The 2009 NBA All-Star Balloting Sweepstakes (“Sweepstakes”) is open to legal residents (natural persons only) of the 50 United States, the District of Columbia, and Canada (excluding residents of Quebec) who are 13 years of age or older as of 11/13/08 (“Participants”). Eligible minors must obtain their parent’s or legal guardian’s consent prior to participation. Employees, officers, directors, representatives and agents of NBA Properties, Inc., (“Sponsor”), NBA Media Ventures, LLC, the National Basketball Association and its member teams, T-Mobile USA, Inc., Tech Marketing Communications Group (“TMC”), Take Two Interactive Software, Inc., and each of their respective parent companies, subsidiaries, affiliates, governors, owners, distributors, retailers, advertising/promotion agencies and Project Support Team, Inc. (“P/S/T”) (collectively, “Released Parties”), and the immediate family members (parent, spouse, sibling or child, regardless of where they reside) and those living in the same household of each, whether or not related, are not eligible to participate or win. Sweepstakes is subject to all applicable federal, provincial, state, and local laws. How To Participate:
There are (3) ways to enter the Sweepstakes. Between 12:00:01PM Eastern Time (“ET”) on 11/13/08 and 11:59:59PM ET on 1/19/09 (“Promotion Period”): 1.) Complete an Official NBA All-Star 2009 ballot form distributed while supplies last during participating home games of any of the 30 NBA teams and either deposit the completed ballot in a ballot box located in the arena by 1/11/09 or mail the completed ballot to be received by 1/19/09 to: NBA All Star Balloting c/o TMC Group, P.O. Box 1550, Pembroke, MA 02359-1550; 2.) Visit www.NBA.com, follow the links to the Sweepstakes registration page and complete and submit the Official NBA All-Star 2009 Ballot form according to the instructions provided. Limit one (1) online entry per person and per email address per day of the Sweepstakes. Additional online entries received from any one person or email address thereafter during any one day will be void; or 3.) Hand print your name, complete mailing address, date of birth, and telephone number (including area code) on a plain 3”x 5” index card, and mail it to: 2009 NBA All-Star Balloting Sweepstakes, P.O. Box 17036, Bridgeport, CT 06673-7036. Enter as often as you wish by mail (whether using the Official NBA All-Star 2009 Ballot form or your own 3”x 5” mail entry), but each entry must be mailed separately. All 3”x 5” mail entries must be postmarked by 1/20/09 and received by 1/26/09. The individual for whom you cast your ballot will have no impact on your chances of winning. No photocopied, computer generated facsimiles, mechanically reproduced, or mass entries permitted and all such entries will be void. Released Parties are not responsible for lost, incomplete, illegible, late, misdirected, stolen, undelivered, misdirected, damaged, garbled, postage-due or mutilated entries, Official Ballot Forms, mail or email; lost entries or transmissions; lost or stolen ballot boxes; any error, omission, interruption, defect or delay in transmission, interrupted or unavailable network, cable, satellite, Internet Service Provider (ISP), server or other connections; miscommunications, failed computer hardware or software or technical failures; garbled, misrouted or scrambled transmissions; incomplete entries or communications; or other errors; printing, typographical or other errors appearing within these Official Rules, in any Sweepstakes-related advertisements or other materials; or other errors or problems of any kind whether mechanical, human, computer, electronic, mail or otherwise relating to or in connection with the Sweepstakes, including, with limitation, errors or problems which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the prizes, or cancelled or postponed games. Sponsor reserves the right, in its sole discretion, to void any and all entries of an entrant who Sponsor believes has attempted to tamper with or impair the administration, security, fairness or proper play of this Sweepstakes. The use of automated or similar devices which subvert the entry process, including but not limited to entries submitted using any bot, macro, script, or sweepstakes service (or any other devices intended to automate any aspect of entry) to enter this Sweepstakes is prohibited and entries through such devices are void. Winner Selection:
