No other material, including without limitation, offensive, sexually explicit, profane or illegal material, as determined by Trail Blazers Inc. in its sole discretion, may be included in the videos and if any such material is included, that video will be disqualified. You may enter as many times as you like. Trail Blazers Inc. In the event of a dispute, all videos will be deemed to have been submitted by the owner of the e-mail account from which they were sent. For these purposes, an email account holder shall mean the natural person assigned to such email account by the Internet access provider, online service provider or other organization responsible for assigning e-mail addresses for the domain associated with such e-mail account. Any questions regarding the owner of an e-mail account shall be determined by Sponsor in its sole, reasonable discretion, and Sponsor reserves the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the Contest.
3. PRIZES AND ODDS. This Contest is based on skill, not chance. The odds of your video being selected as the winning video depend entirely upon the following selection process: The three videos with the highest score based on an average of the video’s total number of views and scores received by the video (averaging as determined by Sponsor in its sole discretion) will be voted on to determine the winner. Specifically, people will be asked to visit trailblazers.com after April 7th to vote for their choice of their favorite video, 1, 2 or 3. The video that receives the most votes in its favor will receive the Grand Prize. The Grand Prize is two (2) seats for the Trail Blazers game against Golden State on April 18, 2007, and a meet and greet with Brandon Roy after that game. The retail value of the Grand Prize is $512.00. The two videos that receive the second and third most votes will each receive two (2) tickets to a game (game and seat location determined by Sponsor in its sole discretion) and a Brandon Roy jersey. Retail value of the second and third place prizes are $150.00.
4. WINNER NOTIFICATION AND ACCEPTANCE. Sponsor will message the winners to notify them that they have won on iamatrailblazersfan.com. Return of prize notification as undeliverable or failure to respond as requested by Sponsor may result in disqualification and the video with the next highest average of total views and scores received and/or next most votes, as applicable, will be chosen as an alternate winner. Winner(s) may waive their right to receive a prize. Prizes are nonassignable and nontransferable. No substitutions allowed, except that prizes and individual components of prize packages are subject to availability and Sponsor reserves the right to substitute prizes of equal or greater value. Winner(s) are solely responsible for reporting and payment of any federal, state, local, and municipal taxes on prizes. Winner(s) are also responsible for all expenses associated with the prize, unless otherwise indicated. Winner(s), if under the age of 18, must provide parent/legal guardian consent to redeem prize. Winner(s) (or their parent/legal guardian, if winner(s) under the age of 18) may be required to complete an affidavit of eligibility, and a liability and publicity release (except where prohibited by law). Failure to sign and return the affidavit or release as requested by Sponsor, or to comply with any term or condition of these Official Rules, may, at the sole discretion of Sponsor, result in a winner's disqualification, the forfeiture of his or her interest in the prize, and the award of prize to an alternate winner. Except where prohibited, participation in the Contest constitutes entrant's consent to the publication, dissemination and use of his or her name, photograph, image, likeness and voice by Sponsor and/or the National Basketball Association and its Member Teams, NBA Properties Inc. in any media at any time for any purpose without any additional compensation to, permission from or inspection by entrant. All videos become the property of the Sponsor. As a condition for participating in the Contest, participants irrevocably assign and transfer all rights, title and interest in and to their videos, including but not limited to copyrights and all other proprietary rights, to the Sponsor. By participating in the Contest, participants further agree that additional written authorization, assignment or other documentation requested by the Sponsor in connection with the transfer and assignment of rights to their videos may be required as a condition of entry and agree to execute any such documents at the request of the Sponsor. Sponsor obtains the right, without limitation, to use, edit, and publish, in whole or in part, any and all videos in any media whatsoever, without time or geographical restrictions, without providing any additional compensation or consideration to participants. Participation in the Contest will be conclusively deemed to be a waiver of any and all claims, including for publicity, invasion of privacy, defamation and ownership and use of videos.
