizes awarded in the promotion.

8. CONSTRUCTION. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any entrant and Sponsor, shall be governed by, and construed in accordance with the laws of the State of Oregon, without giving effect to any choice of law or conflict of law rules or provisions (whether of Oregon, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than Oregon. The invalidity or unenforceability of any provision of these rules shall not affect the invalidity or unenforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.

9. GENERAL RELEASE. By entering the Ford Fly Away Sweepstakes, entrants release Trail Blazers Inc., NW Ford Stores, the National Basketball Association and its Member Teams, NBA Properties Inc., any other promotional sponsors, and each of their respective affiliated companies, directors, officers, employees, representatives, partners and agents from any liability whatsoever for any claims, costs, injuries, losses or damages of any kind arising out of or in connection with the Ford Fly Away Sweepstakes or with the acceptance, possession or use of any prize (including, without limitation, claims, costs, injuries, losses or damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light) .

10. SPONSOR. The Ford Fly Away Sweepstakes is sponsored by Trail Blazers Inc. and NW Ford Stores (together “Sponsor”). Sponsor’s decisions regarding the selection of winners and all other aspects of the Ford Fly Away Sweepstakes shall be final and binding in all respects.