Potential winners will be selected in a random drawing on or about 1/28/09 from among all eligible entries received by P/S/T, an independent judging organization whose decisions will be final and binding in all matters relating to this Sweepstakes. Odds of winning will depend on the number of eligible entries received. The first randomly selected potential winner that answers a telephone call placed by P/S/T notifying him/her of his/her potential winning status and who agrees to accept such prize will be declared the Grand Prize winner, subject to verification of eligibility and the terms of these Official Rules. Messages will not be left on answering machines or with live persons and if an individual declines prize or is not available for any reason when called, his/her prize opportunity will be forfeited and, at Sponsor’s discretion, an alternate winner will be selected. Potential Grand and 1st Prize winners will be notified by email, telephone and/or mail. In the event of a dispute as to the identity of any entrant, entrant will be deemed, as applicable, the person named on the applicable entry (whether using the Official Ballot Form and/or your own 3”x 5” mail entry); or for the online entry method (#2. above), the authorized account holder of the e-mail address submitted at the time of entry and such individual must comply with these Official Rules. “Authorized account holder” is defined as the natural person who is assigned to the e-mail address by an Internet access provider, online service provider or other organization (e.g., business, educational institution, etc.) which is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Proof (to Sponsor’s satisfaction) of being the authorized account holder may be required by Sponsor. If an eligible Canadian entrant is selected as a potential winner, he/she will be required to correctly answer, without assistance of any kind, whether mechanical or otherwise, a time-limited mathematical skill-testing question administered by telephone at a pre-arranged, mutually convenient time before being declared a winner. If a potential Canadian winner cannot be reached by telephone within seventy two (72) hours of the first attempt to administer skill-testing question, the prize may be forfeited and, at Sponsor’s sole discretion, an alternate potential winner selected. Limit one (1) prize per person, per household and per e-mail address. Prizes:
(1) Grand Prize: A prize package consisting of the following: 1.) A four (4)-day/three (3)-night trip for two (2) to NBA All-Star 2009 in Phoenix, AZ between 2/13/09 and 2/16/09, consisting of round-trip coach air transportation from major gateway airport nearest to winner’s residence, standard double-occupancy hotel accommodations (one (1) room), two (2) tickets to select All-Star events and ground transportation to/from the airport and the applicable hotel; 2) One (1) 2009-2010 season ticket package for two (2) to one NBA team market (subject to availability and approval by Sponsor) (winner’s choice of team); 3.) Winner will have the opportunity to create a character which may be included in the 2K10 game; and 4.) One 2K9 Video Game (Approximate Retail Value ("ARV") of Grand Prize package=$16,000US). Actual prize value will vary depending on winner's city of departure and winner’s choice of season ticket package. Sponsor, in its sole discretion, reserves the right to provide ground transportation in place of air transportation if winner lives within a reasonable driving distance of Phoenix, AZ as determined by Sponsor, and to award no additional compensation or substitution for the difference in prize value. Travel and hotel arrangements determined by Sponsor in its sole discretion and must be made through Sponsor’s agent, on a carrier of Sponsor’s choice. Trip must be taken on dates and times designated by Sponsor or prize will be forfeited in its entirety and may be awarded to an alternate winner. Winner and guest must travel together on the same itinerary. Guest must be of legal age of majority in his/her jurisdiction of residence (and at least 18) unless child or legal ward of winner. Winner and guest are responsible for obtaining all necessary travel documents, including passports and visas (if applicable). If any Grand Prize events are canceled or postponed for any reason, travel prize will be awarded less applicable prize-related activity(s) and Sponsor will substitute that activity(s) with an item(s)/activity(s) of equal or greater value as determined solely by Sponsor. Winner and guest must comply with each event venue’s rules and regulations. Failure to do so may result in forfeiture of applicable prize element. Exact seat locations at games to be determined by Sponsor in its sole discretion. All prize details are at Sponsor’s sole discretion. Season ticket package consists of: two (2) tickets (mid-level seats) to the selected team’s 2009-10 regular season home games only. Certain travel restrictions may apply. (5) 1st Prizes: Two (2) tickets to a regular season NBA game in any one (1) team market (to be determined by Sponsor). Travel to and from game is not included in prize and is each winner’s sole responsibility. (ARV=$1,000US each). (50) 2nd Prizes: 2009 NBA All-Star Gift bag including one (1) 2K9 Video Game (ARV=$250US each). Total ARV of all prizes: $33,500US. Tickets are subject to terms and conditions specified thereon. Seat locations will be determined by Sponsor. Miscellaneous:
