The Burger King Full Court Pass Promotion

ELIGIBILITY. The Burger King Full Court Pass Promotion (the Promotion is open to residents within a 75 mile radius of Portland, Oregon, except spouses, parents, siblings and children of Burger King Corporation (BKC), Trail Blazers Inc. (TBI and, together with BKC, Sponsor), the National Basketball Association and its Member Teams, NBA Properties, Inc., and each of their respective parents, subsidiaries, affiliates, directors, owners, employees and agents are not eligible to enter. The winner of the 2011-2012 Trail Blazers Season Tickets, if under the age of 18, must provide parent/legal guardian consent to redeem prize.
ENTRY. This Promotion begins on December 27, 2010 at 12:00 p.m. (prevailing Pacific time), and all entries must be received by 11:00 p.m. (prevailing Pacific time) on February 28, 2011. There are two (2) ways to enter: (1) With every upgrade of any Regular Value Meal to a Large Value Meal at participating BURGER KING® Restaurants, customers will receive a co-branded Burger King and Trail Blazers commemorative cup. The commemorative cup will feature details about the Full Court Pass Promotion and how to enter to win on trailblazers.com. Consumers must go to the Burger King Full Court Pass landing page on trailblazers.com via a rotating promo button on the site and a banner campaign and click on the applicable link, completing all of the required information, following all instructions, and submitting the information, and (2) Fans can also send in a post card to: Full Court Pass Promotion, One Center Court, Ste. 200, Portland, OR 97227, to enter to win. All mailed requests to enter to win Full Court Pass must be received on or before February 28, 2011 and must include the name, address and phone number of the person entering the contest. No mechanical reproductions permitted. TBI will not be responsible for incomplete, lost, late, postage-due, misdirected or illegible entries, or for failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with sender or TBI. In the event of a dispute, all e-mail entries will be deemed to have been submitted by the owner of the e-mail account from which they were sent. For these purposes, an email account holder shall mean the natural person assigned to such email account by the Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with such e-mail account. Any questions regarding the number of entries submitted or the owner of an e-mail account shall be determined by TBI in its sole, reasonable discretion, and TBI reserves the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the Promotion.
PRIZES AND ODDS. The winners will be notified by telephone after the random drawing on March 3, 2011. All prizes must be redeemed by April 1, 2011 or they are null and void. There are 200,000 commemorative promotion cups produced. The odds of winning a prize depend on the number of entries received. A total of twenty seven (27) winners will be selected in a random drawing from among all eligible entries to be held after 5:00 pm on March 3, 2011. The odds of winning any particular prize depend on the number of prizes in each prize tier. The prize tiers are as follows: ( Tier 1) 1 (one) pair (two game tickets per game) of 2011- 2012 Trail Blazers Season Tickets with an approximate retail value (ARV) of $3,000.00 (Season ticket location is at the sole discretion of TBI), anda suite night including 22 total tickets in the suite to the March 25, 2011 Trail Blazers game vs. Dallas Mavericks, with an approximate retail value (suite location is at the sole discretion of TBI) ARV of $3,500.00 (includes full food and beverage, a visit from a Trail Blazers broadcaster, a visit from two BlazerDancers, and a visit from a Trail Blazers Alumni Ambassador); (Tier 2) 1 (one) Burger King Rip City Row Night including 14 total tickets (ticket location at the sole discretion of TBI) to the March 15, 2011 game vs. Dallas Mavericks with an ARV of $40 for each ticket (total of $560); (Tier 3): 5 (five) pairs of tickets (seat location at the discretion of TBI) to the April 1, 2011 Trail Blazers game vs. Oklahoma City and a Trail Blazers merchandise gift pack with an ARV of $20 per ticket and $25 per gift pack; and (Tier 4): twenty (20) pairs of tickets (seat location at the discretion of TBI) to the April 1, 2011 Trail Blazers game vs. Oklahoma City with an ARV of $20 per ticket.
WINNER NOTIFICATION AND ACCEPTANCE. The winner(s) may waive their right to receive a prize. If the winner(s) waive their right to receive a prize or if Sponsor is unable to contact the winner(s) (as determined in Sponsors sole discretion), such winner will be disqualified and an alternate winner will be selected randomly from among the remaining entrants. Prizes are nonassignable and nontransferable. No substitutions allowed, except that prizes and individual components of prize packages are subject to availability and Sponsor reserves the right to substitute prizes of equal or greater value. Winner is solely responsible for all applicable federal, state and local taxes and any expenses associated with the prize, unless otherwise indicated. Winner (or winners parent/legal guardian, if winner is under the age of 18) may also be required to complete an affidavit of eligibility, and a liability and publicity release (except where prohibited by law). Failure to sign and return the affidavit or release as requested by BKC and TBI, or to comply with any term or condition of these Official Rules, may, at the sole discretion of TBI, result in winner's disqualification.
GENERAL RELEASE. By entering, entrant agrees to follow the Official Rules and hold harmless and indemnify BKC, TBI, the National Basketball Association and its Member Teams, NBA Properties, Inc., and each of their respective parents, franchisees, subsidiaries, affiliates, directors, officers, employees and agents against any and all liability, damages or causes of action (however named or described), with respect to or arising out of either (i) entrants participation; or (ii) the receipt or use of the prizes awarded in the Promotion. In consideration for being awarded the prize, each winner hereby agrees and consents, without further authorization, compensation or remuneration of any kind, to the use of winners name and/or likeness in any and all advertising, promotions and other publicity conducted by TBI, BKC, the National Basketball Association and its Member Teams, NBA Properties, Inc., and each of their respective parents, subsidiaries and affiliates. The Full Court Pass Promotion is void where prohibited.
LIMITATIONS OF LIABILITY. By entering the Promotion, entrants agree that (1) any and all disputes, claims, and causes of action arising out of or in connection with the Promotion, or any prizes awarded, shall be resolved individually without resort to any form of class action; (2) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Promotion, but in no event attorney's fees; and (3) under no circumstances will any entrant be permitted to obtain any award for, and entrants hereby waive all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses.
CONSTRUCTION. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any entrant and TBI, shall be governed by, and construed in accordance with the laws of the State of Oregon, without giving effect to any choice of law or conflict of law rules or provisions (whether of Oregon, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than Oregon. The invalidity or unenforceability of any provision of these rules shall not affect the invalidity or unenforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.