No transfer, assignment, cash redemption, or substitution of prizes (or portion thereof) except by Sponsor, who reserves the right to substitute a prize (or applicable portion thereof) with one of comparable or greater value (except as otherwise provided above), at its sole discretion. Prizes are awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. Federal, provincial, state, and local taxes (including income and withholding taxes) and all other costs and expenses associated with acceptance and use of a prize not specified herein as being awarded are winners’ sole responsibility, including, without limitation, additional ground transportation, luggage fees, meals and gratuities with respect to the Grand Prize. If an eligible minor is selected as a winner, prize may be awarded in the name of said minor’s parent or legal guardian who will be responsible for fulfilling all requirements imposed on winners set forth herein (although with respect to Grand Prize, if a minor is selected as a winner he/she must accompany his/her respective parent or legal guardian on trip as guest). Grand Prize winner (if minor, his/her parent or legal guardian) will be required to execute and return an Affidavit of Eligibility (or, if a resident of Canada, a Declaration), Liability Release and (where legal) Publicity Release within two (2) days of date of receipt of documents. Grand Prize winner’s guest (if child or legal ward of winner, winner) will also be required to execute and return a Liability Release and (where legal) Publicity Release prior to prize award. Non-compliance with any of the foregoing or with these Official Rules may result in disqualification and awarding of prize to an alternate winner, at Sponsor’s sole discretion and time permitting. If Grand Prize winner or guest is a minor, he/she must be accompanied to all prize-related activities by his/her parent or legal guardian. If any prize notification letter or prize is returned as undeliverable, in the event of non-compliance with these Official Rules, if a potential winner fails to execute and return all required documents within the specified time period, or Sponsor is unable to contact a potential winner within a reasonable time period, such potential winner will be disqualified and, at Sponsor’s discretion and time permitting, an alternate potential winner may be selected. Winner and guest must agree to comply with all NBA and venue rules and regulations relating to the use of NBA All-Star 2009 tickets or regular season tickets (as applicable) and, in accordance therewith, agree not to act in an unsportsmanlike or disruptive manner, or with any intent to annoy, abuse, threaten or harass any other person at such game. Failure to do so may result in forfeiture of prize or prize element (as applicable). Sponsor, in its sole discretion, reserves the right to: 1.) disqualify any person who tampers with the entry process, the operation of NBA.com, or any other component of this Sweepstakes, or who is otherwise in violation of these Official Rules and 2.) modify, suspend or terminate this Sweepstakes should virus, bug, worm, unauthorized intervention or other causes, including but not limited to war, strikes, terrorist activities, and/or acts of God, corrupt or impair the administration, security, fairness or proper play of this Sweepstakes and, in the event of termination, at its discretion, select winners from among eligible, non-suspect entries received as of the date of the event requiring such termination. By participating, participants (if minor, his/her parent or legal guardian) agree to be bound by these Official Rules and agree that: 1.) Released Parties and their designees and assigns may use (unless prohibited by law) such entrant’s name, voice, city/state of residence, biographical information, photograph, and/or other visual likeness for advertising and/or trade purposes and/or for the purpose of posting his/her name on NBA.com and/or for TV or radio broadcasts and/or for any other purpose in any media or format now or hereafter known worldwide in perpetuity without further compensation, permission or notification; and 2.) Released Parties are released, will have no liability whatsoever for, and shall be held harmless by participants against any liability for any injuries, losses or damages of any kind (whether due to negligence or otherwise) to person(s), including death, or property, resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize, or participation in this Sweepstakes including any travel or related activities associated with the foregoing.
